The International Commercial Mediation Competition is organized by the International Chamber of Commerce (ICC) in Paris, which held the event for the eighth time in February 2013. As the competition has grown, participation has become more and more diverse and thus mediation and negotiation have become more and more cross‐cultural. This led the ICC to invite external research on culture at the competition in February 2011. In this article, I discuss this student competition, the external research project question, and the culture of the competition. I also identify some of the further cultural issues raised by referring to relevant research on conflict and mediation across cultures, and conclude with some thoughts on how better to conceptualize the field of cross‐cultural mediation in terms of a systems approach.  相似文献

"枫桥经验"历经五十年的发展,成为一种基层纠纷预防和解决的有效模式。"枫桥经验"通过网格化的组织建设,细致的档案管理,丰富的宣传教育,以及主动的纠纷预防和解决工作,形成了以"党政带头,群众参与"和"预防教化,情理调解"为特点的工作模式。多年的实践证明,"枫桥经验"这种"政府-公民"的互动模式取得了很好的社会效果。完善并推广"枫桥经验",也是解决适用地区基层纠纷的有益尝试。  相似文献

中国大陆法院审理涉台民商事案件可以适用国际惯例.在争议问题的准据法为大陆地区法律,而大陆地区法律没有相关规定,国际上对于争议问题存在国际惯例的情况下,法官决定是否适用该国际惯例.涉台案件的当事人也可以选择适用国际惯例.国际惯例一般适用在涉台货物买卖、运输、保险、支付、结算等方面,且受国内强行法、公共秩序保留等限制.统一实体私法条约可以作为“国际惯例”而适用于涉台民商事案件.  相似文献

The paper studies the concept of the place of arbitration in comparing with the legislation and practices of international commercial arbitration. It also stresses on the connection and distinction between the place of arbitration, the place of hearing, and the place where the arbitration tribunal deliberates the case, as well as the method of deciding the place of arbitration. The author also analyzes the current legislation and practices of the determination on the place of arbitration in China. The paper pointed out that it is important in both theory and practice to promote international arbitration in China and amend domestic arbitration legislation in determing place of arbitration properly. Zhao Xiuwen, professor, has been teaching international business law in the law school of Renmin University of China since 1984. She used to be a Fulbright research scholar in Georgetown Law Center of George Washington University and other universities (USA), and as a visiting professor in universities and research institutes (UK, Germany, Italy, Austria and Australia). She also works in the panel of China International Economic & Trade Arbitration Commission (CIETAC), World Intellectual Property Organization (WIPO), Chartered Institute of Arbitrators (CIArb), Singapore International Arbitration Center (SIAC) and some local arbitration commissions in China. She is the author of several books and dozens of articles in the field of international business law and commercial arbitration, i.e. arbitration system in Hong Kong, international economic law, private international law, copyright, international commercial arbitration, international economic and trade arbitration law, etc.  相似文献

The literature on performance excuses does not consider the cost of determining whether the conditions established for contract excuse are met. We must incorporate these costs to determine which contract laws are efficient. I show that while the costs of determining whether the conditions for excuse are met will rise with the value of the contested performance, the benefits are unrelated to the value of performance. I conclude that the court should not allow excuse if the value of the contested performance is large.  相似文献

This study investigates whether gender and the perceptions of department climate affects faculty job satisfaction and intentions to quit (work outcomes) with surveys responses from 308 faculty members in science and engineering fields. The study finds that both gender and department climate are related to work outcomes and that two facets of department climate (affective and instrumental) mediate the relationship between gender and both job satisfaction and intention to quit. This finding suggests that universities can benefit from improving department climate, which then may improve the retention of both male and female faculty, but may have an even greater impact on improving job satisfaction and reducing intentions to quit of female faculty.  相似文献

商业受贿罪的客观构成要件是一个颇具争议的问题。从国外立法和我国实际出发,在商业受贿罪客观构成要件中,“利用职务上的便利”既包括直接利用和间接利用,也包括利用过去职务之便和利用将来的职务之便;不应取消“为他人谋取利益”构成要素;“贿赂”应当包括财产性和非财产性利益。  相似文献
