我国著作权合理使用制度的宪法学释义

在“使用者权”和“权利限制”理论框架下解释合理使用制度的宪法性基础有一定合理性,但也存在不足之处。解读合理使用制度的宪法性基础,应依靠宪法中基本权利限制依据并尊重部门法中已有的法秩序。宪法限制公民基本权利的依据、合理使用的制度功能及其法定种类,能够证明“公共利益”与“其他公民宪法性权利”是我国合理使用制度的宪法性基础。据此,建议将“免费表演已发表作品”调整为法定许可,“商业性目的”应被纳入“公共场所艺术作品”合理使用的判断标准。根据比例原则,商业/非商业使用判断二分法只适用以“公共利益”为宪法性基础的合理使用,“三步检验法”应以维护权利人使用作品所得收益为适用取向。     

政府形式回应是无奈之举还是必要手段:一个整合性归因模型

十九大报告提出以人民为中心的发展思想,要求各地政府积极转变政府职能,通过更加平衡、更为充分的发展来不断满足人民在新时代的新需求,提升政府的回应性。但现实中存在大量推诿性回应、模糊性回应等政府形式回应行为。研究发现,公众的不合理期望与政府权力和能力有限的矛盾催生出超越政府职责范围与能力边界的诉求,构成政府形式回应的触发因素;制度环境、抗争性利益表达以及官僚理性知识与个人感性知识冲突是政府形式回应发生的重要外部推力;与此同时,基层公务员胜任力不足和公众身份特征则发挥着调节变量的作用。     

Public Value in Moral Market: A Case Study of Human Organ Transplantation System

Although public value may be a new paradigm beyond traditional and new public management, some important theoretical questions are still unanswered. These questions could be clarified by the comparison to economic value in free market. Most public values have been ignored and threatened in free market, but they could be partially measured by some methodology. The issue of public value is emerging at the background of market society and so the moral market should be clarified. A human organ transplantation system has been analyzed to show how the public value could be created in a moral market.     

Printmedia poll reporting in Poland: Poll as news in Polish parliamentary campaigns, 1991–2007

Information about the support given by the public opinion to political actors has become a constant element of the public debate in Poland after the fall of Communism. Very soon polls became an argument in debates, a premise, or a way to justify decisions. At the same time they were criticized both by politicians and journalists convinced that polls can significantly influence the election results. But the fact was not noticed in Poland that all debates about the influence of polls on election outcomes should be preceded by a discussion of the way they are presented in the media. The present article joins this debate by subjecting to analysis the polls published in the Polish press during parliamentary campaigns in the dimensions of the role they played during the recent several years, the quality of methodological information, and of the way the polls were used in the media.As opposed to European and American analyses, no improvement in the conformity to standards of minimal disclosure in newspapers’ reporting of public opinion polls was noticed, although—like in other countries—a dramatic increase in the number of polls reported was observed.     

论检务公开视野下当事人知情权的保障及扩充--以刑事诉讼审查起诉阶段告知程序之规制为中心

在刑事诉讼过程中规范、完善、细化告知程序,进一步深化检务公开,使一切可向诉讼当事人公开的程序及实体信息得以传递并真切落实,有利于保障诉讼当事人充分行使其权利。目前,刑事诉讼审查起诉阶段对于告知程序的规定相对简单并存在一定缺陷,司法实践中未予告知、难以告知、迟滞告知和敷衍告知等现象较为普遍,影响了刑事诉讼活动的正常进行,因此,亟需对我国审查起诉阶段告知程序进行进一步规范和完善。     

社会资本范式下村民自治与城镇化农村社会治安管理

城镇化对农村社会治安既有正面效应,也有负面影响。但城镇化带来的社会公共安全需求与基层派出所警力不足的矛盾更加突显。要构建良好的社会治安环境,创新农村社会治安管理模式是关键。而管理创新离不开村民自我管理和主动参与意识的培养。通过社会资本范式分析农民自治意识,对创新农村社会治安管理提供了一种有益的视角。     

中国对东南亚公共外交的问题与建议

公共外交是国家的一项重要战略资产,对于传播本国外交理念,塑造国家形象,改善本国的国际舆论环境有重要的意义。但作为一种外交手段,公共外交也具有局限性,其作用不应该过度被夸大。本文以中国在东南亚地区的公共外交为例,分析了我国公共外交存在的问题并提出了政策建议。
