论我国商业医疗保险中最大诚信原则的适用

目前我国商业医疗保险的发展进入了关键阶段,由于其保险标的的特殊性,决定了最大诚信原则在商业医疗保险中的重要作用,本文就最大诚信原则在商业医疗保险发展中的若干法律问题略抒拙见,以期抛砖引玉。     

Absolute and limited war: The possibility of foreign‐imposed regime change

This paper examines the relationship between foreign imposed regime change and war participation. The oppertunity and willingness of an opponent to impose a new regime on a war participant affects the likelihood that such a change will occur. Results from a logistic regression model suggest that (1) winning or losing the war, (2) the amount of war costs the participant endures, (3) the power of the participant relative to its opponent, (4) the amount of war costs the opponent endures, (5) the occurrence of a domestic regime change during the war, and (6) the difference between the authority structures of the war participant and its opponent all have a significant and sizable impact on the probability that a war participant endures a foreign imposed regime change. The first three variables measure the opponent's opportunity to force a regime change, while the last three measure its willingness. I suggest that these results increase our ability to evaluate the likely consequences of a war, and may have important implications for our understanding of the decision to enter and terminate a war.     

The community corrections perspective toward sex offender management policies and collateral consequences: does contact with sex offenders matter?

Since the 1990s, numerous policies have been enacted aimed at managing sex offenders in the community. Two of the most prominent management policies are registries for sex offenders and residence restrictions. Community corrections professionals are tasked with enforcing these policies and yet little is known about their perceptions toward sex offenders and the policies in place to manage them. Prior research has suggested that contact with sex offenders may place a significant role in shaping the attitudes of community corrections professionals toward sex offender management policies and collateral consequences. The current study investigates the effect of contact with sex offenders on the perceptions of community corrections professionals (n = 209) toward sex offender management policies and collateral consequences faced by sex offenders. Findings suggest that contact with sex offenders does not influence the attitudes of community corrections professionals, but several other significant factors were revealed including parental status, political orientation, race, tenure, sex, and age.

Abstract

Today’s financial system essentially relies on the pledge of collateral. A closer look at this uniquely cross-disciplinary instrument not only reveals a remarkable absence in the modern disciplines but also a close relationship with money. This connection is brought into theoretical perspective by analysing the role of pledge in three historical configurations. In ancient Greece, symbola and horoi stones emerge as two distinct devices to secure contract that become entwined in seventeenth–eighteenth century pledge-theories of money as witness and object of exchange. Together these throw new light on the contemporary form of shadow money as a distinct marriage of security and safety.     

Do new democracies deliver social welfare? Political regimes and health policy in Ghana and Cameroon

Democratic reform processes often go hand in hand with expectations of social welfare improvements. While the connection between the emergence of democracy and the development of welfare states in the West has been the object of several studies, however, there is a scant empirical literature on the effects of recent democratization processes on welfare policies in developing countries. This is particularly true for Africa. In a dramatically poor environment, Africans often anticipated that the democratic reforms many sub-Saharan states undertook during the early 1990s would deliver welfare dividends. This article investigates whether and how the advent of democracy affected social policies – focusing, in particular, on health policy – by examining one of the continent's most successful cases of recent democratization (Ghana) and comparing it with developments in a country of enduring authoritarian rule (Cameroon). Evidence shows that democracy can indeed be instrumental to the expansion and strengthening of social policies. In Ghana, new participatory and competitive pressures pushed the government towards devising and adopting an ambitious health reform. Despite façade elections, no similar pressures could be detected in undemocratic Cameroon and health policy remained almost entirely dictated by foreign donors.

在人寿保险以外的其他类型保险中，被保险人应在事故发生后承担施救义务。被保险人应主动履行施救义务，如果保险人就如何施救给出指示，被保险人应遵照执行。被保险人履行施救义务时发生的必要、合理费用，保险人应予以补偿，但补偿金额原则上不应超过保险金额。如果被保险人违反施救义务，保险人对由此发生或者扩大的损失不负赔付责任。     

两岸关于旅游合同最新立法例的比较研究——以祖国大陆《旅游法》的制定为中心

以祖国大陆《旅游法》的制定与实施为标志,旅游合同于祖国大陆终于实现了规范化。而将其与1999年我国台湾地区"民法"新增有关旅游合同之法规则进行对比,可发现二者在总的立法体例、主要规制的内容上有很大的相似性,但在缔约双方一些具体权利义务的分配上仍有差异。如祖国大陆《旅游法》所规定的旅行社告知义务内容的明文化、因旅游者原因所产生合同解除权的列举式立法、旅游合同违约无过错责任原则的缓和、惩罚性损害赔偿的引入;我国台湾地区"民法"债编规定的旅行社对旅游者购物瑕疵之协助及处理义务。而这些细微的差别也为两岸旅游合同法的相互借鉴与改进预留了空间。     

The Unintended Consequences of the Transatlantic Trade and Investment Partnership Negotiations

ABSTRACT

Although stalled since 2016, the negotiations on a Transatlantic Trade and Investment Partnership (TTIP) have had major unintended consequences. The TTIP led to demands from third countries to upgrade their trade relationship with the EU and to unprecedented politicisation. As second-order effects of the latter, it endangered the EU-Canada trade agreement and brought about reform of EU trade governance and amendments to EU trade policy positions. These unintended consequences occurred because of inflated expectations about and insufficient awareness of the different nature of TTIP with regard to scope and partner compared to other trade negotiations. In the meantime, EU trade policy has adapted to the new politics of trade, making unintended consequences less likely.
