结果加重犯的刑事责任的演变

本文通过对结果加重犯的刑事责任由结果责任向意思责任的转化,分析了对结果加重犯的加重结果不要求“预见”或“过失”是不合理的,只有行为人对加重结果有“预见”或“过失”才能成为结果加重犯,这样限制结果加重犯的成立范围。

根据丝光绿蝇在自然条件下的发育速度及其发育过程中的有效积温推断尸体的死亡时间。对在尸体腐败过程中最常见、国内分布极广的丝光绿蝇在自然条件下的发育速度及其发育过程中的有效积温进行观察、记录结果和统计学处理 ,分别确立了K1=2 0 880 + 0 80 14X1、K2 =5 4 0 917-2 8814X2 、K3=133 2 180 -2 6 312X3 等 3个有效积温与长度 (蛆 )和卵重的线性回归方程。应用丝光绿蝇发育速度与有效积温的回归方程 ,能比较准确地进行死亡时间的推断

Classical Marxism and Maoism: A comparative study

The issue of the Marxist character of “Mao Zedong Thought” has never really been resolved. The present work is a comparative analysis of the classical Marxism of Karl Marx and Friedrich Engels and the ideology of Mao Zedong. The argument is made that whatever Marxism there was in Maoism was the “creatively developed Marxism” of V. I. Lenin—which allowed for socialist revolution in retrograde economic circumstances—something that had been specifically rejected by Marx and Engels. That led to the theoretical idiosyncrasies that characterized Maoism throughout its history, and ultimately resulted in the form rejected by Deng Xiaoping and post-Maoist China.     

Forming “affective communities” and narrative forms of affection: Damon Galgut’s Arctic Summer

This article examines Arctic Summer (2014) by Damon Galgut, a biographical novel focused on a period in the life of British author E.M. Forster. My inquiry is concerned with narrative form and aesthetics that limn affiliations between the two authors’ creative and sexual sensibilities and struggles, and how forms of affective affiliations are forged through narration and narrative stylistics. I discuss critical responses to Galgut’s oeuvre and trends in South African literary production post-1994, to introduce ideas about his non-conformist creative impulses. I reflect on hybrid narrative form, generic ambiguities, and aesthetics to consider how affective affiliations are fashioned in Arctic Summer and beyond the boundaries of the text when compared to Galgut’s In a Strange Room (2010). Leela Gandhi’s thoughts on “affective communities” inform my argument that the representation of sexuality and bonds of affection in Arctic Summer enables formal and nonconformist affinities across temporal and spatial registers.     

The EROI of agriculture and its use by the Via Campesina

Via Campesina supports peasant and small farmer agriculture both in the South and in the North. Its basic doctrine is that of ‘food sovereignty’. It is a movement that defends an ‘ecological neo-Narodnism’. Among the analytical tools used by this international peasant movement is the comparison between the energy efficiency of traditional small farm agriculture and modern industrial agriculture. This article briefly recalls the history of agricultural energetics, and then looks at the use of the concept of EROI (energy return on energy input) by Via Campesina when it claims that ‘industrial agriculture is no longer a producer of energy but a consumer of energy’, and that ‘peasant agriculture cools down the Earth’. The absence in Marxism of a tradition of analysis of energy flows is also reviewed here, since it is of interest in order to bring together the classic economic concept of decreasing returns with the more recent notion of a declining EROI. The article also draws on work analysing how environmental activists use concepts from ecological economics, while at the same time ‘activist knowledge’ contributes to ecological economics in a two-way communication between activism and science.
