俄罗斯联邦安全会议的历史演进及对中国的启示

当前,国际局势发生着复杂而深刻的变化,国内安全与国际安全、传统安全与非传统安全问题相互交织、难解难分,世界各国都在采取各种措施应对国际安全局势的变化。俄罗斯的安全会议诞生于苏联解体前夕,作为苏联的继承国,俄罗斯接掌安全会议后,随着国内外局势的变化不断完善该机构的工作和决策机制。俄罗斯总统作为安全会议主席领导安全会议机构,协同国家各个关键参与部门,在事涉国家安全的内政外交方面,尤其在打击车臣恐怖势力方面,做出许多具有重要意义的决策,保证了俄罗斯国家经济发展、社会稳定和领土完整。俄罗斯安全会议还就经济、军事、人口、能源、生态、信息、科技等许多事关国家安全的重要领域出台了一系列战略构想。在国际关系领域,俄罗斯安全会议除出台对外政策构想、对独联体国家发展关系的方针政策外,还在2014年乌克兰危机的关键时刻,及时做出重要决策,有力地保障了俄罗斯的利益与国家安全。俄罗斯作为中国的重要邻国和全面战略协作伙伴,与中国面临着相似的内外安全问题,其设立安全会议的经验及具体运行机制等均对中国新设立的国家安全委员会具有重要的参考意义,值得中国认真研究、学习和借鉴。     

Fiscal Distress in Local Authorities in Israel: the Convened Committee as a Method and a Solution

This study addresses fiscal distress in local authorities in Israel and around the world, and provides an in-depth analysis of the city of Bnei Brak from 1994 to 2003. When the city of Bnei Brak grappled unsuccessfully with fiscal distress, the Ministry of the Interior appointed a Convened Committee (CC; Va'adah Kruah) to handle the crisis. This study explores the methods and solution used by the government to extricate the authority from bankruptcy, while examining the sources and repercussions of this decision. The findings show that the CC solution was borne of necessity, due to the gravity of the financial crisis and the fact that the government had no other way of bailing out the city. However, the situation in Bnei Brak did not improve even after the CC was appointed, which challenges the very efficacy of the solution. This forms the basis for a discussion of the complexities of resolving the fiscal distress of localities in Israel.     

THE SINS OF THE GREAT-GRANDFATHER: THE ROWLATT ACT AND THE AMRITSAR MASSACRE

Justin Rowlatt, the BBC's South Asia Correspondent, writes a reflection on the 1919 Amritsar Massacre and the 1919 Rowlatt Act, which was a precursor to the Massacre. The author is the great-grandson of Sir Sidney Rowlatt, who was responsible for the 1919 legislation.     

Can Formal Rules of Order be Used as an Accurate Proxy for Behaviour Internal to a Legislature? Evidence from Costa Rica

Scholars rely heavily on formal rules to classify legislatures, but parchment institutions may only tell part of the story about how the chamber works. Behind-the-scenes behaviour may counter-balance or temper the power distribution created by formal rules. To begin examining if formal rules are an accurate predictor of actual behaviour, we analyse standing committees in Costa Rica's Legislative Assembly. We find that despite the formal institutions that favour a majoritarian bonus, the opposition party is a full participant in the legislative process in committee sessions. Opposition deputies participate equally or more so than majority party deputies, and deputies of all parties work together to investigate bills and kill legislation evaluated to be flawed, which indicates that formal rules are only one component to understanding legislative behaviour.     

广州仲裁委员会十年发展述评

广州仲裁委员会成立已近十年,为及时总结经验,明确今后努力的方向,有必要对广州仲裁委员会过去十年的发展情况作一总结性回顾。本文首先简单回顾了广州仲裁委员会的成立与中国仲裁制度改革的关系,然后对广州仲裁委员会近十年的发展情况进行了统计学分析,最后就广州仲裁委员会的成功经验进行了总结,并对广州仲裁委员会未来的发展进行了展望。     

论我国的违宪审查体制与完善

本文立足于中国实际 ,在比较衡平了国外三种违宪审查类型的利弊后 ,认为我国实行以全国人大及其常委会为主的违宪审查制度较为适宜。文章还讨论了我国现行违宪审查制度的审查主体、审查范围及审查方式 ,并从设立专门工作机构和扩大全国人大常委会审查范围两方面提出了完善的建议。     

村委会选举中的行政侵权及其救济

现行制度框架下,由于缺乏村委会选举权利的救济制度,导致村民选举权无法得到及时有效的保障;此外,对行政侵权行为处罚不力,也成为当下乡镇机关频繁侵犯村民选举权的制度性因素。因此,健全村民选举权的宪法、诉讼和行政救济体系,成为控制村委会选举中行政侵权和规范村委会选举行为的有效途径。     

论村民自治异化及其法律治理

村民自治虽然取得巨大成就,但在实践中由于制度设计、传统体制的惯性和自治主体素质等多方面原因使其在自治主体、功能和权力等方面存在较严重的异化现象.克服村民自治异化,不仅要完善制度供给,强化组织保障;而且还要贯彻村务公开,加强程序保障,建立有效的司法保障机制;更要完善民主选举制度,提高村民自治主体素质.     

业主委员会：城市社区民主发展的可能载体——广州嘉和苑业委会调查

从对广州嘉和苑业委会成立过程的调查可见,业主委员会的选举是一场崭新的民主实验,是一种实质的民主选举,不像原有的居委会选举只具民主的符号意义。究其原因,城市住房制度的变革,使居民成为住宅的所有者(业主),他们的利益第一次与其居住的社区紧密结合起来。这或许意味着以业主委员会为主导的城市新型社区的业主自治实践,有可能成为我国城市社区民主发展的另一个支撑点或载体,并对国家的民主政治建设产生积极影响。     

当前村委会选举中的问题及对策

村民自治是我国民主政治建设的重要内容 ,在我国的基层民主建设中取得了初步成效。完善村委会选举规范 ,提高村委会选举质量 ,应侧重于理顺乡镇政府与村委会的关系问题 ,解决部分村民选举资格受阻问题 ,杜绝拉选票现象
