被害人作为刑事诉讼的当事人,如何在量刑改革中更好地维护其合法权益是维护被害人主体地位的体现,而如何确保被害人适度有效地参与量刑程序更是在量刑改革中维护被害人权益的重中之重。被害人有权独立参与量刑程序,而有效参与依赖于量刑建议与量刑诉讼证明的规范。     

论普洱地区边防执法形势及对策

随着改革的不断深化,因企业改制、拆迁安置、林权改革等引发的各种各样的人民内部矛盾不断增多,影响边防边区稳定的因素也相应增多。同时,普洱边境地区走私、贩卖、运输毒品犯罪亦呈上升态势．打击毒品犯罪面临一系列的新问题和新困难,这给边防执法工作带来了新的挑战。要应对新的复杂的形势和任务,必须通过创新法治理念、健全执法制度、打牢执法基础、推动执法规范化建设等措施．来进一步增强公安边防部队的履职能力。     

The Australian Public Service and Policy Advising: Meeting the Challenges of 21st Century Governance

This concluding article summarises the case study findings comprising the Special Issue on ‘Advising Australian Federal Governments: Assessing the Evolving Capacity and Role of the Australian Public Service’, identifies and discusses cross‐cutting issues, and considers strategic implications for future practice and research. It reviews key findings from six case studies – Treasury, Prime Minister and Cabinet, Intergovernmental Relations, Housing, the BER Stimulus program, and Defence – and assesses the policy advising capacity of the Australian Public Service, with a focus on the policy‐political interface between governments and officials. Putting recent experience in historical context, it considers the performance of the Commonwealth's policy advisory system, the impact of prime ministers and centralisation, the link between advising and analytic capacities, the system's resilience and readiness, whether recent dissatisfaction over APS advising reflect lack of capacity or a culture clash, and the responsibility for ensuring high‐quality policy advice. It recommends developing a more systematic approach to assessing policy advising capability, building on recent APS reforms.     

广州地区农民工政治信任状况的实证研究

我国农民工的数量极其庞大,广州地区是我国农民工重要的集散地。广州地区农民工的政治信任呈现出三大特点：政治信任的水平与信任客体的层级正相关、政治信任的认知基础比较模糊和新生代农民工的政治信任度较低。这一状况容易导致广州地区农民工群体性事件的发生,为此,我们需要采取以下措施来提升其政治信任度：提高农民工的工资水平,拓宽农民工的政治参与渠道,加强对农民工信任网络的整合,发挥电子媒介的政治传播功能。     

《刑事诉讼法修正案（草案）》之检视与建言

《刑事诉讼法修正案（草案）》在翘首企盼中露出水面。纵观全文，此次刑事诉讼法修正草案在证据制度、强制措施、辩护制度、侦查措施、审判制度、执行制度、特别程序等七个方面做出了可以预期的巨大进步。但是总体上与人民群众和法学界的期待尚有差距，如在刑事司法原则、程序性制裁等方面还有与现代法治要求和我国社会发展不相符合的地方。针对此草案，仅就存在的几个主要的问题提出建言。     

关于警察出庭作证问题的调查分析

警察出庭作证是刑事诉讼改革中的重要问题。调查显示,造成警察不出庭的原因在于观念的误区、诉讼结构不合理、证据规则的缺失等。建立我国的警察出庭作证制度不仅必要,而且可行。可从克服立法和观念上的困难入手,调整诉讼结构,完善证据规则,构建配套措施。     

论中国赠答诗发展成熟的轨迹

赠答诗是一种很重要的诗体。自它产生之日起,后世文人鲜有不作赠答诗者。赠答诗的发展由“赠言”发轫,经过不关个人性情的赋诗阶段,后由无“赠答”之名到以“赠答”名篇,由礼尚往来的应酬对答到抒写个人性情,表现人际的真情往来,再到两汉文坛出现完整的赠答诗以及千古传唱的优秀作品,本文为赠答诗描述了一个较为清晰的发展轨迹。     

Surety Wives in the House of Lords: Time forSolicitors to `Get Real'?Royal Bank of Scotland plc v. Etridge (No. 2) [2001] 4 All E.R. 449

This note considers the recent House of Lordsdecision in Royal Bank of Scotland plc. v.Etridge (No. 2). It concerns the familiarscenario of a wife jointly mortgaging (orproviding a guarantee for a mortgage of) thefamily home in order to secure financialsupport for a business run by her husband. Ina landmark judgement, Lord Nicholls set out newand specific procedures to be followed bylenders and solicitors who are providingindependent advice, in order to counter anyargument by the wife that the charge should beset aside because her signature on the lender'scharge has been obtained by the undue influenceof her husband. This note considers the impactof the decision upon the parties involved insuch transactions. Special consideration isgiven to the surety wife and her chances ofdefending possession proceedings brought bylenders in the post Etridge era.     

惩治战争罪的国内军事立法问题研究

研究战争罪国内立法的理论与实践问题,对帮助国家领导者的正确决策,履行国家的国际承诺,震撼潜在的危及和平的争端和情势等方面具有不可低估的作用。惩治战争罪有国际惩治和国内惩治两种模式。适用国内惩治战争罪是我国相当时期内的现实选择。我国目前有关战争罪国内惩治的法律规定尚存在缺陷之处,需要从立法上予以补充和完善。     

Ideological mavericks or party herd? The effect of candidates’ ideological positions on intra-party success

Political candidates' ideological positions have been used to explain success in inter-party competition, but little is known about how they impact success in intra-party competition. Here, candidates' positions on the Left–Right and GAL–TAN dimensions are analysed in three Finnish parliamentary elections (2011, 2015, 2019). Candidates' ideological positions are measured in terms of their ideological distance from their own party's median candidate. Absolute ideological distances between candidates and their party's median candidate decrease candidates' preference votes. Furthermore, the effects are contingent on the general ideological position of the candidate's party. However, these interactions do not follow any clear pattern, as more rightist candidates in right-wing parties and more green-alternative-libertarian candidates in traditional-authoritarian-nationalist parties all experience a decrease in their preference votes. This effect is large enough to be a decisive factor in intra-party competition between the last candidate that was elected and the first one that was not.
