中国市场经济法律:进展与评价

我国建立社会主义市场经济是在计划经济的基础上进行的,由此决定了市场经济法律体系的特殊性。目前中国的市场经济法律体系已初步形成,但仍存在不足：如观念尚待更新;企业受到过多的行政管制;市场经济法律体系有待完备,须及早颁行反垄断法、国有资产法、国民经济稳定增长法、计划法等;法律可操作性不够。今后,更重要的将是提高执法水平、严格执法程序、惩治司法腐败。     

人身伤害重新鉴定的困惑与出路

刑事诉讼法和司法解释对人身伤害重新鉴定立法位置安排的不当和程序设计的缺失,遭到了鉴定实践的抗争,默默演变为不断重复鉴定的制造源。因此,应当完善人身伤害重新鉴定的启动程序,经过文证审查的过滤,建构专家委员会的终结性复核鉴定制度,并通过诉讼程序消解鉴定障碍,达到公正选择适用重新鉴定程序规则的目的。     

高校腐败犯罪研究

我国高校腐败犯罪数量突升,大案、要案居高不下;犯罪主体年轻化,领导干部涉案多;贪污受贿犯罪为主,窝案串案比例大;犯罪领域众多,后勤基建成高发区。造成这种状况,既有市场经济消极作用的原因,也有高校内部权力过于集中、管理制度存在缺陷、监督严重不力等方面的原因。因此,必须采取多项有效的防治对策,才能遏制高校腐败犯罪的发展。     

对民警培训评估体系建设的几点思考

民警培训质量评估对加强和改进民警培训中心或基地的自身建设,改善民警民警培训教学训练和管理水平,提高民警培训质量具有积极意义。培训中心应充分理解民警培训评估的科学内涵,积极构建评估组织完善、程序合理、指标体系科学的民警培训质量评估体系。

An evaluation approach that is collaborative and elicitive may well serve as a catalyst for transforming relationships of power, standing in stark contrast to more conventional and staid evaluation practices that are technical in nature and actuarial in intent. Election of an orientation is the most decisive and strategic choice that is made in approaching evaluation and articulating value imperatives in fieldwork, coloring as it surely does the pragmatic stages of evaluation and good practice for the peacebuilder.     

Revisionist history,visionary criminology,and needs-based justice

Although there may be some value in debating the question of whatever happened to radical criminology, I believe that it is more productive to think in terms of radical and/or critical continuities in pedagogy, research, and practice that have survived time and can be linked to current efforts in visionary criminology and transformative justice. Examining changes in the study of crime and justice from such a perspective, it can be argued that the antiestablishment criminologies of the year 2003 are not any more marginal, and in fact may be less marginal today than when radical criminology first burst onto the scene in the early 1970s.     

Narrative accounts from the citizens,victims, and offenders restoring justice program

This paper describes the Citizens, Victims, and Offenders Restoring Justice (CVORJ) program, a prison-based program conducted as a pilot study at the Washington State Reformatory. The program brings together offenders and victims - though not involved in the same crime - in the company of interested community members to discuss restorative justice principles. The program focuses on the sharing of personal narratives of crime to explore how the harms resulting from crime can best be addressed and justice achieved. Of interest was how a restorative justice model that highlighted community participation could be incorporated into a correctional setting and whether healing could result from the use of surrogate offenders, victims, and community members. The restorative nature of the program, its method of operation, results from the qualitative evaluation, and key implementation challenges are presented.     

Can Twitter Add to Performance Evaluation in the Area of Performing Arts? Reflections from La Scala Opera House

ABSTRACT

Social media are continuously diffusing in performing arts organizations. Yet little is known on how social media data can contribute to the performing arts evaluation process. This article addresses this issue by investigating if and how Twitter data can add a valuable source of information to the performance evaluation process. A literature review with an empirical application on the evaluation of the performance Aida at Teatro Alla Scala provides evidence about the type of indicators that can be derived from Twitter and support a discussion about potentialities and pitfalls connected to their adoption for the evaluation of performing arts.
