社区警务本土化的理性反思与实现途径

中国社区警务本土化是适宜中国国情的社区警务战略战术的过程。目前,中国社区警务本土化理论研究还存在滞后性和片面性的问题,实践中也受到社区警务与社区发展"协调难"和社区警务"模式化"、"形式化"的制约。实现中国社区警务本土化,必须做好社区警务本土化的顶层设计,深化社区警务理论研究的本土化,实现社区警务理念的本土化,创新本土社区警务实践模式,以情报信息主导警务助推社区警务的本土化。     

Fifty Years After the 1967 Crime Commission Report

In the 50 years since the U.S. President's Commission on Law Enforcement and Administration of Justice under President Johnson issued its report, feminist activism and both feminist and mainstream research have resulted in defining domestic violence (DV) as a social problem. This awareness of the seriousness and expansiveness of DV has spurred the development of unprecedented programs and policies. Although DV policing changes have been significant, so too have been the development of and changes in safehouses, no‐drop court policies, domestic violence courts, community‐coordinated responses, and batterer intervention programs. In this article, we review the nonpolice responses to DV cases and outcomes and provide recommendations. First, research and policies need to more regularly be aimed at addressing victims’ safety and their diverse needs and experiences. Second, assessments should include addressing the processing of these cases through the impact of responses by individual community and criminal legal system actors (e.g., victim advocates, police, prosecutors, and judges) to victims and offenders.     

完善社区矫正管理体制之构想

完善凸显刑罚本质和惩罚功能的社区矫正管理体制已经成为我国现代刑罚执行制度改革的当务之急。推进这项改革的基本路径应以社区矫正刑罚本质法理重塑为核心,从而弥补社区矫正刑罚功能缺失的缺陷,确立社区矫正刑罚目的的价值取向;同时,以社区矫正管理体制法律完善为重心,尽量克服社区矫正管理体制不顺的制度弊端,合理配置刑罚执行权能、不断提升刑罚执行效益。     

警民互动的理论基础研究

当前我国正在全面实施社区警务战略,其核心内容就是通过警民之间的互动,充分利用社区资源凝聚社区的向心力,从而解决社区中的治安问题。但不管在理论界还是在实战部门,对警民互动的理论缺乏研究。本文提出了警民互动的四个理论基础：社会契约论(Thesocialcontract)、变革管理理论(ManagingChange)、破窗理论(BrokenWindowTheory)和社会控制理论(SocialContrloTheory)。     

Community,market, and state: Reflections on their potential for achieving economic justice

This paper investigates the potential of distinct societal decision-making and coordinating mechanisms as means of achieving economic justice. Within the enormous diversity of actual institutional arrangements that guide and shape whatever happens in economies, three overarching ideal types of mechanisms which separately or in combination enable mankind to cope with its economic challenge are discernible: communities, markets, and states. Each of these ideal types represents a different way in which economic decisions are made and the economic actions of members of society are coordinated. The specific question to be answered is how each of these mechanisms can contribute to the solution of the problem of economic justice in modern times.     

社区服务:现代社会的"安全阀"

经济全球化给各国特别是发展中国家带来社会不稳定因素,随着人重新"回归社区",也把不稳定因素带入了社区.社区服务多元化和服务水平的提升,能增强社区人的认同感、归属感,是社会稳定、发展的"安全阀".在现代社区服务中要增强社区助老、就业、文化、信息服务功能,并倡导志愿者精神和社会中间组织.     

国际秩序与国家主权关系探析

国际秩序与国家主权是一种逻辑互动关系。一方面,当今国际秩序对国家的政治主权、司法主权以及国家主权平等原则等产生了消极的影响;另一方面,尊重国家主权是建立公正、合理的国际秩序的基础。在未来的国际秩序中,增进国际合作、促进国际协调机制的进一步发展和多边主义的强化,是唯一理性的选择。     

中国城市社区建设中的公众参与

公众参与是社区建设的动力。但在中国,社区建设经验不足,公众参与程度也相对薄弱。为此,要通过转变政府职能、建立专业化社区工作队伍、居民利益社区化等途径,有效消除社区建设发展"瓶颈"问题,增进中国城市社区公众参与的积极性。     

广州市社区发展的制度创新

广州市社区发展已进入全面推进阶段 ,但当前的社区建设中仍存在突出问题 ,有必要进行社区发展制度创新。具体应坚持从无形的制度安排创新和有形的制度安排创新两个向度 ,做好城市社区意识的培育、社区自治管理体制与社区建设运行机制的创新等工作。
