群体性事件应急处置指挥机制的运行障碍与突破

在公安机关处置群体性事件的过程中,处置主体角色认知障碍、组织协调障碍、绩效评判障碍是阻滞群体性事件应急处置现场指挥机制良性运行的深层障碍因素。要使群体性事件应急处置指挥灵活高效,就必须克服障碍因素,适应并改善群体性事件应急处置指挥系统的运行环境和条件。对事件应急处置的相关机制进行配套改革,才能增强警务工作的主动性、针对性和实效性。实现群体性事件应急处置指挥框架的模塑化和指挥方式的弹性化、以预案形式对群体性事件进行项目化常态管理、实行全警轮值轮训的事件处置专业能力训练、加强信息化建设与组织间的动态协调,是在现行公共安全危机应急管理体制下公安机关解决群体性事件应急处置协同作战能力不足、提高应急处置指挥效能的有效途径。

实践表明,构建以信用为基础的新型监管机制对政府的市场监管具有重要的基础意义。本文综合学理和实践视野,探讨了市场信用监管体系的构成特征,即市场信用监管是以信用信息为基石的一系列制度安排的集合,是实现全方位监管、全过程监管、精准化监管的集合。其核心价值是完善市场资源有效配置机制,降低制度性交易成本和促进新型市场监管体系全面升级。采用制度主义的视角分析了政府在市场信用监管中的制度供给、制度执行、制度维护和制度创新四大政府责任,并用结构-过程的视角结合具体实践分析了事前、事中、事后阶段以及全过程监管中可创新的一系列监管规则和制度。     

Examining media markets’ influence on the diffusion of antismoking legislation in US counties

This article assesses the role of mass media markets in the diffusion of antismoking legislation in the state of Missouri in the US. Testing multiple diffusion theories, this study finds that media markets can facilitate the diffusion of policies among local jurisdictions by exacerbating intercounty competition. More attention should be given to media markets when assessing policy diffusion mechanisms at the local level. Media markets can be an important source for policy information conveyance among counties over a large geographic area. Furthermore, traditional diffusion studies that rely on geographical contiguity measures may not be completely capturing the existence of diffusion by excluding media markets.     

What is Restorative Justice? Fresh Answers to a Vexed Question

Abstract

It has become commonplace to say that restorative justice cannot be defined. I argue that restorative justice can and must be defined concretely as a justice mechanism. I develop this argument with four points: (1) restorative justice is not a type of justice, it is a justice mechanism; (2) retributive justice is not a type of justice or a justice mechanism; (3) restorative justice is one of many justice mechanisms under an innovative justice umbrella; and (4) restorative justice can be defined. The way forward is to assess and compare a variety of justice mechanisms, which reside on a continuum from conventional to innovative. In time, the justice mechanisms studied may come to matter more than the concept of restorative justice.     

The Ambiguity of Love: Beauvoir,Honneth and Arendt on the Relation Between Recognition,Power and Violence

The paper sketches out an account of ambiguous and agonistic love by drawing on the work of Simone de Beauvoir, Axel Honneth and Hannah Arendt. To begin with, I reconstruct the ambiguity of love within the conceptual framework of a paradigm of recognition. I argue further that the social relation of love, understood as an intertwine between dependence and independence, entails a power dynamic. Insofar as the dynamic actualises as “power in concert” or “power with”, namely as mutual empowerment, love unfolds as free love. Finally, I show how agonistic love is damaged by turning into violent domination.

Practicing Normality: An Examination of Unrecognizable Transitional Justice Mechanisms in Post-Conflict Sierra Leone

ABSTRACT

Transitional justice and peacebuilding mechanisms have a tendency to reflect the extraordinary nature of conflict. These recognizable mechanisms—official bodies and institutions with preconceived goals and processes—are often inaccessible and undesired. In fact, what is often desired in post-conflict societies is the ordinary: a transition to a ‘new normal’. This article explores the various ways in which Sierra Leoneans practice normality in the post-conflict era. This is done through economic restoration, agricultural activities and religious engagement. Ultimately, these mechanisms are often seen as a more legitimate and meaningful way for many ordinary Sierra Leoneans to move past their war-related experiences and find some sense of peace and justice.
