What Liquidation Does For Secured Creditors, And What It Does For You

This article analyses the liquidation process, challenging the much repeated proposition that secured claimants 'stand outside' liquidation. It is argued that this proposition (i) is a product of a misunderstanding of the dual duality in the nature of liquidation proceedings, in that, in principle, they serve both public and private functions, and they further the interests of both secured and unsecured creditors; (ii) overlooks how secured creditors benefit from liquidation, and also how unsecured creditors have a real interest in the proper administration of their debtor's encumbered assets; (iii) mistakes the secured creditor's choice in usually being able to gain immunity from the liquidation process, for a compulsion to stand exiled from this process; (iv) is incorrect as a matter of history and practice; and (v) is rendered unsustainable by the statutory text. It concludes that secured creditors have never 'stood outside' liquidation, that liquidation is an important tool for the protection of their interests, and that it is right to require floating charge holders to pay their fair share of liquidation expenses.

本文通过对Sheppard v.Maxwell案具体案情利审理的分析,介绍了美国解决媒体与司法冲突的理念和对策,并从立法机关、新闻媒体、司法机关三方面对我国媒体与司法和谐关系的构建提出了具体的建议。     

国家间信任的生成:进程导向的社会网络分析

信任是影响社会行为体互动的重要变量,但现有国际关系领域的信任研究大多注重经验分析,一般的理论探讨也常常忽视国家间信任的生成问题。本文就现有研究的主要路径进行了梳理和评介,并尝试从社会关系网络的角度建构一个国家间信任生成的研究框架。这一框架沿袭了进程建构主义的基本思路,主要观点为:嵌入在国际社会网络中的信任来源于国家间关系,以关系为本位的网络形塑了信任,信任反过来强化或削弱关系网络;在信任建构的进程中,信任规范得以产生、扩散和内化,进而影响国家的属性和行为;但由于关系网络本身是动态性的,特别是相互关系中存在不对称依赖,这使得信任具有社会资本的分配资源功能。     

Turnover,Trust, and Transfers: An Examination of Local Government Budget Execution

Abstract

Studies of budget execution focus either on the procedural aspects of internal controls and adjustments or the necessity of the changes made in the original budget. Adjustments made on an ongoing basis without undermining the integrity of the budget has been generally seen as a necessary means of creating flexibility while maintaining appropriate controls. In this context, our article addresses one aspect of the local government budget—whether turnover in key leadership and professional position affects the amount of transfer and reprogramming made during the execution process. Based on surveys of municipal budget offices in the Greater Cincinnati area, we report that turnover in some leadership positions does affect budget transfers. This finding also supports the proposition that the stability of key budget roles is an important factor in the budget execution process.

高校思想政治教育是由具有不同基本功能的、多层次的结构或子系统构成和运行的有机系统,师生信任结构是高校思想政治教育有机系统中最基本的结构之一。从对社会学中信任结构的剖析、对目前学界研究成果的论证、对思想政治教育最一般本质的确证中发现,高校思想政治教育师生信任结构具有"两面性",它既是一种特殊主义信任,又是一种普遍主义信任。探讨高校思想政治教育师生信任的结构内涵或特征,不仅在学科建设上而且在实践维度中都具有基础性意义。

State political culture, primary frontloading, and democratic voice in presidential nominations: 1972–2000

In light of the notorious “frontloading” phenomenon in U.S. presidential nominating elections, this paper examines the relationship between state political culture and state primary scheduling, for the purpose of understanding how differences in institutionalized community values may have affected the equity with which democratic voice has been distributed in modern presidential nominations. Using stratified event history analyses of nomination campaign schedules from 1972 to 2000, we find that “moralistic” states tend to schedule primary dates earlier in the campaign season than do individualistic or (especially) traditionalistic states, particularly in states with more ideologically liberal elites. Moreover, this tendency toward frontloading among moralistic states becomes more dramatic as racial homogeneity increases relative to other states. These results disturbingly reveal that the democratic voices of racial minorities have often been muffled under the modern institution of presidential nominations.     

大鼠原发性脑干损伤早期脑干的免疫组织化学研究

用自制的簧片打击装置弹击大鼠枕骨结节，造成严重颅脑损伤或原发性脑干伤，取其脑干（中脑、桥脑及延髓）常规包埋、制片后作LSAB－FN染色。结果表明，在严重颅脑损伤及原发性脑干伤，可见FN沉积于血管周围间质、部分神经纤维内及一些神经细胞内，且随着损伤时间的延长，FN沉积量增加、范围增大。LSAB－FN法可用于生前原发性脑干伤与死后伤的鉴别和推断在3小时内损伤经过时间。     

宪法概念的分析整合与重新界定

有越来越多的学者对传统的宪法概念提出质疑 ,认为传统宪法概念未能揭示它的本质属性。笔者在几位学者明锐的思想及新颖观点的影响和感召下有所启示 ,并试着发表一点见解。笔者认为 ,宪法是调整国家权力在社会中的初次分配和从总体上赋予公民基本权利及协调二者关系的根本法。笔者认为这个定义明确指出了宪法的调整对象 ,揭示了宪法的根本属性 ,能清晰地表达宪法同其他部门法的关系 ,跳出了传统宪法理论的束缚     

Estimating the unintended participation penalty under top-two primaries with a discontinuity design

Participation in U.S. elections lags behind most of its developed, democratic peers. Reformers seeking to increase voter turnout often propose changes to the electoral system as means of addressing these shortcomings. One such reform, the top-two blanket primary, has been adopted in California and Washington in part to boost voter participation. Despite the promises of reformers, however, observers disagree as to its efficacy. In this paper, I estimate the participation penalty generated by top-two primaries using a regression discontinuity design (RDD). I estimate that general elections featuring two members of the same party – the arrangement reformers contend would increase turnout – actually decrease voter participation. I find that approximately 7% of voters “roll off” the ballot in the absence of party competition while overall turnout is unaffected. These results suggest that top-two primaries are likely to exacerbate rather than ameliorate trends in participation.
