This is the latest edition of Baker & McKenzie’s column on developments in EU law relating to IP, IT and telecommunications. This article summarises recent developments that are considered important for practitioners, students and academics in a wide range of information technology, e-commerce, telecommunications and intellectual property areas. European national news

The regular article tracking developments at the national level in key European countries in the area of IT and communications - co-ordinated by Herbert Smith LLP and contributed to by firms across Europe. This column provides a concise alerting service of important national developments in key European countries. Part of its purpose is to compliment the Journal’s feature articles and briefing notes by keeping readers abreast of what is currently happening "on the ground" at a national level in implementing EU level legislation and international conventions and treaties. Where an item of European National News is of particular significance, CLSR may also cover it in more detail in the current or a subsequent edition.

刍议我国中医药专利保护制度

本文阐述了我国中医药专利保护制度的现状,分析了我国中医药专利保护制度存在的问题,如法律法规不健全、专利申请和保护意识淡薄等,从构建专门专利法律保护体系、建立数据库、提高专利意识和加速国际化进程等角度,提出了完善我国中医药专利保护制度的政策建议。     

《政府信息公开条例》第8条的理解与运用——就周某某不服政府信息公开案的法律分析

政府信息公开不得危及"公共利益"是各个国家确立政府信息公开的基本原则,该原则的核心是公共利益与公民知情权的微妙平衡。我国《政府信息公开条例》第8条也是基于这一目的,强调政府信息的公开不得危及"三个安全一个稳定。"但在该条款具体应用时,行政机关应特别注意不应单独适用,而应该有效地结合第14条以及第23条的规定来具体实施,即审查后不能确定是否可以公开时,应当依照法律、法规和国家有关规定报有关主管部门或者同级保密工作部门予以确定。     

搬迁移民权益法律保障研究——以“河北省桃林口水库”搬迁移民为视角

众多水利工程的修建带来了大量的移民,移民生活水平随着搬迁活动及生活环境的改变而下降许多,导致移民贫困化。为了保护移民利益、构建社会和谐,必须调高现有的移民补偿标准,加强移民资金管理,建立开发性移民扶持政策,构建完善的移民经济、政治、文化、社会生活权益保障体系,保证移民能够安居乐业。     

涉及商业秘密的政府信息公开问题初探

涉及商业秘密的政府信息是法定的公开例外种类之一。与涉及国家秘密的政府信息属于强制例外不同,涉及商业秘密的政府信息,行政机关具有部分自由裁量权。然而,由于缺乏对“商业秘密”、“公共利益”等要件的界定,同时也没有明确行政机关对此类政府信息的审查程序,因此,在实践中存在较大争议,有必要对政府信息公开语境下的商业秘密界定、公开程序的操作设想以及此类信息中的可分割性原则的适用等问题进行研究。     

赖昌星“难民”案的法律分析

赖昌星携家人潜逃加拿大后,向加拿大移民部提出了"难民"申请,由于加拿大难民制度完善而复杂,该案也一波三折。本文就赖昌星"难民"案所涉及的加拿大难民法律制度、该案争讼的焦点和该案目前的进展与前景做了简要介绍和分析。     

加强云南公安信息化工作的思考

预测性信息披露免责制度降低了上市公司潜在的诉讼风险,是充分尽到诚信义务的信息披露人的保护伞。可以从美国"安全港"各项规则入手,借鉴相关理论及实践经验,结合我国国情,提出完善我国预测性信息披露免责制度之构想,以期维护信息披露主体之正当利益,规范并鼓励我国上市公司预测性信息的披露。
