“宽严相济”刑事政策的正当性考察

"宽严相济"是我国司法机关依据刑事法规范和原则制定出来的指导具体刑事司法活动的一项基本政策。它适用并诠释着相关刑事法规范所欲实现的价值选择与目标追求;该政策吸纳并体现了现代刑法的谦抑精神,符合轻刑主义刑罚理念的发展方向。从整体上说,"宽严相济"刑事政策既具有理论上的正当性,又具有制定法上的合法性。     

繁荣与困惑——单位犯罪研究30年的回顾与反思

我国单位犯罪刑事立法的政策和功利性,决定了相关理论研究的现实性。但理论研究固有的价值和使命决定了它可以超越实践。建立在不同基础之上的理论研究的功能价值应该有所区别。从我国的刑法基础和单位犯罪的立法演进看,自然人犯罪是追究单位刑事责任的基础,以此为基点的理论研究立足现实,对实践具有较强的指导意义。

Unemployment, Economic Theory, and Property Crime: A Note on Measurement

Drawing on rational choice theory, this study considers how best to measureunemployment within the context of the unemployment–property crimerelationship. Specifically, we use ARIMA techniques to examine the relativeefficacy of using the conventional Bureau of Labor Statistics (BLS)unemployment rate and two alternative measures of the demand for labor aspredictors of monthly counts of U.S. property offenses for the years 1982through 1996. The bivariate time series analyses indicate that while theBLS unemployment rate exhibits null effects, the number of individualsunemployed for 15 weeks or more and the capacity utilization ratesignificantly affect the level of property crime. The implications ofthese results are discussed.     

论重婚罪的几个问题

重婚罪中的配偶,应当理解为事实婚姻和所有符合法定结婚形式要件的婚姻当事人,其中包括不符合结婚实质要件但未经宣告无效和撤销的婚姻当事人。关于有配偶者重婚的问题,应仅限于与他人进行了婚姻登记的情形,同时增设非法同居罪规制有配偶者与他人同居的情形,以维护社会和家庭的稳定。

从价格违法行为的定义入手,分析我国目前价格违法行为的种类,探讨价格违法行为的严重社会危害性及刑事违法性问题,认定我国价格违法行为具有突出的犯罪倾向。

The European Sourcebook of Crime and Criminal Justice Statistics: A New Tool in Assessing Crime and Policy Issues in Comparative and Empirical Perspective

Theories which suggest a relationship between crime or criminal justice variables on the one hand, and variables related to criminal justice policies on the other hand, cannot be tested without reference to historic or comparative data. Since international comparisons offer the most powerful test of such theories, policy-related research in Europe has suffered, so far, from a lack of valid comparative data. Whether crime data from different countries are comparable, has always been subject to controversies. In the case of the European Sourcebook of Crime and Criminal Justice, a network of specialists was established under the auspices of the Council of Europe in order to assess the validity of the data. Although some problems in cross-country level comparisons could not be settled, the European Sourcebook offers comparative data on 36 Member States of the Council of Europe on a variety of subjects (offences and offenders known to the police; prosecution, convictions, sentences, and corrections; survey data; and indications on manpower and budgets of police forces, prosecutors, and corrections).
