Russia and the EU have dramatically expanded their relationship over the last ten years ever since the 1997 Partnership Cooperation and Agreement entered into force. The four spaces of cooperation agreed upon in 2003 have provided a myriad of opportunities for dialogue and cooperation. Yet, quantity does not equal quality in a relationship that lacks a clear endgame perspective. Russia's new cockiness and the EU's internal divisions do not help bridge the strategic gap. Energy and the common neighbourhood are today the main spoilers in the relationship. They could however be turned into major opportunities in developing a strategic partnership.  相似文献

In this article, the authors introduce and explicate Daisaku Ikeda’s contributions to peace education. Ikeda is a Buddhist leader, peacebuilder, school founder, and prolific author whose six decades of contributions to peace education have had a global impact in practice but have remained unexamined in the extant, particularly Anglophone, literature. Using excerpts and bilingual discourse analysis of the Ikeda corpus, the authors focus on five aspects to trace the past, present, and future of Ikeda’s contributions to peace education: first, they trace the biographical roots of Ikeda’s contributions to his early educational experiences and encounter with Josei Toda (1900–1958). Second, they outline the Nichiren Buddhist philosophy informing Ikeda’s approach to peace education. Third, they explicate in the context of peace and peace education Ikeda’s concept of value-creating, or Soka education (soka kyoiku) relative to value-creating pedagogy (soka kyoikugaku) theorized by Tsunesaburo Makiguchi (1871–1944). In light of this relation, they also trace the origin of the Soka Gakkai International, of which Ikeda is founding president. Fifth, they clarify Ikeda’s educational proposals made explicitly under the label of ‘peace education,’ namely, cultural exchange, a United Nations for Education, and education for disarmament and human rights (including anti-bullying, sustainability, and global citizenship). The authors conclude that Ikeda’s perspectives, proposals, and practices of Soka education and ‘peace education’ can be viewed as a tripartite ontological model of a process of becoming, moving from inner transformation by means of dialogue to global citizenship.  相似文献

ABSTRACT

Sri Lanka’s institutional reform project has gathered momentum with the enactment of the Nineteenth Amendment to the Constitution. The Amendment restored the Constitutional Council, which is mandated to recommend and approve appointments to key ‘independent’ institutions and offices. This article asks what it means to be meaningfully ‘depoliticised’, and explores the dynamics and parameters of the current institutional reform project in Sri Lanka. It argues that the entrenchment of Sinhala-Buddhist majoritarianism within Sri Lanka’s institutional structures has led to ‘institutional decay’. Given such decay, the article points to serious limitations in legalistic approaches that are preoccupied with improving appointment procedures. Since institutions in Sri Lanka are structurally incentivized to appease a majoritarian agenda, relying on legal-textual and institutional reform alone is inadequate. Institutional reform is ultimately constrained by the structural limits of Sri Lanka’s current constitutional framework. The article concludes that meaningful constitutional transformation requires a long-term project that aims to transform the majoritarian socio-political and cultural norms that underpin Sri Lanka’s constitutional order.  相似文献

中国市民社会发育发展与政治国家的关系决定了和谐社会状态的实现必然地要表现出与西方社会不同的发展路径。市民社会的和谐与政治国家的互动及政治国家的理性运作是社会和谐状态实现的重要前提条件;西方社会中的政治国家是从市民社会中分离出来的,与之不同的是,中国市民社会与政治国家之间的关系却表现为市民社会从政治国家中分离出来;中国封建社会至今的国家高度中央集权、市民社会发育不成熟的客观历史,决定了中国和谐社会的建构进路必然地不同于西方社会,和谐社会的建构进路必然地要表现为伴随着法治国家建设进程的不断深化,采取由执政党政策指导的国家引导型,主要靠政府自律实现社会和谐的实际进路。  相似文献

宪法修改和宪法解释都是宪法演进的方式,但宪法解释是顺着宪法文本的原意往前走,而宪法修改则是对宪法文本的改变或补充,它多多少少改变了其方向——不是整个宪法的方向,而是宪法中的某些条文的方向。考察我国现行宪法的31条修正案,其中有些条文是应该修改、必须修改、也是只能用修正案的形式而很难用宪法解释的方式表现的;但也有些条文是可以用宪法解释的方法、而不必启动宪法修正案的形式加以改变的。  相似文献

The seventeenth century placed Western political thought on a path increasingly concerned with ascertaining the legitimacy of a determinate individual, parliamentary or popular sovereign. As early as Shakespeare, however, a parallel literary tradition serves not to systematise, but to problematise the discourses used to assert the legitimacy with which control over law and government is exercised. This article examines discourses of legal and political legitimacy spawned in early modernity. It is argued that basic notions of ‘right’, ‘duty’, ‘justice’ and ‘power’ (corresponding, in their more vivid manifestations, to categories of ‘heir’, ‘celebrity’, ‘martyr’ and ‘monster’) combine in discrete, but always encumbered ways, to generate a variety of legitimating discourses. Whilst transcendentalist versions of those discourses begin to wane, their secular analogues acquire steadily greater force. In addition to the Shakespearean histories, works of John Milton, Pierre Corneille, Jean Racine, Friedrich Schiller and Richard Wagner are examined, along with some more contemporary or ironic renderings.

现行刑法理论中定罪与量刑的关系被扭曲了,刑法理论把准确定罪置于至高无上的地位,司法机关把大量精力耗费于准确判断罪名,定罪决定量刑、量刑不可能影响罪名成为刑法公理。但是,判断罪名意义上的定罪,并非刑法的目的;对被告人和社会最有意义的是量刑,判断罪名只是为公正量刑服务的;因此,如果常规判断的罪名会使量刑失当,就可以为了公正量刑而适度变换罪名。  相似文献
