Trends in Residential and Community Care for Dependent Children and Youth in Israel:

Policy trends and their underlying ideologies are reviewed for Youth Aliyah, the Ministry of Labor and Social Affairs, and the Ministry of Education and Culture. On this basis, the current status of research and evaluation, differential diagnosis and program assignment, and planning accountability are presented with recommendations for needed policy initiatives.     

House Poor: How a Drive for Stability Led to a Strategic Rethinking of Cultural Institutions’ Relationship to Their Space

While the financial crisis of 2008?2009 represented an unforeseen and momentous obstacle, the key challenges for many cultural organizations remained constant and revolved around making sound strategic decisions regardless of the financial climate. From the standpoints of three prominent cultural leaders, this article addresses factors that directors must consider in guiding their institution forward, such as maintaining a strategic mix of funding and the delicate balance between mission and space. A key binding element among the institutions chosen is that they all underwent a major capital campaign and the construction of a new facility prior to the crisis.

The youth participation movement begins with the basic premise that, without hearing and heeding the voices of those affected by the policies and practices we create, our efforts to improve the systems designed to help them are doomed to failure. This article provides accounts by court‐involved youth and emerging adults of their frustrations and successes and firsthand perspectives on the nature of the challenges confronting them. These interviews, narratives, and poems provide the fundamental context for the incisive and thought‐provoking articles that follow.

2012年刑事诉讼法修改过程中新增的“依法不负刑事责任的精神病人强制医疗程序”具有深刻的立法需要,但这一新增程序的法律规定仍显粗放,一系列解释学问题需要予以分析.强制医疗本身是保安处分性质的预防性措施,强制医疗程序是刑事司法程序且为独立于定罪程序的独立程序.在强制医疗程序实施过程中,迫切需要解释强制医疗的适用条件、临时的保护性约束措施、申请期间与管辖以及执行等方面问题,方可确保法律规定的真正贯彻落实.     

强制医疗理论问题研究

以强制医疗的基础概念"精神病"和"精神障碍"作为逻辑起点,结合理论发展和最新立法规定,提出概念应统一于"精神障碍"。厘清基础概念之后,分别对"强制医疗"和"强制医疗程序"进行了法律分析,明确强制医疗为一种保安处分,强制医疗程序为一种特别诉讼程序,应当具有诉讼化的构造,并对强制医疗程序的必要性进行分析。强制医疗程序作为一种特别程序,其建立具有重要意义:在实体法意义方面,对关于保安处分的研究及立法形成了倒逼;在程序法意义方面,对刑事诉讼目的进行了拓展。     

“瘦肉精事件”引发的法律问题及其解读

"瘦肉精事件"的发生绝非偶然。在一个失却诚信、监管无力、救济渠道不畅的环境中,此类事件过去有过,现在还在发生,更无人敢担保将来不再发生。此类事件已不再是单纯的产品质量问题,它同时在无情地考验着我们的基本社会价值观、我们的政府能力、我们的法律正义。作为一个社会问题,人们可以从多视角审视、评说之,法律上的思考、检讨亦不可少。     

生育政策与出生性别比差异分析

本文把性别选择和生育政策作为影响出生性别比的两个主要因素,通过定量的方式分析了性别选择和生育政策各自对出生性别比偏高的影响。研究表明,第二胎成功性别选择率越高,出生性别比就越偏高,两种生育政策下的出生性别比绝对差值就越大,相对差值较稳定。当性别选择率一定时,出生性别比本身值越高,两种生育政策下的出生性别比绝对差值就越大,相对差值也较稳定。     

我国新型农村合作医疗制度的特点、问题与对策

我国新型农村合作医疗制度在全面推进中存在的主要问题有：农民参合积极性不高；管理体制不健全；“新农合”基金筹资成本大，补偿标准不尽合理，补偿能力有限；医疗监管难度系数较大；立法滞后，政策不过硬；缺乏合理的人才机制；等等。今后，需要从几个方面着手规范与完善：加强管理机构和管理服务能力建设；扩大筹资渠道，建立长效机制；改善与外部的关系，形成良好的互动局面；尽快建立城乡一体的医疗保障制度和管理制度；强化新型农村合作医疗监管，提高管理效率；加快相关立法，确保新型农村医疗保障制度政策的稳定性；加强“新农合”人力资源建设，重视乡镇卫生院人才培养；等等。

在全球老龄化背景下，社区照顾逐渐成为了一种主流的养老模式。中国人口的老龄化与高龄化、家庭照顾功能的弱化使老年人的日常生活照顾问题凸显，发展城市社区照顾已成共识。该文通过对老年人日常生活照顾需求的分析，在简要阐述社区照顾理论与起源的基础上，提出目前中国已具备发展城市社区照顾的基本条件，初步探索出城市社区照顾发展的目标模式。
