民事非法证据排除问题初探——兼评《关于民事诉讼证据的若干规定》第68条

对民事非法证据的排除 ,反映了民事诉讼对程序权利和宪法权利问题的关注正日益上升。而民事非法证据排除的具体内容 ,则与一国的诉讼体制和诉讼传统密切相关。作者认为 ,首先 ,为了实现程序公正 ,就要对非法证据予以排除 ;同时 ,为了保证民事诉讼目的的全面实现 ,就应在刚性规定之外 ,给法官提供一定的自由裁量的空间 ;此外 ,为了避免审理法官受非法证据的不当影响 ,应将非法证据排除在庭审之外 ,并对非法证据的证明标准进行明确

通过对几种法人经营范围外行为效力理论的介绍分析,论证相对无效说的现实及理论合理性。对我国现行立法中的相关规定作一评论并对民法典草案的相应完善提出建议,也在此基础上对法人的权利能力、行为能力以及相关登记问题在未来的发展趋势进行探讨。

现行基层人民检察院检察委员会制度存在弊端:检察委员会讨论决定的事项范围不确定;组成人员专业性缺失;程序不规范,但基层检察院检察委员会有其独特功能,不应因此废弃而应予改革完善:强化检察委员会的专业性;规范讨论程序;健全制约和保障机制;完善其他配套制度和措施。     

论环境侵权之公共赔偿救济制度的构建

环境侵权本身的特殊性 ,决定了适用传统普通民事救济制度和国家赔偿救济制度的局限性 ,在普通民事救济乏力和国家赔偿请求无据的情形下 ,启动具有填补功能的公共赔偿救济制度 ,对于完善现有环境侵权救济制度 ,切实保障环境人权 ,无疑具有极为重要的法律意义。     

Explaining community mobilization in the city of Vilnius: a search for social capital

The article explores community mobilization in the urban environment. Specifically, it examines community organizations in Lithuania’s capital city of Vilnius. Engaging with social capital theory, the article illustrates the actual community mobilizations, their stories, collective action strategies, and reasons for mobilizing. It challenges the assumption that mobilizations rarely take place in the urban environment of Lithuania due to low civil society and a nonparticipatory culture. This article shows that when mobilizations do take place, they can be short lived but still achieve significant results.

国家赔偿法自实施多年来 ,赔偿案件少 ,赔偿数额低 ,获赔困难 ,有失当初立法的良好初衷。文章从立法方面对国家赔偿法存在的弊端作了一些探讨。     

Rights and obligations in civil society organizations: learning active citizenship in Turkey

This is a comparative analysis of whether and how participation in different types of civil society organizations (CSOs) enable an environment for the learning of active citizenship practices. Active citizenship is conceptualized and defined around three dimensions: civic action, social cohesion and self-actualization. The potential to transform citizenship practices is critical to the Turkish context where, rooted in its strong state tradition, citizenship has been conceptualized and practiced in a passive manner. CSOs in Turkey have burgeoned over the past two decades and provide an important space to pursue a wide range of interests and provide services. This study is an in depth analysis of participant experiences in six CSOs in Istanbul. The study distinguishes between CSOs based on indicators that are expected to create variation in how the participant is engaged. CSOs are classified as either rights or obligations based, membership or volunteer based, and finally based on their types of activities. This article presents results on the effect of participation in rights vs. obligations-based CSOs on the development of active citizenship practices.     

Black is Beautiful: cuerpos negros en Triunfo

Spaniards and African-Americans share significant cultural memories forged by the profound impact that various artistic and historical events had on each other during the twentieth century. To contribute to an exploration and understanding of these shared memories – which have received relatively little scholarly attention – this essay focuses on the presence of Black America in the 1960s, that is, the period of Late Francoist Spain. More specifically, it intends to initiate the study of the impact of the Black Civil Rights and Black Power movements on Spain’s progressive press. Focusing on a selection of articles published in the iconic leftist magazine Triunfo, it examines how the traditional European fascination with blackness manifests itself during the 1960s. In Triunfo’s articles we encounter suffering, violent, and degraded bodies, as well as revolutionary, political, and eroticized bodies. This combination reveals the problematic coexistence of solidarity and inspiration with an ethnographic and voyeuristic gaze that perpetuates the spectacularity of black bodies for global consumption. While foregrounding the challenges posed by writing and representing the Other, this study is also an attempt to reconstruct more fully the 1960s cultural and intellectual history of Spain and to approach the black liberation struggle from a transnational perspective.     

Whither peacebuilding? A reflection on post-conflict African experiences

Peacebuilding is a key concept in efforts to reconstruct African states emerging from conflicts. At heart, it captures the whole array of activities associated with state-and nation-building in addition to building the foundations for local ownership of these processes. Popularised by the UN Secretary-General Boutros-Boutros Ghali in the early 1990s, peacebuilding has evolved alongside peacemaking and peacekeeping in the reconstruction repertoire. This article suggests that while there is considerable scepticism about the utility of peacebuilding in contemporary conflict resolution efforts, African experiences have, since the 1990s, provided solid lessons to both local and international actors on how to rebuild states, societies, polities, and economies.
