Abstract

In the rush for development, the regulatory state has assumed the mantle of a new panacea: the instruments and mechanisms necessary for better government, better governance, and better lives. This paper poses two basic questions in response to the rise of the regulatory state and its increasing diffusion into developing countries. First, can regulatory states exist in developing societies or, more accurately, can effective regulatory states emerge and hope to function in a manner similar to their counterparts in developed countries and deliver the types of benefits and outcomes they promise? And second, do regulatory states offer the most effective modalities for delivering enhanced social well-being? By unpacking the concept of the regulatory state and addressing its underlying assumptions and implicit normative values, it is suggested that the modalities of governance entailed in the regulatory state model may not be well suited to developing countries, hurting rather than enhancing governance outcomes. These issues are explored in relation to the Indonesian energy sector, specifically the upstream electricity generation, transmission and distribution sectors, and the machinations involved in governing the sector.  相似文献

ABSTRACT

Anti-corruption became one of the top priorities in post-Soeharto Indonesia, with democratisation, market liberalisation and institutional anti-corruption frameworks pursued as means to enhance transparency and accountability in public governance. A core component of these efforts was the establishment of a powerful anti-corruption agency, the Corruption Eradication Commission (KPK). This article assesses the effectiveness of the KPK, using evidence from two contrasting cases to identify factors that facilitated or impeded its ability to successfully investigate, prosecute and thus contain high-level corruption. The analysis highlights the threats to the KPK posed by resilient networks that were able to reconsolidate and resist anti-corruption efforts in post-Soeharto Indonesia. However, it also identifies countervailing social forces that emerged in the context of democratisation – in particular, an active civil society and a largely free press. While these supportive pressures from civil society could not fully counter the attacks on the KPK, they were able to prevent its marginalisation in the two major cases examined. Overall the KPK’s success in addressing high-level corruption is shown to be dependent on the interaction of political dynamics, interests and power relations, with no guarantee that anti-corruption forces will prevail in future cases.  相似文献

在建立多层次资本市场的过程中,做市商制度的引入无疑是必要的。而民事责任作为对投资者保护的最终环节,其完善对整个做市商法律制度的建立有着至关重要的作用。做市商的民事权利与义务主要包括双边报价、融资融券与信用交易。这些与传统民法中的要约、承诺和消费借贷都既有联系又有区别。做市商是一种特殊的券商,因此其民事责任制度也需要在现行证券民事责任的基础上进行融合与扩充。  相似文献

For all its rhetorical potency, the policy implications of the ‘squeezed middle’ are yet to be fully explored. This article looks at what the phenomenon means for the design and prosecution of progressive economic policy. It argues that any progressive government today needs to adopt a new first order goal of economic policy: ensuring that the material wellbeing of ordinary working people rises when the economy grows, a project referred to as ‘building a rising tide economy’. This objective would sit in addition to the traditional goals of sustained GDP growth, high employment, low inflation and poverty reduction. The Coalition government made a commitment to review employment law to ensure flexibility for both parties and enhance business's competitiveness. This led the prime minister to ask venture capitalist Adrian Beecroft to undertake the task of identifying the areas of employment law that presented the greatest burden, and making recommendations for reform. The Beecroft report identifies 16 areas for reform, but the lack of evidence to support his conclusions severely undermines his case. The challenge of increasing employment in a stagnant economy is substantial, and Beecroft's recommendations, if implemented, are unlikely to make a difference. Businesses need to see increased demand and access to finance if they are to take on more workers, but government must also develop a long‐term vision of the UK labour market and address weaknesses that existed before the financial crisis.  相似文献
