Section 13(5) of the Human Fertilisation and Embryology Act 1990 requires fertility clinics, before offering regulated treatment services, to take account of the welfare of any child who may be born as a result of the treatment and any other child affected by that birth. This paper presents the findings of an empirical study examining the impact on practice of the controversial reform of this section in 2008. While the broad values underpinning section 13(5) appear well embedded in clinic staff's engagement with ethical issues, there is little evidence that practice has been influenced by the 2008 amendments. A complex picture emerged regarding the implementation of section 13(5), particularly in its interaction with other factors, such as funding criteria and professional norms around counselling, implying a higher level of ongoing attention to likely parenting ability – particularly that of single women – than might be expected from a reading of the statute and guidance alone.  相似文献

L'article dresse un bilan critique de la loi dite de parité, à partir de son application stratégique par les partis, lors des législatives de 2002 et de 2007. A partir de ces deux « cas pratiques », il s'efforce d'apprécier, face à l'épreuve des urnes, la portée d'une loi complexe, en fin de compte peu adaptée à la logique du scrutin uninominal. Quelques éléments d'explication sont proposés pour tenter de comprendre pourquoi la loi laisse paraître une (relative) inefficacité, avant de pointer les raisons pour lesquelles la plupart des partis parlementaires ne se sont pas saisis, autant qu'ils auraient pu, de l'outil égalitaire qui leur était proposé pour faire progresser la représentativité des femmes et, au‐delà, diversifier et démocratiser le recrutement parlementaire. Enfin, est esquissé à grands traits le profil politique et sociologique des femmes députées de la « génération parité », donnant à voir les principaux atouts dont elles disposent pour se couler dans le moule de la profession politique.  相似文献

This article presents the main elements of Directive 2011/24/EU of the European Parliament and of the Council of 9 March 2011 on the application of patients’ rights in cross-border healthcare, commonly known as the Patient’s Rights Directive. It is the latest EU initiative with regard to European Health Care and the Single Market. The main elements of the Directive contain provisions related to the prior authorisation of health care in another Member State, the reimbursement of such health care and the removal of unjustified obstacles to achieving these aims.These provisions largely reflect the recent case law of the European Court of the Justice (ECJ). Amongst these are provisions involving the use of personal data. Such provisions will engage data protection issues and will have to be carried out according to the data protection directives. Alongside this primary aim of codifying ECJ case law the Patient’s Rights Directive also introduces novel initiatives aimed at fostering cross border cooperation between various elements of national healthcare systems.Part 1 of this contribution will describe the legal basis and the aims of the PRD, Part 2 will describe the principle obligations placed on the Member States with regard to reimbursement, Parts 3 and 4 will describe other informational and procedural requirements placed upon the Member States of Treatment and Affiliation. Finally Part 5 will outline some of the novel initiatives that have been included in the PRD.The increases in the frequency of cross border-treatment that this directive attempts to facilitate are likely to see a concurrent increase in cross-border patient information flows. Such data flows will be subject to the Union’s provisions on Data Protection. It remains uncertain whether the EU’s Data Protection regime will act as inhibitor to cross-border medical treatment or rather represent a gold standard that allows patients to engage in such activities with peace of mind. The Patient’s Rights Directive will form part of the EU’s future e-Health strategy which envisages a large increase in the fluidity of patient data. A discussion of this directive is therefore merited in this journal.  相似文献

目的研究常见纺用单根无色纤维的有效鉴别方法。方法使用显微红外光谱仪、显微激光拉曼光谱仪研究7大类纺用单根无色纤维的分子光谱。结果显微红外光谱仪、显微激光拉曼光谱仪能有效区分包括棉、粘胶、羊毛、丝、聚酰胺、聚丙烯腈和聚酯在内的7种纤维,是检测单根纤维的有效手段。785nm激发光源是显微激光拉曼光谱仪研究这7类纤维的最佳波长。但由于纺用纤维生产过程的标准化,仅依据红外或者拉曼的峰位置区分同种类、不同产地纤维的效果一般。结论显微红外光谱仪、显微激光拉曼光谱仪是鉴别常见纺用单根无色纤维的有效方法。  相似文献

Adolescents and young adults (three age groups: 12–15, 16–19, and 20–28 years) reported their use of parents, and peers to fulfill attachment functions (proximity-seeking, safe haven, and secure base.) The use of each target figure varied with age and attachment function. Mothers were an important source of security across this age range. They were used as secure base consistently more than fathers or peers for all age groups, and regardless of whether or not participants had romantic partners; but were used less for proximity and safe haven by the two older groups. Best friends were used most and more than others as a safe haven; but were used less by young adults (vs. early adolescents) and by older adolescents with romantic partners. Romantic partners were used most and more than others for proximity; but were used less by early adolescents than by older participants. Fathers were selected less than other targets for all attachment functions. Those with romantic partners turned to them more than to others, and young adults selected their romantic partners as much as friends for safe haven. Those insecurely attached to mother turned to her less and to romantic partners more than did those securely attached. Implications for developmental changes in adolescent attachments are discussed. 目的监测小鼠死后细胞核DNA降解的情况,探讨死后细胞核DNA降解的一般规律。方法应用单细胞凝胶电泳(SCGE)技术结合荧光显微镜和专业的计算机图像分析技术,测定111只小鼠在死后72h内不同时间点小鼠心肌组织细胞头半径、尾长度、头DNA含量比例、尾DNA含量比例、尾矩、Olive矩、头面积、尾面积八项参数的变化值。结果在个体死亡72h内,测定的八项参数指标均显示细胞核DNA降解速率和程度与死亡时间具有高度的相关性,并获得了更能体现DNA降解趋势的二项式回归方程和多元回归方程,均具有高度的统计学意义。结论应用72h内心肌组织DNA变化与死亡时间之间呈线性关系的各组回归方程,可为法医学推断死后经过时间提供一种新的、客观的、精确的方法和参考依据。  相似文献

With the increasing commonality of divorce involving children, a pattern of abnormal behavior has emerged that has received little attention. The present paper defines the Divorce Related Malicious Mother Syndrome. Specific nosologic criteria are provided with abundant clinical examples. Given the lack of scientific data available on the disorder, issues of classification, etiology, treatment, and prevention appear ripe for investigation.  相似文献

Political parties respond to electoral rules in ways which gain them partisan advantage and enable them to make strategic choices about the use of their electoral support. The alternative vote (AV) and proportional representation by the single transferable vote (STV) provide considerable opportunity for this kind of partisan activity. The ability of the voter under such electoral systems to rank candidates in order of the voter's preference creates a kind of property which can be used by parties, especially minor parties, to influence the behaviour of both candidates and other parties. The paper investigates this aspect of preferential voting systems and the extent to which the context of electoral rules can encourage or discourage a trade in partisan preferences. Elections for the Australian House of Representatives and Senate are used to show how political actors can respond to electoral rules which permit the control and trading of preferences to be developed into a series of sophisticated transactions.  相似文献

Abstract

With the dust settled after Singapore’s 2015 parliamentary elections, the only aspect pundits and Singaporean politics watchers could agree on was that the People’s Action Party’s comeback from its performance at the 2011 elections, although not of Lazarus proportions, was most certainly unexpected. While the result of the 2015 elections has gone through several post-election analytical mills, what has been oddly absent in such analyses is a discussion of gender in Singaporean politics. This article considers the relationship between gender and Singaporean politics through the experience of the 2015 election and its results. It shows that while Singapore has moved some way towards assuaging the demands of liberal feminists for greater representation in the political sphere, much more has to be done in order for gender equality to be achieved. The article argues for the Group Representation Constituency method of electing parliamentarians to be adapted to ensure a greater number of female parliamentarians while a quota system may be required for cabinet to be truly representative of the female demographic of Singapore.  相似文献
