放翁原具自家真--浅谈陆游词的内容特色

陆游"六十年间万首诗",而词的数量却很少,今仅存144首.在这些为数不多的词作中,篇篇发自肺腑,首首凝聚衷情:直抒爱国情怀、修仙学道、艳情婚姻,表现隐逸情趣,表达生活感受等内容,应有尽有,可谓思想丰富,题材广泛,情真意切,感人至深.

This essay attempts to defend the centrality of emotions in our sense of justice and the importance of empirical research into the emotions in the development of philosophical theories of justice. It includes a defense of the negative emotions as well as a preliminary taxonomy of the emotions involved in justice.

本文从心理学的角度探讨了人力资源开发的问题，认为，人的能力是一种重要的开发对象，情绪既是开发的对象又是开发的手段、自我概念的成长则是开发的目标和最高境界，它是个体保持持久的上进心的内在动力，要发挥人力资源效率，应将人力资源开发的各个环节与能力挂钩，科学地设置能力与责任利的关系，激发人的潜能，改善人的情绪智力，促进人的自我成长。     

Bringing Soul to International Negotiation

In this article, the author calls for a shift in training for international commercial negotiation, away from the standard Western linear, rational, fact-oriented style toward training that makes room for "soul." As used here, the term "soul" combines several concepts that integrate learning on human cognition, cultural intelligence, and effectiveness in international management. The article discusses soul in terms of three components: emotion and subjectivity, deep narratives rooted in faith and ethnic traditions, and cultural intelligence. The article presents three negotiation scenarios from around the globe, contrasting first-generation training approaches to next-generation training approaches that would value the unconscious processes of decision making.     

The affective burden of separated mothers in PA(S) inflected custody law systems: a New Zealand case study

ABSTRACT

Custody law systems across the Anglo-West are increasingly characterised by the overt and covert use of parental alienation (syndrome) as an aid to the governance of post-separation mothers. Difficulties with care arrangements within PA(S) inflected custody law systems are often regarded as evidence of mothers’ alienating behaviours, resulting in a range of remedial, coercive and punitive censures, including losing resident parent status. I argue here that the synergistic interaction between custody law and PA(S) creates an affective burden for post-separation mothers. Drawing on the voices of mothers in contested custody cases, I show that their affective burden consists of negative emotional states for themselves and their children, emotion work in relation to these states, and court required emotion work in support of father-child relationships. The latter mitigates the risk of being found to be an alienator and losing what matters most to them – their children.

Arts Marketing Performance: An Artistic-Mission-Led Approach to Evaluation

Marketing in the arts sector has evolved during the past decades from a functional tool to a business philosophy. At the same time, a relational view of art as experience has emerged in contemporary arts philosophy, highlighting the role of arts consumers in the creation and reception of arts. As a consequence, arts consumers have gained a central position within the artistic mission of arts organizations, posing new challenges to the role of arts marketing both as a practice and as an academic discipline. Against this background, financial figures and audience numbers are insufficient indicators of the contribution that arts marketing makes to the functioning of arts organizations. This article suggests evaluating the performance of arts marketing based on the contribution made to the achievement of the arts organization's artistic mission and proposes a model based on Kaplan and Norton's Balanced Scorecard to guide the artistic-mission-led evaluation of arts marketing performance. By paying attention to the new strategic role of arts marketing within the emerging relational view of the arts and by integrating recent literature on performance management in nonprofit organizations, we make a theoretical contribution to the body of knowledge on arts marketing performance evaluation.     

Feeling guilty to remain innocent: the moderating effect of sex on guilt responses to rule-violating behavior in adolescent legal socialization

Legal socialization researchers have ignored the role of emotions such as guilt to explain rule-violating behavior (RVB). The purpose of Study 1 was to determine if anticipated guilt or guilt proneness was a better predictor of RVB. Participants were 325 university students who completed an online questionnaire. Correlations indicated that both measures were related significantly to RVB; however, when both were entered into a multiple regression as predictors, only anticipated guilt was significant. This suggested that anticipated guilt was a stronger predictor of RVB than guilt proneness. The purpose of Study 2 was to investigate the effects of anticipated guilt on future RVB while controlling for the integrated legal socialization variables. Participants were 283 middle school and 187 high school students. Multiple regression analyses were conducted to predict students' future engagement in RVB. Anticipated guilt predicted RVB for middle school and high school students. However, sex moderated these effects. Male students low in anticipated guilt committed more RVBs than male students high in guilt. Female high school students showed a similar effect but not at the same magnitude as the male students. Guilt had no significant effect on RVB for female middle school students. Implications for the findings are discussed.     

感情法益:谱系考察、方法论审视及本土化检验

感情法益自19世纪末的谱系演变表明,援用哲学、心理学的既有成果尝试定义感情,或立足于法益论的基本立场预设可被保护的感情类别,并非妥当的方法论路径。基于感情背后是否存有可回溯至宪法的基本权利这一立场转换,"不真正/真正感情保护犯"的二元筛查架构当为可行的思路。据此,"何种感情值得刑法保护"不应是一个预先判断的命题,感情应为个人或社会法益亦非是一个前置性论断。死者虔敬感这一既往被认为具有社会属性的感情法益可被证伪,其实质在于公民生前人格权的辐射保护;英雄烈士所承载的社会集体感情虽为共同价值观之表征,但在我国刑法第299条之一中仅作为依附于逝者人格权的罪责增量。安全感法益本身亦与社会秩序无涉,而是经公民的意思形成自由之受益权功能最终到达国家保护义务。     

人性丑恶张显中被抛弃的艺术良知

艺术良知担当着艺术的精神，艺术精神体现出艺术良知。自20世纪90年代以来市场引领下的市场文学，大多是没有任何精神内涵和精神原型支柱的世俗文学，作家们一个个争先恐后地投身子世俗经济的大潮，以金钱的标准来取代文学的精神标准，制作着大量的迎合大众口味的文字。这便是金钱崇拜和肉欲崇拜的人性丑恶的张显。文学在失去精神内涵的同时是作家对艺术良知的抛弃。
