英国软件反向工程适用立法探讨

软件反向工程在现代社会具有极其重要的作用，但滥用则会违背知识产权之根本保护法理，理应受到法律规制。英国是一个软件反向工程适用立法较完备的国家，其主要适用欧盟相关立法《软件指令》和本国专门性立法《软件条例》。     

对林业生态工程实施监理制的思考

随着我国工程管理体制的改革,在林业生态工程领域推行监理制已成为一个大趋势.但是,目前监理制并没有在林业生态工程建设项目中普遍实施,一些工程建设、施工方对工程监理的必要性和重要性没有一个正确清晰的认识,监理行为不规范等因素也影响了监理工作的整体效果.这就要求我们应从提高思想认识、完善监理办法及相应规范、调整投资结构、建立专门的监理公司、组建相应的行业管理机构、加强业务培训、提高素质水平等多方面进一步完善和规范林业生态工程监理制的方法和机制.随着我国林业生态工程建设管理体制的进一步理顺,工程管理的进一步规范,我国林业生态工程建设监理必将得到进一步的加强,从而在我国林业生态工程建设中发挥巨大的作用.     

高校机械工程系列课程双语教学改革研究

文中分析了国内外双语教学的发展现状,根据国际化交流与竞争的人才要求,提出了在整个机械专业大学课程中贯穿双语教学的课程体系改革思路。阐述了中南大学机电工程学院进行双语教学课程体系改革的总体框架、具体措施及内容,为我国机械工程专业高等教育改革提供参考。     

论法律的思想实践及其实践理性原则

法律的思想实践即主体以法律工程设计模型为对象而在自己的思想和观念中进行的以思想操作与思想实验为核心的思维实践活动。法律的思想实践是全部法律实践活动在逻辑上和事实上的真正起点。思想性、实践性、现实性、创造性、感性与理性的有机结合,是法律的思想实践的基本特点。合法性、正当性、合理性、客观性和逻辑一致性,则是法律的思想实践必须遵循的实践理性原则的核心原则。     

Scanning memory with Yara

Memory analysis has been successfully utilized to detect malware in many high profile cases. The use of signature scanning to detect malicious tools is becoming an effective triaging and first response technique. In particular, the Yara library and scanner has emerged as the defacto standard in malware signature scanning for files, and there are many open source repositories of yara rules. Previous attempts to incorporate yara scanning in memory analysis yielded mixed results. This paper examines the differences between applying Yara signatures on files and in memory and how yara signatures can be developed to effectively search for malware in memory. For the first time we document a technique to identify the process owner of a physical page using the Windows PFN database. We use this to develop a context aware Yara scanning engine which can scan all processes simultaneously using a single pass over the physical image.     

The reverse mortgage as an asset management tool

Abstract

Reverse mortgages are usually seen as a vehicle for increasing the income of poor, elderly households. This perspective, coupled with the relatively slow growth of reverse mortgage programs, has led some observers to question the growth potential of the reverse mortgage market. This article presents a more expansive view of reverse mortgages as a financial tool for tapping housing equity for various purposes and at various stages in the life cycle.

Three market segments for reverse mortgages are discussed: elderly persons living alone, other elderly households, and non‐elderly households. Potential uses include turning housing equity into personal human capital investment accounts, enabling children to provide care for their disabled parents, funding elderly households’ long‐term care insurance, and sustaining consumption. Recent progress in product development and availability and political pressures to find private financing for health and long‐term care suggest that the reverse mortgage market has considerable growth potential.

China in the context of globalization

Although this paper challenges the standard viewpoint that foreign direct investment actually occurred in colonial times it also finds parallels with today’s international finance. Evidence shows that the reverse flow of funds was infinitely much greater than possible foreign investment for at least one colony, the Netherlands East Indies (colonial Indonesia). We calculate for the late colonial period (1880–1939) out of its total colonial surplus at least US$430 billion in today’s terms (about three-quarters of the total) was available for investment. This was far in excess of actual investment. Less than one-third of the available for investment went to colonial Indonesia and a further one-third was invested in other countries. The remainder is attributed to investment in the Netherlands (mainly portfolio), investment by non-Dutch corporations and to some statistical errors and omissions. Furthermore, we indicate their actual vital function within the global economic and financial organisation of the Netherlands in late colonial times. The probability of similar occurrences today is raised.     

Do mayors matter? Reverse coattails on congressional elections in Brazil

In federal democracies, parties often invest in local politics as a strategy to improve their performance on upcoming national elections. In this study, I use the concept of reverse coattails to investigate how winning local elections affect upper-level electoral dynamics in Brazil. Using a regression discontinuity design (RDD), I show that parties in Brazil boost their national performance, earning more votes on House elections in districts where their members control local offices. I discuss how access to ‘‘pork” controlled by co-partisan House members and mechanical information gains explain these effects. Additionally, I use a Bayesian LASSO algorithm to address data sparsity in RDD designs, and to demonstrate the existence of pro-large party bias on the coattail effects. By disentangling the various effects of winning local elections, this paper contributes to a greater understanding of how parties build electoral strength in fragmented democracies.
