执法为民理论与实践的思考

执法为民是公安工作的出发点和落脚点,也是公安工作的根本要求;“执法为民”理论的确　　立,对公安工作的发展具有里程碑的意义;在实践中,应狠抓五个强化,切实提升执法为民的效应。     

对中心城区侵财类刑事案件的思考

通过对上海市黄浦、卢湾、静安三个中心城区2003年以来部分侵财刑事案件的发案进行的分析,中心城区侵财类刑事发案总量逐步趋于稳定,但盗窃类案件仍居高不下;形形色色的诈骗案层出不穷;“两抢”案件发案总体稳定,并呈下降趋势。侵财案件高发不是偶然的现象,而是有着深刻的社会经济、管理以及人文背景。必须真正树立并贯彻“以打促防,打防结合”的观念,变被动防为主动防;以动制动,提高对侵财案件的打防力度;综合治理,动员社会资源共同推进防范工作;完善司法规定,提高执法机关的执法效率和打击力度。     

UK Abortion Law: Reform Proposals,Private Members’ Bills,Devolution and the Role of the Courts

UK abortion law remains unsettled, and subject to on‐going controversy and reform. This article offers a comprehensive critique of all reforms implemented or proposed since 2016. It examines reforms proposed in both Houses of Parliament and contextualises them within a public law analysis, showing both that the complex parliamentary processes relating to Private Members’ Bills have frustrated reform attempts, and that these attempts have been contradictory in their aims between the two Houses. Secondly, it examines the unique positions of Northern Ireland, Scotland and Wales to show the extent to which devolutionary settlements have influenced both reforms and executive involvement. Finally, it examines the potential impact of the courts on abortion law following Re Northern Ireland Human Rights Commission's Application for Judicial Review, showing that the Supreme Court's reframing of the debate in human rights terms is likely to affect abortion law, not only in Northern Ireland, but in the whole of the UK.     

Family Law,Parents with Disabilities,and the Americans with Disabilities Act

Parents with disabilities contend with bias within the family law system, often threatening their custody and visitation rights. The overarching goal of this article is to explore the experiences of parents with disabilities involved in custody and visitation disputes and the application of the Americans with Disabilities Act (ADA) in these cases. This article begins with an overview of parents with disabilities and their interactions with the family law system. Next, the article examines the ADA and its applicability to custody and visitation disputes. Finally, the article offers thoughts about strategies that can be utilized by attorneys to ensure that the rights of parents with disabilities are protected.

人类司法经历了由“神性法官时代”向“理性法官时代”的发展 ,而法官裁判的方法论一直是受到关注的问题。近代以来 ,法官裁判的方法论已成为法官职业自治乃至于整个法治的基本前提之一。这种方法论不能以单一特质来加描述 ,它是逻辑、经验、技艺、哲学和艺术五大要素的复合体 ,这些特质的整合与统一可以造就出理想的法官 ,塑造法官职业的辉煌。     

A new Fair Trade registration scheme based on the relations of production

Fashion, accessories, and homeware fall outside the regulations of Fairtrade Labelling Organizations International (FLO), which certifies mostly food products. A handful of fashion-led Fair Trade enterprises are now providing ranges of high-quality desirable products, made by workers employed in urban enterprises as well as independent producers in cooperatives. Tabeisa, an NGO involved in Fair Trade retailing, has developed a new regulatory framework which uniquely starts by defining the relations of production between all actors in the chain. This ensures that those not previously covered by existing standards are made visible and receive fair pay and conditions.     

Corruption,human-rights violation,and the interface with violence in the Niger Delta

This article examines the interdependence between corruption, violations of human rights, and conflict in the Niger Delta. It is argued that corruption-induced violations have triggered conflicts that have become cyclical. The article sets out a theoretical context against which to examine the interface between corruption, human-rights violation, and conflict in the Delta, and calls for the integration of the fight against corruption into the peace-building process in the Niger Delta.     

The potential of Corporate Social Responsibility to eradicate poverty: an ongoing debate

This article focuses on one of the assumptions of corporate social responsibility (CSR), namely its usefulness as a tool for eradicating poverty. The claims that business and CSR strategies can be effective in fighting poverty face major challenges, in particular the wide divergence of understandings about the notion and implementation of CSR, and the absence of clear understanding of underlying ideological bases concerning business and poverty. The authors find that, although usually considered as ideologically neutral, the CSR discourse requires the introduction of ideological debate if it is to meet the goal of poverty eradication.     

Working with children as stakeholders in development: the challenges of organisational change

This article considers the challenges of promoting children's participation in development programming. It argues against the tendency to see the main obstacle to achieving this aim as technical. Instead it explores the institutional dimensions of change that may be required. The experience of a four-year process of training and organisational review within Save the Children Denmark provides the substance for reflection about the kinds of cultural and structural change that are implicated in enabling a development organisation to become capable of engaging young people as stakeholders in a meaningful and sustainable manner.
