论公安执法中的公正原则

公安行政执法是公安机关及人民警察为了实现公安行政管理的目的,依照法律、法规、规章规定的职责、权限、程序实施的影响行政相对人权利与义务的活动。因此,只有坚持执法公正原则,才能真正维护最广大人民的根本利益,从而实现社会的和谐、稳定。     

The Weakness of Strong (and Weak) Ties: Obtaining a Government Job

ABSTRACT

Between merit principles and social contacts, how they facilitate individuals to obtain a government job in the United States remains unsettled. Based on a survey administered via Amazon Mturk, this study finds that merit-based selection constitutes the most significant means to obtain public jobs, particularly so in state and local governments despite of sizeable respondents claiming other venues. The use of social contacts, including both strong and weak ties, shows little advantage on obtaining public employment but proves significant in private organizations. Controlling individuals’ previous job obtaining experience, the study contends that variations on job obtaining methods can be reasonably attributable to institutional distinctiveness that features different rules, procedures and regulations. Merit principles are kept alive in governments, though challenges persist, particularly so in federal government. The study ends up with a discussion of research findings and their implications in HR practices.     

Public Services after Austerity: Zombies,Suez or Collaboration?

Public services—in the UK and elsewhere—are under considerable pressure, not just from austerity, but also from a variety of social, demographic and technological changes (in effect ‘austerity plus’). In this context, three broad options are open to policy‐makers: continue with tried‐and‐tested approaches while spending less money, which in the UK means a reliance on ‘New Public Management’ (NPM); withdraw completely from certain public services; or develop new approaches to public administration. We argue that all of these approaches have been attempted in recent years, but it is the final option that is most interesting and potentially the most beneficial. In this article, we examine experiments with these new approaches in responding to ‘austerity plus’. In particular, we examine various attempts at ‘collaboration’ in public services and discuss the risks associated with them. We conclude by setting out the extent to which policy‐makers have moved beyond NPM and suggesting some of the benefits that this could bring.

德国行政执行法律是行政机关自力强制执行模式的典型代表,对许多国家和地区的立法都产生了重要影响。结合德国行政法学界的讨论与相关司法判例,解析该国行政强制执行的前提条件、强制手段以及程序等问题,理清《联邦行政执行法》与《行政程序法》之间的衔接,具有借鉴意义。我国行政法学在法律技术方面深受以德国为代表的大陆法系法学的影响,系统深入地理解德国行政执行法律制度,将有助于我国的《行政强制法》立法进程。     

基于胜任力的公共安全管理在职人员的培训系统创新

本文以广东省公共安全管理在职人员培训系统为研究对象,通过文献研究、系统研究、专家分析相结合的研究方法,构建基于胜任力的公共安全管理在职人员培训系统。该培训系统包括一个核心（胜任力）、一个对象（公共安全在职人员）、三个层面（制度层、资源层和运营层）、四大环节（培训需求分析、培训计划制定、培训组织实施以及培训效果评估）。希望通过这个培训系统,能够有效地提升公共安全管理在职人员的能力素质。     

预防与惩治公职人员海外洗钱的若干对策

公职人员海外洗钱愈演愈烈,当局必须予以严厉打击。为此,必须标本兼治,内外并举,分工合作。洗钱是标,腐败是本,反洗钱和反腐败必须双管齐下;一国力难完成海外反洗钱的任务,须加强国际合作;此为一系统工程,各部门须协同作战,齐抓共管。

社会变迁中的“暴动操作—暴动解除”刍议——读《新秩序下的混乱:从印尼暴动看华人的政治社会关系》有感

本文利用台湾杨聪荣博士的著作<新秩序下的混乱:从印尼暴动看华人的政治社会关系>, 分析有关暴动发生的过程,发现其中存在着统治精英和社会上的抗争力量从不同方面利用华人问题, 进行 "暴动操作",以之为政治斗争的一种特殊手段;并相应地寻找理论与实践模式来做 "暴动解除" 的设计,根据一定的方案来加以防患,减少其祸害的程度."暴动操作-暴动解除"可以当作一种客观存在的事物来加以调查研究;值此全球化区域协作、以人为本和人权主义的时代, 印度尼西亚华人可以利用境内外、国内外的社会网络, 对印度尼西亚国内少数极端主义分子的行动加以暴露, 挫败其"暴动操作";特别是, 可以利用中国和东盟的交流合作体系等平台, 参与印度尼西亚的社会发展、国家建设.这一切既敏感又复杂的活动,如能达到理想效果,则是以非政治化、非意识型态化、非族群体化的原则, 用公共行政、公共管理的方式进行操作的一种公共事务.
