The Strasbourg Court and Indirect Race Discrimination: Going Beyond the Education Domain

Prohibiting indirect discrimination has been hailed as guaranteeing substantive equality by addressing issues of structural discrimination and inequalities in a way that direct discrimination cannot and will not. However, Article 14, the ECHR's non‐discrimination provision, does not distinguish between direct and indirect discrimination. Only in 2007 the European Court of Human Rights explicitly included the notion of indirect (race) discrimination under Article 14 in DH and Others v Czech Republic, its famous judgment on Roma education segregation. Since then it has applied the prohibition of indirect race discrimination in a limited manner to similar education cases. However, in its recent Grand Chamber decision, Biao v Denmark, the Strasbourg Court started clarifying some unsolved issues in the distinction between direct and indirect discrimination in its case law and finally applied the concept to the much broader area of immigration and citizenship.     

The Future of Irish-UK Relations: Borders and Identities after Brexit: Introduction

It is apparent that the consociational framework established by the Belfast/Good Friday Agreement (B/GFA) is under threat, while the UK's withdrawal from the EU poses major challenges for maintaining peace, prosperity and social cohesion in Northern Ireland (NI). The contributions to this special collection examine key elements of the post-Brexit reality, with a particular focus on NI and the future of the intergovernmental bodies established by the B/GFA. The implications of the UK government's attempt unilaterally to disapply parts of the Protocol on Ireland/Northern Ireland are examined.     

Diversifying British Political History

This article explores what the diversification of British political history might look like. Building on an expanded definition of citizenship and attention to ‘ordinary’ politics, it suggests several questions which might diversify political history's content and approach. Whom do we count as political actors? Who has access to democratic processes and where does politics happen beyond these processes? To what forms of political thought do we attend? Drawing on examples from my own research on refugees and asylum seekers in modern Britain, and on the wider field of modern British history, I demonstrate the possibilities of diversification as a way to enliven political history's future.     

Citizenship policies and ideas of nationhood in Scandinavia

This article analyzes the recent changes in naturalization policies in three Nordic countries, Norway, Denmark and Sweden. Considering the homogeneity of the region in terms of culture, social structure and polity, the discrepancy in current citizenship regulation is remarkable. Similar problem definitions have generated diametrical opposite solutions. This is even more striking as the three countries, hailing on perceived ideas of common interests and various experiences of shared rule in different political constellations for the best part of the last 500 years, also cooperated closely in forging their national citizenship legislation from the 1880s up till 1979. The article gives perspective to this novel variation, analyzing the interplay between aims and means in the naturalization policies. Basic questions like citizenship rights, the social and cultural cohesion of the nation state, national ideology and questions of identity will be addressed.     

The citizen of empire

In this paper, the authors imagine a Citizen of Empire. This is a conceptualization of global citizenship as it might appear in Hardt and Negri's global social order of Empire. The article draws on Hardt and Negri's Empire as the model of global society to imagine what citizenship might look like on a global scale. Hardt and Negri's conceptualization of Empire offers a palette of new and emerging social relationships from which a vibrant conceptualization of citizen and citizenship can be imagined and new democratic politics practiced. First, the authors examine the concept of Empire to unearth foundational concepts upon which a notion of Citizen of Empire can be built. Second, the authors imagine a citizen who ‘calls Empire into being' rather than participating in the ready-made political, cultural, and economic institutions of the nation-state. Without institutional support, citizenship in Empire must be highly generative and creative, and it will operate on a virtual and poetic terrain by enacting mechanisms of deterritorialization, networking, and communication.     

Legality and (dis)membership: removal of citizenship and the creation of ‘virtual immigrants’ in the 1967 Israeli occupied territories

This article seeks to show that liberal law continues to justify and legitimize displacements of minority populations, even in an age of universal human rights. As demonstrated by the Israeli court's 1988 decision legitimating the deportation of Mubarak Awad, citizenship and immigration laws provide juridical justifications for contemporary ethno-national settler projects. In the aftermath of a territorial conflict that defines or redefines the bounds of the state, native minority populations are vulnerable to being legally recast as ‘aliens’ or ‘virtual immigrants’. National conflict may thus be transformed by legal formalism into a question of immigration law, allowing the power relations that produce state sovereignty to slip into the background.     

Creating the Islamic Republic of Iran: wives and daughters of martyrs,and acts of citizenship

This paper develops a notion of citizenship which accounts for interruptions of, and compliances with, routines in governance. It applies the concept beyond a legal status and electoral practice to decipher how everyday encounters with the state can lead to creative institutional reconfigurations. Focusing on the wives and daughters of martyrs from the Iran–Iraq war (1980–1988), this paper poses ideologically committed contestation and collaborations with national structures of power as acts of citizenship. With particular attention to temporality and constructive uses of memory, this discussion introduces a governing technique created and utilized by women to remake the state as they assert a self-determined citizenry status.     

Impacts of transactional and transformational leaderships upon organizational citizenship behavior

A leader as one of the determiners in organizational direction and objectives must be able to respond to the development. Basically, leadership is a process influencing activity in a group directed toward the achievement of one or several objectives. In the context of empowerment of human resources in order to produce professional employees having high integrity, the presence of a standard is required which can be used as a guideline by the organization in solving the problems. Such guideline is the organizational citizenship behavior which systematically directs the employees to improve their work commitment. And based on the above explanation, it can be formulated whether there is any impact of transactional leadership and transformational leadership upon the organizational citizenship behavior at PT Aneka Putra Santosa. The analytical techniques applied are the multiple linear regression analysis, multiple determination coefficient analysis, and partial determination coefficient analysis. Results of the multiple linear regression analysis indicate that there is a simultaneous impact between transactional leadership and transformational leadership upon the organizational citizenship behavior with the F arithmetical regression value at the sum of 13.620. The magnitude of free variable impact contribution to the bound variable is 33.50%, whereas the remaining is influenced by other variables not being investigated in the model. Partially, the partial contribution of transactional leadership variable to organizational citizenship behavior is 0.233 or 23.30%, whereas contribution of transformational leadership variable to organizational citizenship behavior is 0.272 or 27.20%. Thus, it can be concluded that transformational leadership has more dominant impact in setting up the organizational citizenship behavior.     

Education for nonkilling creativity: a reconstructive–empowering approach

ABSTRACT

Paige (2002) affirmed that a ‘nonkilling society implies a disciplinary shift to nonkilling creativity’. Creativity is indispensable in the search for peaceful alternatives for the positive transformation of conflicts, inherent in human relationships. Creativity can help individuals to think and act peacefully, to find different alternatives to obstacles and problems, to face daily life challenges, and to be happier people. This article presents the Reconstructive–Empowering (REM) approach of peace education as a concrete proposal for implementing a nonkilling paradigm shift in education that facilitates the formation of a critical, active, creative, and peaceful nonkilling citizenship, capable of promoting social transformations toward a killing-free world.     

Disabled Istanbulites’ everyday life experiences as ‘urban citizens’: accessibility and participation in decision-making

This article assesses whether the everyday experiences of disabled Istanbulites can be considered from an urban citizenship perspective. To this end, Lefebvre’s notion of the ‘right to the city’ and its relationship with the literature on urban citizenship and Disability Studies is discussed, and two broad categories of analysis are presented to elaborate the issue in the case of Istanbul. These are, namely accessibility – to space, but also to education, health, and employment – and participation in decision-making. Interviews show that the limited rights-based discourses, which guided the institutional transformation of the greater and district municipalities in the early 2000s, have had almost no impact on the everyday experience of disabled Istanbulites. Istanbul remains a largely disabling city with major problems of accessibility and no room in decision-making processes for disabled people. Unfortunately, current developments do not point to the possibility of a more powerful practice of urban citizenship.
