忠诚 严谨 博学 创新--谈倡导和弘扬优良校风

警察院校校风建设是高校精神文明建设的重要组成部分,是提高警察院校教育质量的重要保证,既反映警察院校的办学水平,又体现警察院校的品位和格调.树立"忠诚、严谨、博学、创新"的优良校风,把校风建设同警察院校的历史传统、治学理念、办学特色等紧密结合,使之成为鼓舞师生的精神力量,对于警察院校建设和发展具有重要意义.因此,必须采取切实措施,加强警察院校校风建设,为创建一流警官高校而努力.     

内地藏族初中生学业求助的特点及相关因素研究

用问卷调查法对江苏省常州市西藏民族中学240名初中生学业求助的特点及其相关因素进行研究。结果表明:内地藏族初中生学业求助水平较低;在工具性求助上存在显著的性别差异,男生得分明显低于女生;而在执行性求助和回避求助上不存在显著的性别差异;在三种求助方式上均存在极其显著的年级差异;成就动机、成就目标取向、学业价值怀疑与学业求助行为有显著关系;自我效能低的学生不愿意求助或选择执行性求助,支持脆弱假说。     

Learning to be A Peacemaking Lawyer: Law Student Perspectives on Building Peacemaking into Law School Curricula,Building Paths to Practice for New Lawyers,and Interdisciplinary Training

From our perspectives as students, we reflect on the teachings of Lawyer as Peacemaker, a Winter 2015 course taught at UCLA School of Law — the school's course devoted to peacemaking lawyering. Utilizing our newfound peacemaking worldview, we share our collective reactions to the Lawyer as Peacemaker course and the ten articles in the Family Court Review Special Issue on Peacemaking for Divorcing Families. We then advocate for integrating peacemaking into law school curricula and experiential learning offerings and make recommendations on how law schools today can prepare students to practice peace.

• This article is a collaborative work product of three students who come from an array of work experience, backgrounds and interests and from their newly founded peacemaking worldview, the three students collaboratively analyzed ideas presented in the Lawyer as Peacemaker course and the articles from this issue.
• The peacemaking mediation allows the parties more control over their legal disputes and allows the control of the costs that come with litigation.
• Peacemaking involves a holistic and collaborative method, involving mental health professionals to financial advisors as well as legal professionals.
• However, peacemaking skill courses are not readily available to many law students while studying in law school.
• This valuable asset should be made available more extensively to law students interested in family law.

     

律师保密义务的经济学探析——海派经济学的法学观点

本文属于法律经济学的研究范畴,试图以经济学方法探讨律师保密义务在确保公正的前提下可能出现的效率问题,从而分析这项制度安排的合理性。文章通过对两者涉及的各相关主体进行以“成本收益”分析为核心的行为分析,发现流行的律师保密义务理论和措施无法在较低的私人成本、社会成本支出水平上实现司法收益的最大化,即这项制度导致了司法资源配置的低效率。     

对黑格尔思辨哲学的态度是费尔巴哈早期思想的精髓

费尔巴哈在德国哲学中的历史地位是由于他的宗教批判,还是由于他的哲学批判?这是一个涉及到费尔巴哈是在何种意义上对马克思的哲学革命发生影响的重要问题。尽管一提到费尔巴哈,人们首先会想到那为他博得盛名的《基督教的本质》,但是本质地说来,以《基督教的本质》为代表的宗教批判,不过是作为费尔巴哈早期思想精脉的对黑格尔思辨哲学的批判的延续和拓深。对黑格尔思辨哲学的批判,是费尔巴哈思想的核心与精髓。     

关于20世纪中国史学发展道路的对话

20世纪中国史学名家辈出,成就巨大,今天对其发展道路认真地反思、总结,具有重要的学术价值和现实意义。首先,应当树立动态发展的眼光,从宏观上做出“新史学流派”的新概括,研究它如何由“思潮”发展到“流派”,研究这一群体所取得的重大成就,这一群体学者的共性和各自的学术个性;并进而形成20世纪史学“三大干流”（新史学流派、新历史考证学派、马克思主义史学流派）平行发展和相互影响的总体研究思路,取代以往“两大干流”的认识。其次,应进一步探究新历史考证学如何继承了乾嘉考证学的优良传统,同时又因获得进化史观等新的理论指导而成为一门近代学术;至1949年以后,又因为接受唯物史观的指导,而推进到新的境界。再次,对于马克思主义史学,应如实地总结它取得的巨大成就,同时深刻反思其经历过的曲折;要开掘出“传统思想的精华如何通向唯物史观”一类的新课题;对于建国后“十七年”史学,应抓住“两种对立的学风”这一关键做观察、分析,既认真总结教条主义一度盛行的深刻教训,又恰如其分地总结正直学者发扬优良学风而取得的巨大成绩,以此坚定我们坚持和发展唯物史观、用以指导史学研究的信心。     

School resource officers and students’ rights

The safety of students at American schools has become a national priority. With every incident of lethal violence, public fear swells and the demand for effective violence prevention methods increases. School resource officer (SRO) programs that assign sworn law enforcement officers to schools are frequently identified as one straightforward and popular strategy for making schools safer and more secure. However, the placement of these officers at schools raises complex issues and poses new challenges to students’ rights, including the risks of unreasonable search and seizure, the inappropriate sharing of confidential information, and students’ decreased feelings of safety. In this paper, the authors will provide the reader with a review of these students’ rights issues and the possible consequences to students and schools when these rights are not respected. The authors then provide the reader with a review of the relevant literature on the relationship between SROs and students and outlines specific recommendations for the successful implementation and operation of SRO programs that foster positive and respectful connections with students and school officials.     

中华传统行刑文化与行刑制度研究

中国传统行刑文化及行刑制度与儒家传统慎刑思想有着密切的联系,蕴含于其中的合理性因素,如鼓励宽仁治狱;法、理、情相统一的囚犯教育感化制度;录囚制度等。文章旨在通过分析中国传统行刑文化价值核心及其对古代行刑制度的影响,探索其中的合理成分,为当前的行刑制度改革提供历史借鉴。     

创办与完善第二专科教育探索新形势下公安院校办学新模式

在新的社会经济发展和治安形势变化的背景下,上海公安高等专科学校改变传统的办学模式,探索建立了与现代警务机制相匹配的,具有时代特征、上海特点、警察特色、职业教育特性的公安院校第二专科教育新模式,并被确定为国家示范性高等职业院校立项建设单位,将为全国行政执法类高等职业院校的改革提供有益的借鉴。
