中小企业地位作用的再认识

本文针对现行对中小企业地位作用认识的局限性 ,阐述中小企业在新时期地位作用的突出变化 ,中小企业不仅是现阶段经济结构调整的加速器 ,更是中国改革的实验园区 ,而且每单位资金比大企业能创造出更多的社会财富。     

知识产权的滥用行为与反垄断法的调控

知识产权中的独占权与反垄断法在维持公平的竞争秩序,刺激劳动者和企业的创造性和保护消费者权益上保持着一致性。两者的矛盾和冲突主要体现在知识产权的滥用行为上。我国应同时借鉴发达国家和发展中国家的立法模式,对国际技术转让中滥用知识产权的行为进行法律规制;对国际技术转让中的限制性商业惯例实事求是进行分析比较,对没有实质危害,或利大弊小的,可经国家审批机关批准订入合同;对那些不公平不合理有害的条款,则应坚决抵制。     

Course and Severity of Maternal Depression: Associations with Family Functioning and Child Adjustment

Number of lifetime episodes, duration of current episode, and severity of maternal depression were investigated in relation to family functioning and child adjustment. Participants were the 151 mother–child pairs in the Sequenced Treatment Alternatives to Relieve Depression (STAR*D) child multi-site study. Mothers were diagnosed with Major Depressive Disorder; children (80 males and 71 females) ranged in age from 7 to 17 years. Measures of child adjustment included psychiatric diagnoses, internalizing and externalizing symptoms, and functional impairment. Measures of family functioning included family cohesion, expressiveness, conflict, organization, and household control; parenting measures assessed maternal acceptance and psychological control. Children of mothers with longer current depressive episodes were more likely to have internalizing and externalizing symptoms, with this association being moderated by child gender. Mothers with more lifetime depressive episodes were less likely to use appropriate control in their homes.

国企改革30年的纷争焦点与深化改革的取向

我国国企改革伴随着激烈的理论争论走过了30年。2003年以后,我国新的国资管理体制逐步建立,国企调整改革的取向也发生了明显变化——向关键领域集中,整合重组,做强做大。由于地方国企与央企差异很大,特别是二者的战略地位完全不同,因此,其调整改革取向应当有很大差异。要使地方国企与央企沿着合理的差异化取向调整改革,就应当正确认识和调整国务院国资委的定位、合理确定地方国资委的地位、正确处理地方国资委与国务院国资委的关系。     

见危不救犯罪化之合理性质疑

“见危不救”的含义应当被限定在一个恰当范围内。只有不负特定救助职责或义务的人在能够救助、且救助行为不会给自己或者第三人造成危险的情况下的不予救助行为,才是应该讨论的对象。见危不救应否犯罪化的实质,是一定的道德义务能否成为不作为犯罪的作为义务来源。外国刑法中虽有对“见危不救”科处刑罚的例证,但在我国刑法中设立“见危不救罪”,不仅有道德根基不稳之虞,也违背动用刑法的“不得已”原则,对其科处刑罚不可能有效遏制此类行为的继续发生或蔓延。     

别斯兰反劫持失败的心理因素分析

回顾别斯兰人质事件的惨痛教训,我们发现：注意分散、超限效应、“锚定和调整启发式”心理定势、易激惹等心理因素对事件的发展及处置曾产生过重要的影响。由此,可以看出关注、利用积极的心理效应,避免消极心理效应,是反劫持事件处理过程中避免恶性情境出现的关键所在。     

从美国的外交政策辩论看布什第二任期的政策

在布什第一任期,美国国内对外交政策争论激烈。一方面,辩论双方的一些共同点是有利于布什政策的。另一方面,布什新任期的表现也在注意政策调整以减少批评,特别是争取国际合作。因此,布什目前的政策比较符合美国公众的期待。     

Romantic Relational Aggression: What about Gender?

This study examined the relations among romantic relational aggression, social anxiety, loneliness, depressive symptoms, and alcohol and drug use in a sample of 215 undergraduate college students. Consistent with prior work, no gender differences were found in the experience of romantic relational aggression. Results indicated that romantic relational aggression was positively associated with social anxiety (for women only), loneliness, depressive symptoms, and alcohol use and drug use. Implications of these findings for the role of aggression within the context of intimate relationships during college are discussed.

Incremental Validity of the Psychological Inventory of Criminal Thinking Styles and Psychopathy Checklist: Screening Version in Predicting Disciplinary Outcome

A group of 136 male inmates housed in a medium security federal correctional institution were followed for a period of 24 months for evidence of disciplinary infractions (incident reports) after completing the Psychological Inventory of Criminal Thinking Styles (PICTS) and being scored on the Psychopathy Checklist: Screening Version (PCL:SV). Age, prior incident reports, the PICTS General Criminal Thinking (GCT) score, and the PCL:SV total score were included in a series of negative binomial regressions and Receiver Operating Characteristic (ROC) analyses of three increasingly more serious outcomes: total incident reports, major incident reports, and aggressive incident reports. Results indicated that the PICTS GCT score and PCL:SV total score were incrementally valid predictors of all three outcomes, with the strongest effects occurring when more severe incident reports were predicted. On the other hand, only the PICTS GCT score and Proactive Criminal Thinking (P) scale produced more than one significant ROC finding.
