提升检察机关执法公信力的路径

检察机关作为国家宪法赋予职权的法律监督机关,能否在实际工作中履行好监督职能、有效化解社会矛盾,是促进和巩固执法公信力的原因和动力。提升检察机关执法公信力的路径,主包括三个层面：日常执法活动的规范化、涉检突发新闻事件的合理应对、公信力理念的强化及相关制度的完善。     

Framing and dominant metaphors in the coverage of North Korea in the Australian media

Through the selective allocation of attention, framing and metaphors in covering foreign affairs and countries, media narratives often act to delegitimise, marginalise and demonise international actors. Focusing on Australian reportage of North Korea in The Australian, The Sydney Morning Herald and from the Australian Broadcasting Corporation (ABC) between 1 January 2010 and 31 December 2012, this paper explicates how the framing mechanisms utilised in media point to media complicity in reinforcing a negative, adversarial orientation towards North Korea. It also discusses implications for how Australians view the North Korean people, Australian–North Korean relations, and policy pertaining to Northeast Asia more broadly.     

男性服刑人员心理防御机制的特点

目的探查男性服刑人员心理防御机制的使用情况及其特点。方法采用随机抽样方法,使用防御方式问卷（DSQ）对355名男性服刑人员心理防御机制进行团体测查。结果男性服刑人员成熟防御机制得分最高,中间型次之,不成熟型最低（F=199．28,P〈0．001）。青年组成熟型防御机制得分低于中年组（t=-3．14,P〈0．01）;随受教育程度升高,男性服刑人员的不成熟型防御机制得分逐渐降低,成熟型得分逐渐上升;暴力组成熟型防御机制得分低于非暴力组（t=-2．18,P〈0．05）,不成熟型得分高于非暴力组（t=3．69,P〈0．001）。结论年龄、受教育程度及犯罪类型对男性服刑人员的心理防御机制有影响。男性服刑人员使用不成熟防御机制的频度偏高。     

完善我国商品房预售制度的立法建议

对于商品房预售制度问题层出不穷的今天,一个重要的问题是如何保证房地产金融安全高效地运作。从其他国家和地区的国际经验来看,房屋预售制度促进房地产业的良性循环关键在于设计合理的风险担保机制以分散其各个环节的风险。无论是严格的准入或退出制度,预售资金的专项管理,严格的法律监管,或是为购房者提供更多的合约形式等这些都是风险分担机制的重要组成部分。     

日本人的恩伦理意识初探

日本人具有浓厚的恩的伦理意识。从感恩的对象来看,有天地自然之恩、父母之恩、师恩和社会恩;感恩与施恩是互动共存的,由施恩、受恩、感恩、报恩组成恩的行为链,构成了日本人的恩的伦理世界。为了使外在的规范变成个人内在的自觉,日本人重视恩的伦理实践和报恩意识的培养,从而为日本伦理和谐设置了牢固的心理机制,对于社会稳定和谐起到了重要的作用。     

Tackling Ill-Treatment in Places of Detention: The Work of the Council of Europe’s “Torture Committee”

The article examines the working methods and effectiveness of the Council of Europe’s Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (the CPT) which, since 1990, has been carrying out visits to places of detention. It also examines the impact the Committee has had upon European standards and expectations, and, in particular, upon the jurisprudence of the European Court of Human Rights, and raises certain issues in respect of the establishment of the United Nation’s Subcommittee on Prevention of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment of the Committee against Torture. This article draws upon material to be published in The Treatment of Prisoners: European Standards (Council of Europe Press: 2006).     

日本公害纠纷处理机制与我国之借鉴——以日本丰岛产业废弃物调解案为例

丰岛产业废弃物调解案是日本中央公调委进行公害纠纷行政处理的典型案例。日本中央公调委作为独立的公害纠纷行政处理机构,以其多样化的纠纷处理方式在纠纷处理中具有独特的优势地位。以自愿调解为主、强制调解为辅的行政调解原则又赋予了行政调解较强的约束力,调解机构以纠纷解决为目的的务实态度是值得我国环境行政调解所借鉴的。     

浅析利益协调机制之法律保障

构建和谐社会的过程是一个妥善处理各种利益关系、消除不和谐因素、增进社会和谐的过程。利益协调机制是在社会转型过程中,用来协调不同利益主体之间相互的关系和有效发挥其功能与作用的方式、方法。因此,完善利益协调机制是构建和谐社会的基本要求,应当通过法律途径保障其建立健全,以推动和谐社会建设的有序开展。     

当前贿赂犯罪案件查办中存在的问题及对策

贿赂犯罪作为以谋取利益为目的的犯罪形态之一,其发展和变化总是同社会经济的发展与现状具有必然的联系。改革开放以来,我国的经济体制、经济成份、激励机制和国家机关调控经济的职能手段都发生了深刻而巨大的变化。经济结构的变化必然引起与此相关的犯罪形态的变化,贿赂犯罪的犯罪形态变化体现在犯罪手段、犯罪目的、犯罪数额等各方面。同时由于司法机关对贿赂犯罪的打击力度不断增强,新时期的贿赂犯罪呈现一些新情况、新特点。如何有效遏制贿赂犯罪的发展态势,已成为检察机关在打击职务犯罪上重点关注的问题。     

Jurisdictional issues and the internet – a brief overview 2.0

Issues of Internet jurisdiction remain a key challenge for the application of law to the online environment. Despite of a large volume of academic writings on the topic, these issues continue to be perceived as complex and inaccessible. This article aims to provide an accessible introduction to private international law as it applies to the Internet. As such, it is hoped that it may be a useful resource for courses in IT law, Internet law, e-commerce law or the like, as well as for anyone looking to refresh their understanding of exactly what it is that people are struggling with in the field we may call Internet jurisdiction.
