借鉴服务营销理论 探索边检服务与管理模式创新

近年来,我国边检机关的服务水平得到了明显提高。结合边检工作实际,在情景维度因素的管理方面,服务功能质量是最核心的影响因素。边检机关需要对那些影响服务体验的功能质量进行有效管理,才能让服务对象在通关过程中获得真正宾至如归的服务体验。边检机关可以通过搭建有边检特色的“服务体验驱动型”质量管理模式,全面提高边检服务工作水平。     

组织管理理论视野下的河南警务改革

在河南全省范围内实施的＂局所合一＂的警务改革撤销了所有省辖市的公安分局,改变了全国统一的＂市公安局——公安分局——派出所＂三级管理模式,建立了＂市公安局——派出所＂的两级管理模式。用管理理论进行分析可知,激励保健理论显示了其积极和消极两方面的影响,动态平衡理论证明了其加强了组织合作与沟通,开放系统理论说明了这场改革是势在必行的。     

论技术侦查措施在职务犯罪侦查中的适用

为适应职务犯罪发展的新趋势,在职务犯罪侦查中适用技术侦查措施已是势在必行,有其正当性、必要性和可行性.但技术侦查措施的适用也易造成对公民基本权利的侵害,因此应根据技术侦查措施的自身特点,在立法中明确规定适用的范围、对象、条件、司法审查等,以实现打击犯罪与保障人权的相对平衡.     

论卧底警察的保护与规制

随着有组织犯罪的日益猖獗,公安机关运用卧底警察进行侦查破案的策略日益受到人们的关注。然而由于我国相较于其他世界发达国家在这方面的立法及制度建设还存在极大的滞后性,因此,理论界学者有必要对卧底警察这一被广泛运用的现象给以正确评价、规制和保护,以满足当今刑事侦查工作的切实需要。     

Strategy and Selection in International Relations

It is widely recognized that many of the samples we use for statistical analysis in international politics are the result of some selection process. Not surprisingly, selection models are becoming increasingly popular. At the same time, the role of strategic interaction has begun to play a more important role in statistical analyses. However, it has not been clear how statistical strategic models and selection models relate to each other, or what the effects are of employing one when the other is the more appropriate model. In this article, I 1) clarify why international relations scholars cannot shield themselves from selection bias simply by assuming their results are limited to a given sample; 2) show how recent statistical strategic models relate to traditional selection models and generalize the two sets of models by deriving a correlated strategic model; and 3) examine the effects of misspecifying either correlated errors or strategic interaction. My results indicate that failure to model the strategic interaction produces worse specification error than failure to account for correlated disturbances. In fact, traditional bivariate probit models appear to be superior only when states are almost completely uncertain about each others' preferences.     

耗散结构论对英语写作的启示

Patricia Williams: Inflecting Critical Race Theory

Critical Race Theory (C.R.T.) has developed out of a deep dissatisfaction that many black legal scholars in the U.S. felt with liberal civil rights discourse, a discourse premised upon the ideals of assimilation, ‘colour-blindness’ and integration. In addition, the emergence of the Critical Legal Studies movement provided Critical Race theorists with an innovative lexicon and practice which allowed them to develop a critique of traditional race analysis and U.S. law. Patricia Williams has played a key role in the formation of the C.R.T. movement and is concerned with many of the C.R.T. themes: the understanding that traditional civil rights law has benefited whites more than blacks, the ‘call to context’, and the critique of liberalism by the assertion that racism is routine and not aberrational. Following the C.R.T. belief that form and substance are connected, Williams has also extended the boundaries of another C.R.T. theme by (largely) eschewing the conventional genre of legal writing in much of her work, including her two books, The Alchemy of Race and Rights and The Rooster's Egg. This was one of the issues Williams discussed in an interview that commenced when she visited Britain in 1997 to deliver the Reith Lectures. This revised version was published online in August 2006 with corrections to the Cover Date.

近20年来,祖国大陆先后出台一系列保护台胞投资的法律法规,这些立法切实保护了台商在大陆投资的合法权益,有效地鼓励了台商投资的积极性。但是,随着两岸关系的发展和大陆投资环境的变化,《台胞投资保护法》及其《实施细则》的部分条文已不太适应当前两岸关系的需要。2012年8月《两岸投保协议》签署后这一问题更加凸显。因此,大陆方面应以落实《两岸投保协议》为契机,加快台胞投资保护立法的修订工作,协调其与《两岸投保协议》的关系,为台商在大陆的投资发展提供更加良好、宽松的法律环境。
