外国行政指导法律控制探析——兼论对完善我国行政指导制度的借鉴

行政指导是各发达市场经济国家普遍采用的一种新型行政管理方式。本文分析了我国行政指导在运用中出现的弊病,并借鉴国外成果和本国实际就对行政指导的法律控制提出一些粗浅的看法。     

论案例指导制度的法律定位

将案例指导制度定位为法律适用机制，就是意图在现行的司法体制框架里，通过指导性案例具体化、细化法律原则，使其可以像法律规范（规则）那样可以发挥裁判准则、行为规则以及（裁判结论的）评价准则的功能，以恰当、公正地处理纠纷。但这一定位没有看到以成文的制定法为核心，根据依法裁判原理构建起来的现行司法制度、诉讼程序制度的特点，没有看到指导性案例法律效力的特点，以及依法律规则裁判与依指导性案例（法律原则）裁判所要求的不同的裁判方式和运行条件，从而极有可能忽视相应的司法程序制度建设。     

Marxist Philosophy vs. International Relations Research in China

This article argues for the confirmation of Marxist philosophy as the ideology that guides international relations （IR） studies in China. Justification comes through the following points. According to Marxism, correct theoretical guidance serves as the prerequisite for correct practice. Marxist philosophy embodies, by nature, righteousness, in opposition to political hegemony. Accordingly, practice under its guidance represents fruitful revolutionary realism. Finally, advanced studies of international relations in this country cannot be separated from philosophical thinking. Using these arguments as background, this article specifically advocates materialism, patriotism, and service to the people as the corner-stone of China＇s IR theory building.

在我国经济转型进程中,政府对于创新的功能边界究竟在哪里？随着自主创新战略的确立和实施,政府和企业的功能地位界定问题显得尤为重要。自主创新内在的禀赋特征致使创新的市场失灵和系统失灵,政府对于自主创新的功能边界介于创新和市场之间：发挥对创新的政策引导作用,而非主体作用;政府对于自主创新的宏观调控标志在于,为自主创新完善国家创新体系;政府对于推进自主创新的引导作用表现在,为自主创新优化政策生态环境,营造有利于自主创新的社会文化氛围和完善并实施政府采购制度等。     

Justice in a non-ideal world: the case of climate change

Ideal theory faces a paradox. The ‘capacity of guidance’ is an important feature of most normative theories, but ideal principles of justice are not well suited to guide action in non-ideal circumstances. This charge presses us to seek plausible avenues to connect ideal values with the non-ideal realisation of justice. The objective of this paper is to introduce an analytical framework and present a case study in support of what I call the ‘reflective integration thesis’. The thesis states that: if we wish to formulate principles of justice that can guide action in non-ideal circumstances, we need to integrate ideal and non-ideal theory, and the way to integrate ideal and non-ideal theory is by seeking reflective equilibrium between these levels. Taking climate justice as a model, this paper will explore the features of a non-ideal theory of justice, thereby providing insights about the structure of an action-guiding theory. It will show that, in order to guide action, our ideal principles of climate justice need to be reformulated in the light of real-world considerations, which we only obtain by integrating the relevant empirical work on the matter.

行政指导在法国二战后得到广泛应用,对法国的经济和社会发展起到积极的促进作用.本文通过对法国行政指导产生背景的研究,探讨了行政指导所具有的制度特征,在对行政计划和农业行政指导进行实证考察的基础上,对法国行政指导的制度进行了全面评价,并进而得出结论行政指导是一种弹性的、能够广泛适应社会现代化、民主化发展的有效行政方式,值得引起我国理论界和实务界的高度重视.
