法德刑事侦查制度比较研究

法德是大陆法系国家的典型代表,但是由于诸多因素的影响,两国的刑事侦查制度,在组织、程序、人事等方面又存在一定的差异.这主要是两国历史背景、国家结构形式、外来因素影响和现代化侦查制度的改革等的不同造成的.     

“拜一杜规则”与中国《科技进步法》和《专利法》的修订

如何促进政府投资所生之科研成果尽快向产业界转移,充分实现公共投资的经济和社会价值,一直是各国政府所面临的一个挑战。美国于1980年制定的《拜—杜法案》通过将政府资助所作之发明获得专利的权利划归完成单位,以产权激励的方式刺激此类创新成果的实施,并为此构建了被称为拜—杜规则的一整套颇为完备的制度,其实施取得了举世瞩目的效果。中国为提高政府资助科研所获得成果的产业化实施率,借鉴美国经验,在《科技进步法》中引入了拜—杜规则的核心内容。但是,仅有科技基本法原则性的规定是不够的,为充分发挥拜—杜规则的积极作用,《专利法》或者《专利法实施细则》中有必要充实这一规则的具体制度设计。

建设和发展华侨华人历史地理研究有利于促进华侨华人学科的完善,拓展历史地理学的研究领域,对推动当今华侨华人问题的解决也有重要现实意义。华侨华人历史地理研究是一门交叉学科,其学科属性是探索历史时期与华侨华人相关的地理现象的演变及两者间的相互影响,并进而探索演变和影响的规律的学科;华侨华人历史地理的研究对象是历史时期与华侨华人相关的地理现象的演变;研究内容主要包括华侨华人历史地理理论和方法研究,侨乡历史地理,移民历史地理,海外华侨华人历史人文地理、社会地理,华侨华人历史自然地理等;研究方法主要是历史文献法、实地考察法、新技术手段及其他相关学科的方法。     

Spatial mobility of knowledge transfer and absorptive capacity: analysis and measurement of the impact within the geoeconomic space

This paper analyses the spatial mobility of knowledge and technology transfer and measures the economic impact on the geo-economic space. The data of laboratories operating in different research and technological fields are used. The results show that, when the distance from the source of knowledge (research institute) to users increases, the impact of knowledge and technology transfer decreases with damped pulsations. The magnitude of knowledge and technology transfer shows a high intensity within the industrial district because small businesses are able to acquire externally scientific knowledge, without conducting in-house research, but by interactions with public scientific bodies and adopting both collective rules that act as collective knowledge devices, making collective learning possible, and skilled labor.

Publication and Research Trends in Police Psychology: A Review of Five Forensic Psychology Journals

Police psychology (PP) articles in five forensic psychology journals (Behavioral Sciences and the Law; Criminal Justice and Behavior; Law and Human Behavior; Legal and Criminological Psychology; Psychology, Crime, and Law) were identified in order to examine PP publication and research trends within the field of forensic psychology. A level of interest (LI) score was calculated by dividing the total number of pages dedicated to PP articles by the total number of journal pages. Article characteristics (e.g., research location, topic) were also coded. The overall LI-score across all journals was 0.13, with Legal and Criminological Psychology having the highest LI-score. Results also showed that interest in PP research is growing, particularly in Law and Human Behavior and Criminal Justice and Behavior. PP research has primarily been conducted in the United States, dedicated to operational issues, and experimental in nature. The alignment of these research trends with practice is discussed.

Wiki “communities” based on the open access ideology allow any visitor to easily add, remove or edit content. However, there are a slew of ethics and policy challenges inherent in their use. Open source software developers are faced with the dilemma of openly sharing their intellectual property and prevent others from claiming proprietary rights from the code they freely shared to the public? Intellectual Property rights licensing, ironically, is the route by which open software developers have chosen to regulate their free code in cyberspace. Open source code is generally free on the surface; but in reality, it comes with obligations which are enforceable by law. Aside from the potential liability for intellectual property infringement, the use of open software raises competition law and tort liability issues. The European Union has developed the European Public License which is written in conformity with the copyright, product liability and consumer protection laws of the 27 member states. The EU Commission has also proposed a new Directive which will extend the principles of consumer protection rules to cover licensing agreements of products like software. This paper will address the various legal issues that may arise in open source community sharing.
