International Disorder and China's Strategic Thoughts

Since the 2008 international financial crisis,international political and economic disorder has become obvious.Major reasons are the decline of US-led Western developed economies' global influence;US and other Western countries inaction or ineffective actions;power diffusion allowing non-state actors to intervene;a global governance short of needed rules;and mainstream economic theory's overemphasis on market roles.International disorder is a long-term process posing a potential threat to China' s national interests.The situation challenges China to create an international economic and trade order,thereby shaping itself as prophet of global free trade,shaper of international economic and trade rules,and trendsetter for globalization.     

Improved Area of Origin Estimation for Bloodstain Pattern Analysis Using 3D Scanning

An important component of crime scene reconstruction is bloodstain pattern analysis (BPA). Where BPA concerns impact patterns, estimating the area of origin is critical information for scene reconstruction. Traditionally, this is achieved by measuring individual bloodstains and performing trigonometric calculations; however, 3D scanning has been proposed as a viable alternative for overcoming logistical and practical concerns with the manual method. Therefore, this project aimed to establish whether the FARO Focus 3D scanner and FARO Zone 3D software can improve the accuracy of area of origin estimates relative to the manual method. We created a series of eight bloodstain impact patterns and performed paired analysis using the two methods to estimate areas of origin for each pattern. Our data suggested that FARO-derived estimates were generally more accurate than using the manual method. FARO-estimated heights of origin areas were generally closer to the true distance. Both methods underestimated the distance from the wall for most patterns originating 150mm or greater from the wall, but overestimated distances for patterns originating closer to the wall. The degree to which distances were underestimated increased significantly the further the blood source was from the wall and was greater for FARO-derived estimates. The results of this research contribute to the validation of these instruments for operational implementation for BPA and should be considered alongside the practical benefits of 3D scanning relative to manual methods. Further, 3D scanning can provide reliable BPA reconstruction documentation for technical review and court presentation.     

东盟地区公共产品供给模式与困境分析

近年来,随着地区合作与一体化进程的发展以及相应的地区政治研究的兴起,地区公共产品理论已在地区主义发展的实践领域产生了越来越强的解释力。一般而言,水平较低、进展缓慢的地区合作进程,很大程度上就是由于该地区的公共产品供给不足而引起,东盟即是如此。作为一个由中小国家组成的地区组织和一个处于发展与建构中的一体化进程,在其几十年的发展中始终存在地区公共产品供给不足的困境,并明显地制约了其地区合作进程的发展。东盟要想实现《东盟宪章》提出的目标,在共同体建设中加强合作,推进地区认同和制度化建设,从而增加地区公共产品的供给,缓解供给不足的困境是东盟的必然选择。     

试论证券犯罪的犯罪形态

证券犯罪的犯罪形态,是指在证券犯罪过程中,由于某种原因所呈现出的静止状态．刑法所规定的犯罪形态包括犯罪的预备、来遂、中止与既遂形态。在证券犯罪的过程中,由于我国刑法对大多数构成证券犯罪的行为均要求具备情节严重或者数额巨大或者造成严重后果的才是犯罪．对于这类犯罪．行为首先是违反证券法律法规的行为,一旦实施这样的禁止性行为就会受到相关法律法规所规定的相应的处罚所以．在这类证券犯罪中不应包括犯罪的预备、未遂、中止形态。     

法律行为框架中的股东表决权制度

表决权虽名为权利,但在资本多数决的股东大会决议机制下却分化为意思表达权和形成权两种性质各异的权利,而其原因在于股东大会决议行为的特殊法律行为属性和特殊法律效力,在于股东表决的不同性质——意思通知和单方法律行为,并由此导致对一系列关乎股东表决权制度的重新评价和审视,如表决权排除、类别股东表决、异议股东股份购买请求权以及资本多数决的决议机制等。     

对刑法中原因自由行为的"视角性"研究

我国的刑事法律缺乏对"原因自由行为"这一重要理论的研究和运用,这不利于我国刑事法制的完善.因此,在对"原因自由行为"所针对情形之可罚性理论的历史演变进行阐释的基础上,借鉴大陆法系的"原因中自由的行为"这一法理,并对客观主义三种学说进行比较分析,以"归责原则视角 犯罪论体系视角 结构性视角"这一综合性视角来研究"原因自由行为"的观点,原因自由行为的相关理念可以为解决醉酒犯罪提供理论支撑.

在社会转型初期，自由市场逻辑主导下的社会变革激发了社会活力，释放出了巨大能量，但也因利益在社会成员中的不均衡分布而产生对经济发展公平性的质疑。伴随市场力量的不断强大，社会自我保护力不断增强，使得社会矛盾呈愈演愈烈之势。在世界社会治理机制由一元向多元转变的趋势下，中国也开启了社会治理机制的变革之路，其核心议题在于建构何种国家、市场与社会力量的分配格局。这对于深化中国社会转型进程，实现社会稳定有序，奠定社会管理的社会基础具有十分重要的意义。然而，如何进行社会建设，不能给出简单的、想当然的结论，而需要挖掘其背后的支配逻辑——双向运动，以此重塑国家、市场与社会三者之间的关系。
