On Music,Censorship, and Globalization

Malik Bendjelloul’s music documentary, Searching for Sugar Man (2012), uses the narrative of its central figure, American rock “n” roll musician Sixto Rodriguez, to allegorize South Africa’s emergence from censorship and isolationism to a post-apartheid and increasingly transnational dispensation. I look at the cultural politics of apartheid-era censorship in attempt to account for Rodriguez’s cult appeal in South Africa, despite his artistic shortcomings and his obscurity in the USA. I then focus on the film’s final concert sequence, featuring Rodriguez’s first South African performance, which Bendjelloul subtly positions as a moment of celebration over the new possibilities enabled by the demise of apartheid and the rise of an increasingly integrated global culture.     

Differing patterns of marriage between a city and villages in 18th century Korea: The case of Taegu Area

While the urban area was increasingly filled with middle- and low-status residents, the rural area was dominated by high-status settlers whose number increased because of migration from the city and natural growth. Remarkable differences existed between urban and rural marriage features such as marriage age and rate of remarriage. The more sincere adoption of the high-status marriage culture in the rural area may be attributed to its occupational homogeneity. In the rural agrarian settings, landlords, self-cultivators and tenants shared a similar living pattern and value system based on the agricultural cycle. The urban area, however, exhibited a variety of work patterns of local functionaries, artisans and merchants. Many middle- and low-status people might well have found the high-status culture of the rural area incompatible with their own.     

"More than All the Others": Meditation on Responsibility

Abstract

This essay examines one aspect of the wide-ranging philosophical back ground of the intellectual and dissident movement for human rights in one-time communist Czechoslovakia. I shall meditate on Jan Pato?ka's finite responsibility, Derrida's aporetic emphasis on the infinite dimension of responsibility, and Lévinasian-Dostoyevskyan ethico-existential variations on in/finite responsibility. Havel alludes to hyperbolic ethics in a parenthetical remark on the birth of "Charta 77", the Manifesto for Human Rights in Czechoslovakia. The question before us is this: which dimension of responsibility appears at this birth or, to put it otherwise, what responsibility is born in care for the soul and polis?     

Psychoanalysis and development: contributions,examples, limits

This article examines the contributions of psychoanalysis to international development, illustrating ways in which thinking and practice in this field are psychoanalytically structured. Drawing on the work of Lacan and ?i?ek, the article will emphasise three key points: (1) psychoanalysis can help uncover the unconscious of development – its gaps, dislocations, blind spots – thereby elucidating the latter’s contradictory and seemingly ‘irrational’ practices; (2) the important psychoanalytic notion of jouissance (enjoyment) can help explain why development discourse endures, that is, why it has such sustained appeal, and why we continue to invest in it despite its many problems; and (3) psychoanalysis can serve as an important tool for ideology critique, helping to expose the socioeconomic contradictions and antagonisms that development persistently disavows (eg inequality, domination, sweatshop labour). But while partial to Lacan and ?i?ek, the article will also reflect on the limits of psychoanalysis – the extent to which it is gendered and, given its Western origins, universalisable.     

The success of Afghan NGOs

During the 1990s, and as part of a broader drive towards the “Afghanisation” of humanitarian assistance in Pakistan, Afghan NGOs became key implementing agencies supporting refugee-related and reconstruction activities in Afghanistan. This paper provides a detailed account of their emergence and consolidation, with a twofold objective. First, it complements and contributes to recent studies on Afghan NGOs and Afghan civil society, by providing historical insights on their trajectory. Second, it assesses such trajectory as a way of engaging with broader discussions on the role of NGOs within humanitarian operations.

Le succès des ONG afghanes

Durant les années 1990, et dans le cadre d'une initiative plus générale vers l’« afghanisation » de l'assistance humanitaire au Pakistan, les ONG afghanes sont devenues des agences clés de mise en ?uvre soutenant des activités de reconstruction et d'aide aux réfugiés en Afghanistan. Cet article propose un compte rendu détaillé de leur apparition et de leur consolidation, dans un double objectif. En premier lieu il complète et contribue à des études récentes sur les ONG afghanes et la société civile afghane, en donnant un aperçu historique de leur trajectoire. En second lieu, il évalue cette trajectoire dans le but de prendre part à des discussions plus larges sur le rôle des ONG dans les opérations humanitaires.

El éxito de las ong afganas

Como parte de un esfuerzo dirigido a “afganizar” la asistencia humanitaria en Pakistán durante los años noventa, las ong afganas se volvieron agencias operativas clave para el apoyo de actividades vinculadas a los refugiados y a la reconstrucción en Afganistán. El presente artículo proporciona una historia detallada de su aparición y de su consolidación y tiene dos objetivos. En primer lugar, complementar y contribuir a los estudios recientes respecto a las ong afganas y a la sociedad civil afgana, esclareciendo su trayectoria histórica. En segundo lugar, realizar una valoración de dicha trayectoria como una manera de participar en el debate más amplio en torno al rol jugado por las ong en el ámbito de las operaciones humanitarias.

Durante a década de 1990, como parte de uma orientação mais geral para a “Afeganização” da assistência humanitária no Paquistão, ONGs afegãs tornaram-se agências implementadoras cruciais que apoiam atividades relacionadas a refugiados e à reconstrução no Afeganistão. Este artigo oferece um relato detalhado sobre o seu surgimento e consolidação, com um duplo objetivo. Primeiramente, ele complementa e contribui para estudos recentes sobre ONGs afegãs e a sociedade civil afegã, fornecendo informações históricas sobre sua trajetória. Em segundo lugar, ele avalia tal trajetória como forma de engajamento com discussões mais gerais sobre o papel de ONGs dentro de operações humanitárias.     

Alternative Verursachungskonkurrenz mit dem Zufall – Die Wahrscheinlichkeit als Haftungsgrund?

Der Arbeitsgruppen-Entwurf eines neuen ?sterreichischen Schadenersatzrechts sieht vor, dass die Verursachungskonkurrenz mit dem Zufall zu einer Anteilshaftung führt. Die Verfasser des Entwurfs konnten sich dabei an der hM orientieren. Deswegen wird im Folgenden die alternative Konkurrenz mit dem Zufall auf der Grundlage der lex lata beurteilt, um den Ausgangspunkt des Entwurfs bewusst zu machen. Dabei wird gezeigt werden, dass die hM mit dem geltenden Recht nicht vereinbar ist. Die ge?u?erten Bedenken sprechen überdies gegen eine Normierung der Anteilshaftung im Zuge der Reform des Schadenersatzrechts.     

Wirksamkeit der Bestellung eines Verfahrenssachwalters

Die Bestellung eines Verfahrenssachwalters wird wie jene des einstweiligen Sachwalters bereits mit der Zustellung des Bestellungsbeschlusses und nicht erst mit dessen Rechtskraft wirksam. Hinsichtlich des Fehlens einer klarstellenden Regelung über den Eintritt der Wirksamkeit des Bestellungsbeschlusses ist insofern von einer planwidrigen Unvollst?ndigkeit des § 119 Au?StrG auszugehen, die durch analoge Anwendung des § 120 Au?StrG geschlossen werden kann.     

Reichweite des Vorzugspfandrechts gem § 27 WEG 2002; keine Unterbrechung wegen Konkurses des Bekl im Verfahren über eine diesbezügliche Klagsanmerkung; kein Kostenersatz im Grundbuchsverfahren über die Streitanmerkung

Das Vorzugspfandrecht gem § 27 Abs 1 WEG 2002 kommt der Eigentümergemeinschaft dann nicht zu, wenn ihr der betroffene Miteigentümer wie ein au?enstehender Dritter gegenübersteht, was etwa bei Abschluss eines Werkvertrages über Arbeiten an der Liegenschaft der Fall ist. Anders verh?lt es sich, wenn der Anspruch aus einem gesetzlichen Schuldverh?ltnis resultiert, welches seine Wurzel in der Verwaltung der Liegenschaft hat. Zur Erwirkung der Streitanmerkung nach § 27 Abs 2 WEG 2002 muss die Klage zumindest die schlüssige Behauptung enthalten, dass die F?lligkeit der Forderung h?chstens sechs Monate vor Klagseinbringung eintrat. Das Verfahren über die Streitanmerkung wird durch die Er?ffnung des Konkurses über das Verm?gen des Bekl gem § 7 Abs 1 KO nicht unterbrochen. Im Grundbuchsverfahren über die Streitanmerkung findet auch nach der Rechtslage nach dem Au?erstreitG 2005 grunds?tzlich kein Kostenersatz statt.
