目的探讨单亲鉴定及其有关的法律及社会问题. 方法对1998年1月至2002年12月275例单亲鉴定进行回顾分析,对案例的数量、来源、鉴定事由、鉴定结论等作统计分析. 结果单亲鉴定近3年明显增多,占亲子鉴定总数的三成.案例来源以自诉为主,占95.27%.鉴定事由中,怀疑妻子有婚外性关系为主 ,占88.36%.275例单亲鉴定中,排除亲生关系39例,占14.18%.结果表明,非婚生子女只占少数. 结论自诉单亲鉴定存在法律盲区,但在维护家庭稳定具有一定作用.受理单亲鉴定宜取慎重态度,有关的社会及法律问题需要解决.  相似文献

This paper reports the results of four studies that investigate racial profiling as an attribution about police motives. Each study explores, first, the types of police behavior that heighten or lessen the occurrence of profiling attributions and, second, the consequences of such attributions. Results support prior studies in finding that judgments about whether the police are profiling are associated with the level of public support for the police. The studies then extend the analysis of subjective profiling judgments by examining their antecedents. The findings support the procedural justice hypothesis that the fairness with which the police exercise their authority influences whether members of the public view the police as profiling.  相似文献

Survey reports of police stops and driving behavior are a potential methodology for examining the magnitude and prevalence of the “Driving While Black” phenomena. However, estimates of the magnitude or correlates of racial disparity in police stops from self-reported survey data are potentially compromised if the accuracy of self-reports of police stops and driving behavior differ by race. We report on the results of a reverse record check survey in which we directly assess the degree and consequences of differences by race in self-reports of police stops. In our sample of drivers who had been cited for speeding in the preceding year, we found that 77% of the White respondents and 71% of the African American respondents admitted to being stopped. While both groups underreport stops, African Americans do so at a higher rate. This finding is consistent with many past studies which report stronger social desirability effects on survey responses among African Americans. Thus, survey data will tend to underestimate the magnitude of the “Driving While Black” phenomena.

Forensic analysis of bicomponent fibers using infrared chemical imaging   总被引:2,自引:0,他引:2  
The application of infrared chemical imaging to the analysis of bicomponent fibers was evaluated. Eleven nominally bicomponent fibers were examined either side-on or in cross-section. In six of the 11 samples, infrared chemical imaging was able to spatially resolve two spectroscopically distinct regions when the fibers were examined side-on. As well as yielding characteristic infrared spectra of each component, the technique also provided images that clearly illustrated the side-by-side configuration of these components in the fiber. In one case it was possible to prepare and image a cross-section of the fiber, but in general the preparation of fiber cross-sections proved very difficult. In five of the 11 samples, the infrared spectra could be used to identify the overall chemical composition of the fibers, according to a published classification scheme, but the fiber components could not be spatially resolved. Difficulties that are inherent to conventional "single-point" infrared spectroscopy, such as interference fringing and sloping baselines, particularly when analyzing acrylic type fibers, were also encountered in the infrared chemical image analysis of bicomponent fibers. A number of infrared sampling techniques were investigated to overcome these problems, and recommendations for the best sampling technique are given. Chemical imaging results were compared with those obtained using conventional fiber microscopy techniques.  相似文献

The combination of soil's ubiquity and its intrinsic abiotic and biotic information can contribute greatly to the forensic field. Although there are physical and chemical characterization methods of soil comparison for forensic purposes, these require a level of expertise not always encountered in crime laboratories. We hypothesized that soil microbial community profiling could be used to discriminate between soil types by providing biological fingerprints that confer uniqueness. Three of the six Miami-Dade soil types were randomly selected and sampled. We compared the microbial metagenome profiles generated using amplicon length heterogeneity-polymerase chain reaction analysis of the 16S rRNA genes with inductively coupled plasma optical emission spectroscopy analysis of 13 elements (Al, B, Ca, Cu, Fe, K, Mg, Mn, Na, P, S, Si, and Zn) that are commonly encountered in soils. Bray-Curtis similarity index and analysis of similarity were performed on all data to establish differences within sites, among sites, and across two seasons. These data matrices were used to group samples that shared similar community patterns using nonmetric multidimensional scaling analysis. We concluded that while chemical characterization could provide some differentiation between soils, microbial metagenome profiling was better able to discriminate between the soil types and had a high degree of reproducibility, therefore proving to be a potential tool for forensic soil comparisons.  相似文献

Despite the immense popularity of offender profiling as both a topic of fascination for the general public as well as an academic field of study, concerns have been raised about the development of this area of scientific inquiry. The present study provides a preliminary step towards moving the field forward as it reviews the type and quality of studies dealing with offender profiling over the past 31 years. Based on a content analysis of 132 published articles, the review indicates that researchers investigating this phenomenon rarely publish multiple articles, and they are generally reported across many different journals, thereby making knowledge synthesis and knowledge transfer problematic. In addition, the majority of papers published in the area are discussion pieces (e.g., discussing what profiling is, how profiles are constructed, and when profiling is useful), despite the fact that the processes underlying offender profiling are still not well understood. Finally, although peer-reviewed articles exploring this topic have steadily increased, the statistical sophistication of these studies is sorely lacking, with most including no statistics or formal analyses of data. Suggestions for future research and recommendations to streamline efforts in this field are provided based on the results of this review.

Abstract: The chemical profiling of illicit drugs is an important analytical tool to support the work of investigating and law enforcement authorities. In our work, comprehensive two‐dimensional gas chromatography–time‐of‐flight mass spectrometry (GC × GC‐TOFMS) combined with nontargeted, pixel‐based data analysis was adapted for the chemical profiling of 3,4‐methylenedioxymethamphetamine (MDMA). The validity and benefit of this approach was evaluated by analyzing a well‐investigated set of MDMA samples. Samples were prepared according to a harmonized extraction protocol to ensure the comparability of the chemical signatures. The nontargeted approach comprises preprocessing followed by analysis of variances as a fast filter algorithm for selection of a variable subset followed by partial least squares discriminant analysis for reduction to promising marker compounds for discrimination of the samples according to their chemical profile. Forty‐seven potential marker compounds were determined, covering most of the target impurities known from the harmonized one‐dimensional profiling as well as other compounds not previously elucidated.  相似文献

Based on Engel's critique of the outcome test and Persico and Todd's response, the underlying assumptions critical to the outcome test are summarized and discussed. It is argued that many of these assumptions are not met when applied to police search data. The key underlying assumption—the principle of equilibrium—is examined in detail, and several additional concerns are raised. Thereafter, the proper interpretations of outcome test analyses are reiterated, and discussion regarding the types of racial bias demonstrated by these analyses is further explored.  相似文献

The analysis of amino acids present in fingerprints has been studied several times. In this paper, we report a method for the analysis of amino acids using an fluorenylmethyloxycarbonyl chloride‐derivatization for LC separation and MS detection. We have obtained good results with regard to the calibration curves and the limit of detection and LOQ for the target compounds. The extraction of the amino acids from the substrates used proved to be very efficient. Analysis of the derivatized amino acids enabled us to obtain full amino acid profiles for 20 donors. The intervariability is as expected rather large, with serine as the most abundant constituent, and when examining the total profile of the amino acids per donor, a characteristic pattern can be observed. Some amino acids were not detected in some donors, or fell out of the range of the calibration curve, where others showed a surprisingly high amount of material in the deposition analyses. Further investigations will have to address the intravariability of the amino acid profiles of the fingerprints from donors. By the development of the analytical method and the application to the analysis of fingerprints, we were able to gain insight in the variability of the constituents of fingerprints between the donors.  相似文献
