论我国死刑制度立法理念及其完善

本文首先介绍了死刑制度及其历史沿革,通过死刑存废之争,以及各国立法例的探讨及法律发展,指出中国现阶段不宜废除死刑,但应通过立法、司法等限制,严格控制死刑的适用范围,并对中国刑事法的发展提出立法预测———中国刑事法人道化。

在公路建设资金贷款实践中,最常见的担保方式是公路收费权质押.拟建或在建公路收费权是种期待权,用此项权利作为质押标的向银行申请贷款,出质人是以省级人民政府批准建设收费公路并同意建成后收费的批件为收费公路建设资金的贷款进行质押担保.在价值范围内,公路收费权可以多次质押.公路收费权质押合同由省级交通主管部门进行登记,自登记之日起生效.     

马克思的虚拟资本理论与我国资本市场的健康发展

马克思关于资本主义和社会主义经济发展的理论,在我国资本市场的发展中是值得借鉴和发展的,没有价值的虚拟资本在资本主义国家发展中起到了至关重要的作用。在我国现阶段随着有价证券、期货等虚拟资本的出现,金融市场出现前所未有的繁荣,但是由于市场规则滞后,这种繁荣的背后隐藏着许多不规范,因此带来了很多风险漏洞,因此我们需要研究马克思关于资本主义的发展和虚拟资本在资本主义阶段成败的经验,以便为社会主义市场经济的健康发展寻找一个正确的方向,保证我国资本市场健康稳步的发展。     

当前我国有限责任公司发展对法定资本制的依赖

我国目前正处于转型期,社会信用短缺。在此情境下,若法定资本制缺位,则由于其具有使投资者以有限责任公司为交易欺诈工具的诱因,故极可能导致有限公司整体信用趋劣。倘如此,则其潜在交易者的交易热情会因其对前者所产生的预期利益减少而下挫,这无疑将制约前者的发展;而若法定资本制严格施行,则能使上述情形得到相当改观。这凸显出当前我国有限公司的发展对法定资本制的依赖。因此,宜对其加以完善而不是以授权资本制或折衷资本制取而代之。     

Network Politics,Political Capital,and Democracy

Abstract

Is network politics a good or a bad thing for democracy? Seen from a narrow perspective of democracy the answer is clear. It is a bad thing. However, seen from broader perpsective the answer is more complex since it does not only focus on the preservation of representative democracy but also on the promotion of organizational democracy in civil society and on the enhancement of the citizens' political capital, that is their endowment, empowerment and political identity. The complexity of the relationship between democracy and network politics is apparent in a case study of political decision making in Skanderborg, a small town in Denmark.

文章考察了不同类型的投资者（机构、个人）在上市公司募集资金投向变更公告前后的交易特征和行为。结果发现：公司募资投向变更市场反应为负,变更事件显著导致公司未来业绩变差,这说明变更对于绩效的影响是无效率的;机构投资者表现出了显著的信息优势,整体上,机构（及共同基金）的交易行为在更大程度上体现为价值性投资;个人投资者只为机构投资者提供了流动性。研究结果具有明晰的政策含义,即监管机构在严格管控资金用途变更的同时,既要发展机构投资者,又要提升个人投资者教育。     

REVISITING JUVENILE WAIVER: INTEGRATING THE INCAPACITATION EXPERIENCE*

More than 20 years after an expansion of juvenile transfer policies, questions remain regarding the specific deterrent effect of juvenile waiver given the singular focus on the court of jurisdiction and neglect of other critical aspects of the provision, such as the incapacitation experience. Prior research has also not been focused on identifying the mediating mechanisms that produce criminogenic, null, or deterrent effects. We use data from the Pathways to Desistance Study, propensity score methodology, and mediational analyses to examine how and why the waiver‐incapacitation experience is related to recidivism rates during emerging adulthood. We find that the prior focus on a binary “waiver effect” is potentially misleading as it masks meaningful variation. Furthermore, we find that the path to increased recidivism in emerging adulthood is indirect and we identify stymied educational attainment as a mediator. Our discussion is focused on the criminogenic effects of incapacitation for juveniles and its implications for juvenile transfer research. The discussion also calls for future research to explore treatment heterogeneity further.     

Social capital in Scottish and Danish neighbourhoods: paradoxes of a police–community nexus at the front line

Community-oriented social capital strategies and punitive-oriented policing approaches conflict. Establishing local networking initiatives with community-oriented policing at the centre lends itself to an assets-based policing approach, based on honouring, mobilizing and extending the assets of community members. Scholars argue about the need for comparative research on convergences and divergencies across subcultures on the streets and communities. Based on qualitative data gathered from working class communities in Scotland and Denmark in 2014, the article draws inspiration from community-generated theory of social capital to explore the micro-sociology of experiences and understandings about community–police integration policy initiatives. We use this perspective to argue that the building of positive inter-generational and police–community relationships is the result of social exchanges and officers’ use of what we call ‘constructive investment strategies’. Ironically, our insights from Scotland to Denmark also suggest what appear as positive achievements of community policing may instead intensify residents’ negative perceptions of police officers and organizations. In this way, the article illuminates the tangled and conflicted nature of these embedded symbolic interactions, social capital formations and the latter’s form as a potential positional and ‘tribal’ commodity.     

人力资本与“创造性替代”：假说及检验

提出了一个人力资本的"创造性替代"效应假说.这一假说的基本思想是,在劳动力市场"岗位配给"前提下,人力资本创造性作用的发挥以竞争性替代他人人力资本为中介,这一过程造成了负的外部性.这一假说在理论上对以往的人力资本理论进行了一次合理的综合,在实践上能够解释中国近几年来出现的大学生失业现象,从而具有较强的政策含义.
