依据痕迹学的理论基础,若把血液看作造痕体,则血迹形态便是造痕体在不同力的作用下在不同承痕体上的形态反映.解释血迹形态的根本属性,将血迹形态分析归纳为力的分析,可为血迹形态分析走向规范指明方向.     

A blind trial evaluation of a crime scene methodology for deducing impact velocity and droplet size from circular bloodstains

In a previous study, mechanical engineering models were utilized to deduce impact velocity and droplet volume of circular bloodstains by measuring stain diameter and counting spines radiating from their outer edge. A blind trial study was subsequently undertaken to evaluate the accuracy of this technique, using an applied, crime scene methodology. Calculations from bloodstains produced on paper, drywall, and wood were used to derive surface-specific equations to predict 39 unknown mock crime scene bloodstains created over a range of impact velocities (2.2-5.7 m/sec) and droplet volumes (12-45 microL). Strong correlations were found between expected and observed results, with correlation coefficients ranging between 0.83 and 0.99. The 95% confidence limit associated with predictions of impact velocity and droplet volume was calculated for paper (0.28 m/sec, 1.7 microL), drywall (0.37 m/sec, 1.7 microL), and wood (0.65 m/sec, 5.2 microL).     

Predicting the position of the source of blood stains for angled impacts

Droplets of pig's blood were dropped onto paper at different angles to the horizontal to produce blood stains. Impact velocities varied from 1.82 to 5.76 m/sec, drop size from 3.7 to 5.0 mm in diameter, and the surface sloped at angles between 22.7 degrees and 90 degrees to the horizontal. From the data a single equation relating stain size to drop size and velocity for all impact angles was produced; ab = 111.74 (Re(1/2)We(1/4))(0.75)D(o)D(o) + 0.00084 with R(2) = 0.88, where a is the stain width, b the stain length, Re the Reynolds number, and We the Weber number. A second equation related the number of spines, N, to drop size, velocity, and surface slope for all impact angles as N = 0.76 We(0.5) sin(3)theta with R(2) = 0.9, where theta is the impact angle. Combining these equations the impact velocity can be determined and hence the position of the stain's source.

：菲律宾知识产权刑事立法采用混合型模式,有利于调节刑法典的稳定性与其对频繁变动的社会关系的适应性;罪名体系比较完整;原则上任何故意侵犯知识产权行为都构成犯罪,仅将犯罪目的作为个别侵犯知识产权犯罪的主观要素,并且该目的要素并非唯一的选项,相对而言比中国著作权犯罪“以营利为目的”的规定要宽松;行为方式可谓形式多样、种类丰富,而中国侵犯知识产权犯罪的行为方式则比较狭窄;虽然都规定了一定的刑事门槛,但中国规定的“违法所得数额”等情节设置不科学,不利于司法认定;两国侵犯知识产权犯罪的刑罚设置以短期自由刑为主,并设立罚金刑,有利于该类犯罪的惩治与预防,但在罚金数额的设定上,都需要借鉴限额罚金制与倍比罚金制相结合的方式。

The Use of Forensic Tests to Distinguish Blowfly Artifacts from Human Blood,Semen, and Saliva

This study investigated whether routinely used forensic tests can distinguish 3‐day‐old or 2‐week‐old fly artifacts, produced after feeding on human blood, semen, or saliva, from the biological fluid. Hemastix^®, Hemident^?, and Hemascein^? were unable to distinguish blood from artifacts. Hemastix^® returned false positives from negative controls. ABAcard^® Hematrace^® and Hexagon OBTI could distinguish blood from 3‐day‐old artifacts, but not 2‐week‐old artifacts. Phadebas^® and SALIgAE^® were unable to distinguish saliva from artifacts. RSID^?‐Saliva was able to distinguish saliva from 3‐day‐old artifacts, but not 2‐week‐old artifacts. Semen tests Seminal Acid Phosphatase, RSID^?‐Semen, and ABAcard^® p30 were all able to distinguish semen from 3‐day‐old artifacts, but not 2‐week‐old artifacts. The tests investigated cannot be relied upon to distinguish artifacts from biological fluids. However, if an artifact is identified by its morphology, a positive result may indicate which biological fluid the fly consumed, and this knowledge may prove useful for investigators searching for DNA.

政府治理模式变迁：理论范式和实践绩效

自工业社会以来,从政府结构和治理方式选择的角度,大致可以把政府的治理模式划分为两种,一种是传统的政府治理模式,另一种是最近20余年新兴起的政府治理模式。有关传统的政府治理模式的研究,已经形成了具有共识性的理论解释,但对于新的政府治理模式,则出现了不同的解释范式,而在实践中,新的政府治理模式也在试行之中。

经过对相关国家财政分权实践的考察,可以概括出财政分权的制度模式主要有两种,即对称型和非对称型。在当代社会经济发展呈现复杂化的现实背景下,两种制度模式存在融合趋势。基于特定的政治文化和国家体制等方面的原因,中国应该选择非对称型作为未来财政分权的制度模式。
