民营化:消防管理体制改革的一种路径

城乡二元对立结构基础上的乡村巨变、消防事务治理结构内在的可分解性以及公共部门消防服务供给能力的不足,使得消防事务的民营化具有客观必要性。我国消防服务民营化改革宜采取通行的合同承包方式,通过委托民营部门生产部分消防服务实现,政府角色向事前决策者和事后监管者的嬗变,从而在维系政府公共责任的前提下向全社会公平地供给消防服务。     

新型网络服务提供者的定性与责任建构——兼评阿里云服务器案

对于云服务器租赁等新型网络服务提供者而言,应当灵活地理解《侵权责任法》第36条中所述的"通知删除"规则。因为该类网络服务提供者对于他人通过其提供服务所传递的信息及内容,并无实际控制或影响的能力,一概地要求其断开所提供服务,可能有违"手段-目的"应合比例性的要求。当然,权利人发出的通知应当满足必要的构成要件。若因其不当行使通知权利,也应受到必要的惩罚。根据阶段不同,对新型网络服务提供者也有不同的责任要求,具体而言:其在事前应履行必要审查义务,在事中应主动判断通知内容并确定可以采取的适当必要措施,而在事后视其过错程度承担相应的责任。

刑事被害人国家补偿制度体现了国家对刑事被害人这一弱势群体的人权保障,反映了一国的法治水平。本文就建立我国刑事被害人国家补偿制度的必要性和可行性进行了分析,提出了具体的构建设想。     

被害教育初探

既然被害预防是以减少被害人和潜在被害人自身的诱发因素和犯罪条件的预防方式,那么,没有对被害人和潜在被害人的被害教育,被害预防就难以实施。被害教育是被害预防的最基本的措施和前提。政府应当制定切实可行的被害教育计划,增强公众预防被害的责任感,帮助公众树立被害预防观念。

对四川省劳务市场拐卖妇女犯罪现象进行实证调查,“王某、周某劳务市场被拐案”表明,求职妇女、中介人、市场的管理者和用人单位四类人员在劳务市场拐卖犯罪及其预防中的地位和作用不同。非法职介的大量存在是诱发劳务市场拐卖妇女犯罪的主要根源。其产生有立法、执法等各方面原因。要有效地预防劳务市场拐卖犯罪,必须制定有针对性的宏观策略和配套措施。     

中国会计服务出口的机遇与挑战——以东盟市场为例

Not Afraid at All? Dominant and Alternative Interpretative Repertoires in Discourses of the Elderly on Fear of Crime

This article demonstrates how a dominant and an alternative interpretative repertoire are activated and negotiated within two focus group discussions conducted with elderly people around the issue of fear of crime: the active, competent actor and the potential victim. In contrast to quantitative generalist studies that tend to neglect the ambiguity and complexity of group membership and identification, a contextualized, dynamic, and interactive understanding of the elderly – as well as of the victim – identity is presented.     

Exploring Agreement on Appropriate Responses to Domestic Violence and Sexual Trauma Across Victim Advocates,Mental Health Service Providers,and Substance Abuse Treatment Providers

Abstract

Research suggests that survivors of domestic violence and sexual assault are more at risk than the general population for substance abuse and/or mental health disorders (Kendler et al., 2000). Additionally, research suggests that survivors of both crimes are at risk to be “multiply diagnosed-have” a history of victimization, a mental health diagnosis, and abuse of alcohol and drugs (Steele & Rechberger, 2002). While advocates have called for a change in the treatment of trauma survivors to treat their multiple needs, the availability of collaborative care between victim advocates and behavioral health professionals remains questionable. Using survey data collected from victim advocates, mental health service providers, and substance abuse treatment providers, this study assesses the extent to which providers of different backgrounds agree on how to effectively and appropriately serve domestic violence and sexual assault survivors-the first step in achieving the goal of holistic care.     

Langauge and Violence: Analysis of Four Discursive Operations

The Interactional and Discursive View of Violence and Resistance is a framework for critical analysis and research, prevention and intervention that takes into account the conditions that enable personalized violence, the actions of perpetrators and victims, and the language used in representing those actions. Using this analytic framework, we analyzed five accounts of personalized violence, one each from a perpetrator, a psychiatrist, a judge, a government minister, and a therapist. Our results demonstrate the scope and the ubiquity with which diverse accounts locally accomplish four-discursive-operations; namely, the concealing of violence, obfuscating of perpetrators’ responsibility, concealing of victims’ resistance, and blaming and pathologizing of victims. We examine the specific linguistic devices that combine to accomplish the four-discursive-operations in each case. These data suggest that the problem of violence is inextricably linked to the problem of representation.
