附赠商品是市场竞争的产物,我们应当界定附赠商品的含义和范围;明确附赠商品致人损害民事责任的性质,解决违约责任、侵权责任、违约责任与侵权责任的竞合等法律问题;对附赠商品所造成的人身损害、财产损害和惩罚性损害赔偿等,都应当确定赔偿的范围;正确分担附赠商品致人损害的举证责任.从而厘清附赠商品的法律关系,更好地维护当事人的合法权益.

旅游商品的虚拟经营是在组织形式上突破有形的界线,在有限的资源条件下取得竞争中的最大优势.实行虚拟经营,不仅能够令整合在任务中的企业充分发挥其自身能力,同时也为这些企业提供了参与更大范围生产经营活动的机会.虚拟经营有利于激活单靠自身资源难以独立地全方位参与市场竞争的企业的存量资产,有利于提高存量资产的利用率.     

Struggles for autonomy from and within the market of southeast Mexico's small coffee producers

This contribution examines the historically shifting reproduction strategies of southeast Mexico's small coffee producers through the lens of autonomy. It argues that producers attempt to create and occupy spaces of relative autonomy from commodity and labour markets while also struggling to exert a degree of control over their commodity market integration – termed here ‘autonomy within the market’. Recent developments in Mexico's coffee sector – falling real prices for certified coffee, an emerging quality programme led by transnational export firms, and devastating crop disease – are transforming coffee growing regions, threatening producer livelihoods and driving diverse reconfigurations of autonomous struggles.

This article critically assesses the relationship between the claimed fall in global poverty and the rise of China in recent years. It questions the mainstream “pro-globalisation” argument, which suggests that there is a causal link between neo-liberal, “pro-globalisation” policies, and falling poverty and rising China. It is argued instead that the evidence concerning poverty reduction is ambiguous, and it is not the case that the most successful developers have adopted pro-globalisation policies. This latter contention is examined through consideration of the relationship between Chinese development and globalisation, with particular emphasis on the “transnationalisation” of capital and the rise of global commodity chains, and how this has produced new forms of uneven development in the global economy.     

处理好文化产业两种属性的关系

文化产业既具有一般的商品属性,又具有很强的意识形态属性,商品属性是作为文化产业正常盈利的首选目的,意识形态属性是文化商品产业化的根。如果两种属性的关系处理不当,将不利于文化产业的持续健康发展。因此,在促进文化生产商品化的同时,要强调文化产业的意识形态属性,准确把握文化产业的商品属性,统筹兼顾文化产业的双重属性,只有这样才能立足本源,把握适度原则,促进文化产业的繁荣发展。     

论合同相对性原则在处理商品房买卖合同纠纷中的司法适用——基于最高人民法院相关司法解释及其判决的评判和反思

合同相对性原则在合同法规则体系中具有基石性的地位,在实体法和司法审判方面都具有重要的功能。最高人民法院《关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》第25条第二款的规定背离了合同相对性原则,造成了理论上的缺陷和实践中的困境。应当对该条司法解释的原意作出诠释,使其符合合同相对性原则,尊重合同当事人的约定,赋予当事人诉权及选择权,赋予法官自由裁量权,并在司法实践中正确处理合同相对性原则与司法裁量权的关系。     

The geopolitics of Brazilian soybeans

Soybean plays a major role in the development of Brazilian agribusiness, and in turn in Brazilian geopolitical power as well. It is a pillar of Brazil's insertion into a ‘new multi-polar world order’ as basis for much Brazilian land ownership in neighboring countries, for the extension of political influence in Africa, and it is especially important for balancing trade with Brazil's new primary commercial partner, China. Yet the US dollar and North Atlantic transnational companies still control global soybean markets and production technologies. In a context marked by booming but volatile commodity prices, food crises, riots and revolutions in food-importing countries, a global rush for farmland, and severe droughts and climate change, the soybean agribusiness in Brazil takes on new and crucial geopolitical significance. I trace the geopolitical role it has served in consolidating the ‘green revolution’ in Brazil, and raise questions about the intersection between agroindustrial markets and currencies: could agricultural commodities serve geopolitical functions (and thus contestation) similar to those ‘petro-dollars’ have served since the 1970s? These considerations show how the political ecology of soybean shapes and is shaped by inter-regional and global-scale processes, and reveals new directions for research on the emerging geopolitical landscape of our century.     

寻求“普遍伦理“的现实基础及其意义

“普遍伦理“的现实基础是商品经济关系.在商品经济的社会形态中,道德与价值规律有着密切的联系,道德旨在消除价值规律自发地起作用的盲目性,使价值规律通过人的自觉活动而顺利实现.在当今世界的“全球化“中寻求“普遍伦理“,须从理论上抽象出“一般商品经济“.通过对价值规律主要表现形式的分析,可得出一般个人最底线的基本道德准则:在个人与个人之间,做到“诚实劳动、平等互利“;在个人与社会之间,做到“两者兼顾“.在国际间寻求“普遍伦理“的实际意义是,维护世界和平,促进共同发展.     

建国前陈云的经济思想研究

本文考察了陈云主持延安时期和东北时期财经工作期间 ,组织发展商品交换和商品生产的实践 ,及形成的商品经济思想 ,剖析了中共经济思想史上第一个计划与市场相结合的经济模式———东北经济模式 ,展示了中国共产党人在建设新社会经济问题上 ,既坚持马克思主义关于共产主义最高纲领的思想 ,又搁置无商品、无货币的设想 ,实践最低纲领 ,实事求是创建商品经济模式的科学态度和史实。
