A study in contrasts

In this personal view of a 'second generation' psychoanalyst in Vienna, private life events are counterposed to political and social developments in Austria over the last twenty-five years, leading up to the phenomenon of Jörg Haider and the recent formation of the new Austrian government including his Freedom Party (FPÖ). In particular, de Mendelssohn discusses the resurgence of openly antisemitic utterances and racist electoral platforms, both against the larger background of historical precedents and against the smaller one of a psychoanalytic study group set up to enquire into the unconscious motives and fantasies involved in this resurgence. Although the emergence of public prejudice is an alarming sign, de Mendelssohn points to mitigating factors. On the one hand there is the possibility of seeing Austria as a 'test case' for similar, often more actively violent eruptions in other European countries, one in which coping strategies may be developed while there is still time. Here he sees the EU sanctions against Austria as fully justified. On the other hand there is an active and younger generation and a solid history of civil protest that may help strengthen Austria's rather weak democratic traditions. As an analogue to Freud's individual psychoanalysis, in which the 'return of the repressed' is seen as a painful experience but necessary for insight and growth, the resurgence of quasi-racist politics in Austria may be seen as a necessary result of long years of being more or less taboo, with the hope that there can be a 'working through' of inter-generational dislocation and social amnesia.     

追踪与研判:《南海行为准则》制定问题的研究动向

本文梳理了近年来国内外学者关于《南海行为准则》制定问题的最新研究成果,试图在一定程度上展现学界对准则问题的基本认知,以期为相关部门和国内学界开展进一步的对策研究提供有益借鉴。在行为准则制定工作久拖不决的情况下,部分学者倡议的先行尝试制定岛屿规则、专属经济区行为规则等"准则单行本"或绕开《联合国海洋法公约》而另行创制《南中国海海洋法公约》等新观点尤其值得国内重视和研究。     

论所有人抵押权——基于对德国法和瑞士法的分析

所有人抵押权是所有人于自己的财产上存在的抵押权,它是近现代私法上的一项特殊制度。其中,德国法对此制度于较大范围内予以认可,规定了三种类型的所有人抵押权形态,并就每种形态的所有人抵押权的发生事由定有明文。瑞士法在所有人抵押权制度上更加严格地贯彻了顺位固定规则。要理解所有人抵押权的法律构成,有必要厘清其与顺位固定、顺位保留、抵押权的附随性(附从性)、对自己之物的权利及混同之间的关系。我国现行法制仅于混同的例外情形认可所有人抵押权的立场应予变更。为有利于我国不动产信用关系与金融资本信用关系的发展,我国应在较大范围内认可所有人抵押权,摒弃抵押权的不可分性规则,改采顺位固定规则。     

中国大陆台湾研究的现状与趋势——基于1991-2013年国家社科基金台湾研究立项项目的量化分析

本研究力图通过对1991—2013年国家社科基金台湾研究项目进行统计分析，从立项数量、学科分布、研究主题、立项机构和地域分布等方面对中国大陆现阶段台湾研究现状加以讨论，揭示出相关项目的表面特征及走势，项目内容的变化与发展情况，力图使研究者对台湾研究的未来发展趋向有更加准确的了解。     

异常点分析法在案件侦查中的应用研究

异常点是统计学领域中的一个重要术语,是与其他数据有着显著不同的数据点。同样,在案件侦查过程中也有这样的异常点,因此将异常点分析法引入案件侦查工作中,通过比对、分析案件相关数据,发现异常点,能为侦查案件提供方向,提高侦查案件的效率。     

Out of sight,but not out of mind: Traces of nearby devices' wireless transmissions in volatile memory

An IEEE 802.11 wireless device can leave traces of its presence in the volatile memories of nearby wireless devices. While the devices need to be in radio range of each other for this to happen, they do not need to be connected to the same network—or to any network at all. Traces appear in the form of full wire-type frames; a residue of the signals in the ether. We examine types of information that can be extracted from such residual frames and explore the conditions under which traces develop and persist. Their availability is determined by factors in both in the external environment (the types of signals in the ether) and the internal environment (the configuration and particulars of a device's wifi stack). To isolate some of these factors, we have created memory dumps of devices in various environments and configurations. Analysis of the dumps has offered insights into the conditions determining creation and decay of the traces. The results indicate that they will be available in a limited number of real-world scenarios. We conclude with practical advice on triaging and preservation.

论规范分析方法的核心要义——基于法学的视域

作为法学特有方法的规范分析方法并未得到"认真对待",学界对该方法的本体存在着"融合论"、"规范论"和"逻辑思维论"的学说分歧。为有利于该方法在法学研究中的运用,确立如下要义对该方法而言是必要的:规范分析方法的作用对象是一国现行有效的法规范整体(即实在法体系),其秉持"价值中立"的价值立场,是逻辑分析、语言分析等方法所构成的方法体系。     

行为分析法在《思想道德修养与法律基础》课教学中的应用

具有法律意义的行为,都存在合法与非法、善与恶的涵义,都有其思想根源。在大学生德育教学中,通过对具体行为的合法性、善恶、思想根源三个层次的分析,既能加深对思想、道德、法律三者联系的认识,又能加深对具体行为的立体认识,更有针对性地校正自身行为。
