理论界和实践部门对认定非法储存爆炸物罪存在不同观点,文章认为问题的产生与非法储存爆炸物罪的刑法理论研究不足有直接关系。刑法的价值与使命决定,刑法绝不能对不断发生的由于储存爆炸物发生的爆炸事故造成人民群众生命财产损失的情形熟视无睹,而要准确理解非法储存爆炸物罪,必须探析设立本罪的基本价值取向和主要功能诉求。  相似文献

Digitalization has increased the number of video surveillance systems that sometimes capture crime images. Traditional methods of human height estimation use projective geometry. However, sometimes they cannot be used because the video camera surveillance system is not available or has been moved and there are no reference lines on the frame. Scientific studies have developed a new method for human height estimation using 3D laser scanning. This model necessarily requires a series of approximations, which increase the final measurement error. To overcome this problem, in the present study, images of a subject are projected directly on the 3D model, estimating the height of the subject. This article describes the methodological approach adopted through the analysis of a real case study in a controlled environment executed by Carabinieri Forensic Investigation Department (Italy). The aim is to obtain a human anthropometric measure derived from frames extracted from the videos associated with the digital survey of the framed area obtained with 3D laser scanning and point cloud analysis. The result is the height estimation of five subjects filmed by a camera obtained through the combination of 2D images extracted by a DVR/surveillance systems with 3D laser scanning. Results show that most estimated measurements are less than the real measurement of the subject; it also depends on the posture of the subject while walking. Furthermore, results shows the differences between the real height and the estimated height with a statistical approach.  相似文献

Researchers envisioned Storage as a Service (StaaS) as an effective solution to the distributed management of digital data. Cooperative storage cloud forensic is relatively new and is an under‐explored area of research. Using Symform as a case study, we seek to determine the data remnants from the use of cooperative cloud storage services. In particular, we consider both mobile devices and personal computers running various popular operating systems, namely Windows 8.1, Mac OS X Mavericks 10.9.5, Ubuntu 14.04.1 LTS, iOS 7.1.2, and Android KitKat 4.4.4. Potential artefacts recovered during the research include data relating to the installation and uninstallation of the cloud applications, log‐in to and log‐out from Symform account using the client application, file synchronization as well as their time stamp information. This research contributes to an in‐depth understanding of the types of terrestrial artifacts that are likely to remain after the use of cooperative storage cloud on client devices.  相似文献

Digital forensic visualization is an understudied area despite its potential to achieve significant improvements in the efficiency of an investigation, criminal or civil. In this study, a three‐stage forensic data storage and visualization life cycle is presented. The first stage is the decoding of data, which involves preparing both structured and unstructured data for storage. In the storage stage, data are stored within our proposed database schema designed for ensuring data integrity and speed of storage and retrieval. The final stage is the visualization of stored data in a manner that facilitates user interaction. These functionalities are implemented in a proof of concept to demonstrate the utility of the proposed life cycle. The proof of concept demonstrates the utility of the proposed approach for the storage and visualization of digital forensic data.  相似文献

Cloud computing systems provide a new paradigm to the distributed processing of digital data. Digital forensic investigations involving such systems are likely to involve more complex digital evidence acquisition and analysis. Some public cloud computing systems may involve the storage and processing of digital data in different jurisdictions, and some organisations may choose to encrypt their data before it enters the cloud. Both of these factors in conjunction with cloud architectures may make forensic investigation of such systems more complex and time consuming. There are no established digital forensic guidelines that specifically address the investigation of cloud computing systems. 瘢痕鉴定是法医工作中重要的一项任务,对瘢痕的纹理、位置和长度等信息都有着细致的规定和要求。通过三维扫描仪可以便捷地获取点云数据,还原瘢痕区域的具体结构,为瘢痕鉴定提供新的工具。本文基于三维点云数据,提取瘢痕的趋势线,进行瘢痕长度测量。该方案首先对三维瘢痕数据进行投影,在二维平面上提取瘢痕的端点和关键点。然后在三维曲面上通过近邻搜索和向量内积的方法,依次连接所有关键点得到沿瘢痕表面的趋势线,计算瘢痕的长度。本文实验中使用的三维瘢痕点云来自某法医司法鉴定中心的工作内容,通过三维扫描仪提取。在实验数据上的应用结果显示,提取的趋势线在瘢痕表面贴合程度较好,可以跟随曲面进行弯折,可靠性很高。以点为核心的计算方法,在后续测量功能改进中也有较大的空间。  相似文献

刑罚执行完毕的犯罪人回归社会后普遍存在难以融入社会的情况,有就业难、生活难等问题。造成这个问题的原因主要是载明罪行记录的犯罪人刑事档案在社会生产、生活中被广泛运用,相关法律法规对曾经犯过罪的人的权利有所排除和限制,社会观念也对有罪行记录的人心存戒备和歧视。这不但违背宪法理念,而且与刑法的谦抑性原则和公平、正义不相容。前科消灭也不具备现实可操作性,应尝试建立犯罪人刑事档案封存制度。  相似文献
