甘肃省装备制造产业结构的发展演化：2002—2012

该文通过构建结构相似系数、产业需求弹性系数以及比较劳动生产率等统计量,探寻甘肃省装备制造产业发展演化过程中的特征和规律。研究发现,甘肃省装备制造产业结构整体上呈现出趋同性,但也有部分产业与其他产业间存在分化的迹象;金融制品产业市场容量存在进一步缩小的趋势,交通运输设备制造业在多数年份的市场容量均较小;产业内部的劳动生产率存在明显的差异性,且其变动趋势也不尽相同。     

高校学生伤害事故责任问题新探

当今社会,高校学生伤害事故频发并引起社会的强烈关注。如何妥善处理高校学生伤害事故,依法厘清高校责任,既是维护学生合法权益的需要,亦是维护高校教学秩序,维护高校和谐校园建设的需要。高校与学生之间,既非大陆公法学说认为的特别权力关系,亦非私法契约理论认为的私法契约关系或者简单地适用美国宪法理论,更非盲目套用的监护关系,相比之下,双重法律关系说更值得借鉴与探讨。因此,学生与学校之间除有明确的合同关系外,学生伤害事故更应该适用侵权责任法来界定责任。     

The Special Needs of Victims of Torture or Serious Violence: A Qualitative Research in EU

Abstract

In recent years ongoing wars and serious violations of human rights have driven increasing numbers of people away from their homes, especially in the Middle East and Africa to countries in the European Union to seek asylum. It is estimated that between 5% and 35% of these asylum-seekers and refugees have suffered from torture or serious violence. Studies and practice have shown that an appropriate response to the special needs of victims of torture or serious violence contribute to reduce survivors’ suffering and provide properly international protection. EU legislation recognizes that such vulnerable individuals have special needs, but few of these needs have already been identified and recognized as such. This article reports on a qualitative study carried out in six EU countries - France, Germany, Greece, Italy, Malta and Portugal - to explore the special needs of victims of torture or serious violence who present among asylum-seekers, during the asylum request procedure, in reception, and throughout rehabilitation and social integration. The study aims to release into the academic community the results of a large policy and practice-oriented study.     

菲中贸易对菲律宾经济的影响评估

2005年以来，中国成为菲律宾的第三大贸易伙伴，菲中贸易对两国都产生了重要影响。本文主要分析菲律宾与中国之间的进出口商品结构、机械及运输设备和农产品贸易数据，评估菲中贸易对菲律宾经济、就业和民生的影响程度。     

“两个证据规定”运行情况实证调研——以S省G市地区法院为考察对象

"两个证据规定"出台实施后,其呈现出的实践面相到底若何,究竟是满足了制度预期还是"经历坎坷",这都需要走进司法实践,以旁观者的视角对其进行考察、审视后才能加以回答。基于此,课题组于2011年11月选取了S省G市为调研蓝本,重点关注并调研了以下几个方面:(1)非法证据的认定、排除程序;(2)瑕疵证据的补正与合理解释;(3)特殊侦查措施的适用、质证;(4)证人出庭作证;(5)翻供、翻证的处理;(6)证据裁判原则的运用。在对上述六个专题的实践样态以及存在问题进行客观描述后,课题组对其加以评析,并在此基础上提出了对策建议,以期对立法、司法部门、理论界作出有益的贡献。     

犯罪心理测试技术存在的问题及完善方法

中国的犯罪心理测试技术经过三十年的发展,初步建立了心理测试的科学体系,测试技术在中国起步并呈现良好的发展势头,但是在发展实践中仍然存在诸多问题,文章提出了相应的解决对策,对犯罪心理测试技术的科学发展具有指导意义。     

论农业合作社的法律性质

农业合作社是农民自愿组成的、以互利为基础的、自治性的生产经营组织。其作用正越来越受到重视 ,《合作经济组织法》也已列入十届全国人大立法规划。尽管农业合作社是生产经营组织 ,但其与公司在营利性和成员权利方面存在着很大不同 ;与集体经济组织在产生原因和目的以及成员边界等方面也不相同。因此 ,农业合作社是一种既不完全同于公司、又不同于集体经济组织的特殊法人。承认这种特殊性 ,是保证合作社法的具体规则得以科学、合理安排的前提和基础     

Noise Trauma Induced by a Mousetrap—Sound Pressure Level Measurement of Vole Captive Bolt Devices

Abstract: While ballistic parameters of vole captive bolt devices have been reported, there is no investigation on their hazardous potential to cause noise trauma. The aim of this experimental study was to measure the sound pressure levels of vole captive bolt devices. Two different shooting devices were examined with a modular precision sound level meter on an outdoor firing range. Measurements were taken in a semi‐circular configuration with measuring points 0° in front of the muzzle, 90° at right angle of the muzzle, and 180° behind the shooting device. Distances between muzzle and microphone were 0.5, 1, 2, 10, and 20 m. Sound pressure levels exceeded 130 dB(C) at any measuring point within the 20‐m area. Highest measurements (more than 172 dB[C]) were taken in the 0° direction at the 0.5‐m distance for both shooting devices proving the hazardous potential of these gadgets to cause noise trauma.     

An Ecological Examination of Factors That Impact Well‐Being Among Developmentally‐Disabled Youth in the Juvenile Justice System

Youth with developmental disabilities make up a large proportion of those in the juvenile justice system, and experience various unique and intricate threats to their well‐being. This review examines the complexity of these challenges, exploring the multiple levels of contextual factors that influence youth's well‐being as they experience adjudication. Using an ecological framework, this paper reviews findings on the individual socio‐demographic characteristics, as well as the micro, meso, exo, and macro factors that impact their development and functioning. Specific policy and practice implications are provided to address improving outcomes of youth in this population at each ecological level.     

特殊犯罪群体的犯罪分析与预防——以“未婚妈妈”杀婴案为视角

“未婚妈妈”杀婴案存在着被告人低龄化、低学历化,犯罪手段具有较大的残忍性,刑罚处遇轻缓化等特征。该类犯罪的成因既有行为人个体心理失常的直接原因,社会化的失败及消极的非社会实践的社会因素,也存在着现代性文化冲突的根本原因。预防此类犯罪,要进行价值观与道德教育,消除犯罪心理;加强特殊群体的社会化过程;净化社会环境,消除消极因素的影响等。
