掩饰、隐瞒犯罪所得及其收益罪的行为样态分析

本文从民法的角度界定了掩饰、隐瞒犯罪所得及其收益罪的犯罪对象和行为样态:前者包括犯罪所得及其收益,犯罪所得为民法上的原物,犯罪所得收益为原物产生的孳息;后者包括隐瞒行为和掩饰行为,隐瞒行为包括窝藏、转移、收购、代为销售以及其他隐瞒行为,掩饰行为包括加工等。     

论我国行政补偿制度的原则与范围

行政补偿制度是因行政机关的合法行为、合法行为的附随效果或公法之无因管理行为等给相对人造成损失,从而进行补偿的行政法律制度。补偿原则与范围等是行政补偿制度构建的基础性问题。从我国的制度构建需要出发,行政补偿原则应当包括公民权益保护原则、依法补偿原则等,补偿范围则因补偿领域的不同而有所不同。

附带民事诉讼中的民事赔偿,历来是理论界和实务部门所关注的焦点之一。杭州胡斌案、成都孙伟铭案和近来闹得沸沸扬扬的李刚之子案,再次把人们的视线引向了附带民事诉讼中的民事赔偿。附带民事诉讼中的民事赔偿应当包括精神损害赔偿,附带民事诉讼中民事赔偿的＂赔钱减刑＂则应当慎用。     

出口产业生产贸易链构建的财政利益补偿机制研究——基于中国—东盟自由贸易区框架下我国粤、桂、琼、滇四省区的分析

中国—东盟自由贸易区(CAFTA)框架下我国广东、广西、海南、云南(粤、桂、琼、滇)出口产业生产贸易链(下简称"出口产业链")的构建有其现实必要性。在出口产业链的构建过程中,必然会涉及到各地区之间金融、财政税收权益等多方面相关利益的调整,需要建立有效运行的利益补偿机制,对各省区之间的利益矛盾和冲突进行解决。本文从公共财政角度出发,深入分析并论证了CAFTA框架下出口产业链的构建对广东、广西、海南、云南4省区相关利益的影响,并认为地区间利益补偿机制的建立不仅应当包括纵向的利益补偿机制,还应当包括横向的利益补偿机制,同时还必须与其他非财政性政策进行协调与配合,实现良性互动。     

论国家安全与签证制度改革

基于国际移民的历史与现状，以国家安全为视角，研究中国、美国、英国等国家在不同历史时期，调整其移民政策以及改革其签证法律制度的理论与实践，可见各国签证制度的变革往往是以国家安全为核心。为加强我国国家安全，应从新时期的华侨政策、人才签证和打击“三非”等方面改进我国的签证法律制度。     

医疗损害赔偿诉讼难题及审判对策

《侵权责任法》第七章留下诸如当事人选择、案由确定、医疗过错和因果关系判断标准、病历证据属性、鉴定体制等许多实践操作的难题。对这些司法实践难题的解决,最高人民法院目前已经出台了部分司法解释,但实质性的问题都没有得到解决。由于最高人民法院出台司法解释有一个过程,在司法解释尚未出台之际,地方高级人民法院针对当地的司法实践的具体情况,可以因地适宜出台地方司法审判指导文件。我们现在看到的浙江、江苏、上海、北京四个省市的地方审判指导文件,解决了各地审理医疗损害赔偿纠纷案件中的一些难题,在制度上有创新之处,且具有极强的可操作性。地方司法审判指导文件的出台,既解决了当前地方上医疗损害赔偿案件审理的困境,也为最高人民法院制定司法解释积累经验。

The dynamic properties of individual-level party identification in the United States

Central to traditionalist and revisionist perspectives of individual-level party identification is a debate about the stability of party identification. We revisit the debate about the dynamic properties and processes underlying party identification. We present a conceptual framework that defines heterogeneity and state dependence as endpoints of a continuum underlying partisan stability, which is important in understanding an individual’s capacity for updating partisanship. Using panel data from the 1992-1996 National Election Study, we estimate dynamic, random effects multinomial logit models of party identification that distinguish between heterogeneity and “true state dependence.” In accord with traditionalist perspectives, our evidence suggests that in general, minimal state dependence underlies party identification; party identification is strongly stationary. However, we find that age enhances the magnitude of state dependence, which provides some support for revisionist theories. Overall, our work showcases how explaining individual-level dynamics expands our knowledge of partisan stability.

刑事附带民事诉讼调解能有效地减少矛盾对抗,缓解情绪对立,平衡利益关系,促进社会和谐,是人民法院在刑事司法领域的重要司法举措,也因此有着较高的调解率。对两种案件类型的实证分析表明,"赔偿从宽"在实践中大力促成了刑事附带民事诉讼调解,成为影响高调解率的一个重要因素。     

Heaven's Talent Scout: Prime Ministerial Power,Ecclesiastical Patronage and the Governance of Britain

In the last decade the role of the Prime Minister in the process for making senior Church appointments has changed significantly. The man who replaces Dr Rowan Williams—and it will be a man—will be appointed through a procedure in which the Prime Minister is expected to enjoy no choice but to simply confirm the Church of England's preferred candidate. The aim of this article is to draw upon fresh empirical research in order to explore why and how the politics and governance of ecclesiastical patronage has been recalibrated in this way. More importantly this article seeks to embed the study of ecclesiastical patronage within a much broader appreciation of how other forms of ministerial patronage have also become tightly constrained. This, in itself, forges a connection between the role of politicians in senior Church appointments, on the one hand, and a much richer and broader seam of research and writing that poses distinct questions about the nature of modern governance, the benefits of depoliticisation, the accountability of appointment commissions, the capacity of politicians and the future of democracy.
