Constitutionalism and imperialism Sub Specie Spinozae

This paper examines the public, private and political in the work of Adriana Cavarero by drawing upon the situations of two women whose lives feature in her work: Elizabeth I and Penelope. It includes an analysis of the way in which Cavarero is rethinking Hannah Arendt’s view of ‘the political.’ Cavarero’s exposition of the metaphor of the King’s two bodies in the common law is explored, along with her critique of hylomorphism. Finally, it extends her work in Stately Bodies by considering different images of the power of the body in later political discourses regarding the worker’s body and the effect of the advance of techno-science. This paper was presented at ‘The State He’s In – Political Philosophy and the Figural: A Conference with Adriana Cavarero on her book Stately Bodies: Literature, Philosophy and the Question of Gender’ at Warwick University, Department of Philosophy in May 2004. Elizabethan ‘Spinning’ and Penelope’s Weaving: The Political, the Common Law and Stately Bodies

18世纪晚期以来,民主一直是人类政治生活的主题,民主化进程成了社会进步的主要评判标准,然而,实现了民主并不能保证没有了政治迫害,现实的民主远没有实现人类赋予它的使命。民主不能使任何个人的利益都得到切实的实现和保障。为了切实的保障个体的权利和利益,人类在反对一切特权民主的同时不得不对民主本身(民主本身也是一种特权,多数人的特权)加以限制,这就是宪政。那么宪政的真正涵义是什么?宪政的基本精神是什么?它与宪法到底是什么样的关系?宪政与民主到底是什么样的关系?本文将就这几个问题作出初步的回答。     

La parité législative en France, 2002‐07: Les stratégies partisanes de contournement de la loi

L'article dresse un bilan critique de la loi dite de parité, à partir de son application stratégique par les partis, lors des législatives de 2002 et de 2007. A partir de ces deux « cas pratiques », il s'efforce d'apprécier, face à l'épreuve des urnes, la portée d'une loi complexe, en fin de compte peu adaptée à la logique du scrutin uninominal. Quelques éléments d'explication sont proposés pour tenter de comprendre pourquoi la loi laisse paraître une (relative) inefficacité, avant de pointer les raisons pour lesquelles la plupart des partis parlementaires ne se sont pas saisis, autant qu'ils auraient pu, de l'outil égalitaire qui leur était proposé pour faire progresser la représentativité des femmes et, au‐delà, diversifier et démocratiser le recrutement parlementaire. Enfin, est esquissé à grands traits le profil politique et sociologique des femmes députées de la « génération parité », donnant à voir les principaux atouts dont elles disposent pour se couler dans le moule de la profession politique.     

传统民本思想的历史局限及其在社会主义政治文明建设中的发展

在中国,传统民本思想一直贯穿于封建社会的政治生态中,并在一定程度上促进了社会历史的发展,但中国传统民本思想有着无法克服的历史局限:封建专制对民主的否定、伦理关系对个性自由的否定、道德至上对法制原则的否定、人身依附对平等观念的否定。这些历史局限性也正是社会主义政治文明所要超越与发展的地方,这深刻体现在党的领导、主权在民、依法治国与以德治国的全过程中。     

现代政治发展中的政教分离原则与实践

作为近代以来民主宪政的一大成果,政教分离在政治现代化的国家逐渐变成了主流模式.政教分离的原则和实践并非一朝确立和形成,从认识到中世纪高度政教合一体制的弊端,通过政治宣言而废除之,到以宪法条文明确规定国家实行政教分离制度,逐步推进政治和司法改革,通过司法判决来规定政府与宗教之间的界限,最终实现从制度上保障政教分离,经历了复杂的政治和社会发展历程.战后日本的政教分离则是由外来的军事占领国根据外国本身的政教分离原则和实践来强行废除国教而设计出来的一种宪政体制.总结这些经验,有助于我们正确而合理地处理政治与宗教的关系.     

乡镇领导职业发展的实证分析

在考察有关官员职业发展的四个基本模型（即政绩模型、派系模型、地方主义模型以及“干部四化”模型）的基础上，本研究通过描述乡镇领导人的人格特征以及所在乡镇的经济、税收、人口总量及其发展速度等客观因素，来分析在乡镇领导人的职业发展中有哪些因素发挥了显著作用，进而考察政绩模型对于乡镇领导人职业发展的解释能力。经验数据显示，政绩模型对于乡镇领导人的职业发展具有一定的解释，其中“税收”相对“经济总量”而言是一个更能显著影响乡镇领导职业发展的变量。与此同时，领导人的学历、现任职务、年龄等方面的因素在领导人的职业发展中提供了较强的解释力，显示了“干部四化”模型在现实中的解释力。     

政治性作战新趋势

随着信息化时代的来临，人类战争出现一种新的作战样式——政治性作战。它是以实现“软杀伤”为主要目标，将各种资源与手段综合运用的一种作战样式。迄今为止，美军是全球唯一一支在信息化条件下进行过完整政治性作战的军队，它凭借信息技术优势，综合运用政治、经济、科技、文化、外交等多种资源和造势、威慑、诱降、离闽、瓦解、制裁等多种手段对敌展开综合进攻，收到了极大的“软杀伤”效果。信息化条件下的政治性作战具有重大的现实意义，应有针对性的加强研究，知己知彼，寻找对策，有备无患。     

思想政治教育的人文关怀——雅斯贝尔斯教育思想的启示

雅斯贝尔斯的教育学重视教育的精神唤醒功能和自我教育的力量，倡导苏格拉底式教育。在马克思主义理论的指导下，合理吸纳雅斯贝尔斯对“人的问题”的思考，有益于拓宽我们理解思想政治教育人文关怀的视野。
