文化对于经济活动具有型塑的作用,正是一个社会的文化规范赋予了经济活动以意义,为个人活动提供劳动动机,为经济活动提供了一套行之有效的技能、策略和制度,担当了经济活动“固定思维习惯”的功能。此外,文化规范尤其是习俗惯例等“固定思维习惯”,也对市场的消费行为起着潜移默化的作用。     

民事诉讼回避制度的两个基本问题

从我国民事诉讼领域观察,回避制度在回避原因、适用程序两个方面存在着结构性的缺陷,在实践中导致侵害当事人诉讼权利的后果。有必要对我国回避制度进行规范分析,并对司法实践运作状况加以考察,对民事诉讼回避制度进行修改、完善。     

公安行政执法问题思考

公正执法是公安工作的灵魂,是依法治国的基本要求。当前公安行政执法存在的问题是:特权思想严重、法制观念淡薄、警察职业素质偏低、执法程序不规范等。解决问题的对策是:树立依法行政和依法定程序办案的意识;加强道德建设,提高民警的道德素养;强化和完善监督机制,严格实行错案追究制度;坚持依法从严治警,建立科学管理机制等。     

Protection Against Judicially Compelled Disclosure of the Identity of News Gatherers' Confidential Sources in Common Law Jurisdictions

In many common law liberal democracies today, news gatherers are resisting efforts to use the powers of the courts to compel them to identify their confidential sources. Often the struggles are epic. Often the public interest in effective news gathering fuelling the vitality of a modern liberal democracy is insufficiently recognised. The article uses recent cases to spotlight the shortfalls in the approach and legacy of the common law in dealing with news gatherer/confidential source relationships. Post Human Rights Act English decisions, especially that of Tugendhat J in Ackroyd , combining European style commitment to the public interest in vigorous newsgathering with common law style analysis of evidence, point the way to a more effective approach. US and Hong Kong cases remind news gatherers of their public interest responsibilities.     

Jurisprudential Dilemmas of European Law

Making a first sketch of philosophical issues arising fromEuropean Community law I want to present a series ofmore or less obvious, and more or less interrelated dilemmas,or even double binds.(i) Deepening the community becomes incompatible withwidening membership. (ii) National states seem bothnecessary for and obstructive in articulating transnationalproblems. (iii) The more democracy is needed as a warrantfor the public exercise of political power in Europe, themore the very concept of democracy on a European scaleevades understanding. (iv) European unity presupposes aunifying rule of law, while member states have radicallydifferent conceptions of this principle. (v) Even the verycore of European integration, the common market, is subjectto two conflicting and, indeed, incompatible doctrines ofcompetition. In explaining the nature of each dilemma I willtry to take my cue from the Maastricht Treaty wherever thisseems suitable. Then I will elaborate on the jurisprudentialproblems involved in it. Finally, each section will be closedby an attempt to state the nature of these problems inphilosophical terms.
