The importance of industry compliance in improving advertising self‐regulatory processes

As the most visible element of the marketing communications mix, advertising has had its critics and, given the choice, developed countries usually select a self‐regulatory approach to deal with unacceptable advertising. The recent breakdown of one of the world's longest established advertising self‐regulatory programmes in Australia has reopened the 20‐year old debate that has taken place in the leading academic and business journals concerned with enhancing understanding of such regulatory systems. This paper focuses on the activity of code enforcement in improving the effectiveness of advertising self‐regulatory frameworks. The key findings of an Australian study, where its scheme has recently failed, are presented and discussed in this context and a key concept is developed. 经过二十多年的市场化改革 ,我国出现了如律协、足协、注册会计师协会等具有自治属性的社会组织 ;这些组织具有全体性、自治性和公权力性 ,承担着原由政府部门行使的管理职能 ,成为公共行政的主体。对这些组织既要予以法治监督 ,又要注意保护其行业自治权 ;在司法审查时 ,需要从设置诉前行政救济程序与合理限定司法审查范围等方面防止司法权过度介入其自治权。     

S&;T Parks and business incubators in middle-sized countries: the case of greece

This paper links the policy context regarding S&T parks to the objectives and characteristics of the established parks and incubators in a relatively small, converging European country. S&T parks and incubators in Greece during the past decade and a half have gradually shifted in terms of ownership and management from university/research institute to the private sector and in terms of financing from public to private funds, also involving the provision of seed capital and access to venture capital. This gradual shift toward more private engagement has created a variety of models out of which, it is hoped, successful innovative companies will emerge in larger numbers than in the past.

论宪法规定公民权利宜用禁止性规则

虽然各国宪法对公民权利实际上有两种规定方式,一是采用禁止性规则,二是采用授权性规则,但从理论上分析,宜采用禁止性规则.从宪法学上来讲,禁止性规则符合宪法乃授权于国之法、权利先于宪法、宪法控制权力的观念;从立法学上来说,禁止性规则更能表达防范国家权力可能侵犯公民权利的目的;从解释学上来看,禁止性规则能够消除"宪赋人权"的误解.

To block or not to block: European approaches to content regulation,and implications for freedom of expression

Based on the limited effectiveness of state laws, and lack of harmonization at international level a number of states started to introduce policies to block access to Internet content and websites deemed illegal which are situated outside their legal jurisdiction. However, blocking policies are not always subject to due process principles, decisions are not necessarily taken by the courts of law, and often administrative bodies or Internet hotlines run by the private sector decide which content or website should be subject to blocking. Therefore, increasingly, the compatibility of blocking action is questioned with regards to the fundamental right of freedom of expression. This article assesses significant developments at the pan-European level with regards to the development, and implementation of Internet content blocking policies. Adaptation of content blocking policies from certain member states of both the European Union and the Council of Europe will be used to assess the nature and implementation of access blocking policies. It will be argued that there could be a breach of Article 10 of the European Convention on Human Rights if blocking measures or filtering tools are used at state level to silence politically motivated speech on the Internet.
