刑法规制网络谣言的若干问题研究

网络谣言之危害显而易见,并随着网络的普及而逐渐扩大。刑法在规制网络谣言的过程中存在诸多缺陷,致使其不足以遏制网络谣言蔓延之趋势。因此在明确网络谣言内涵之基础上,提出合法合理之建议以求得根治网络谣言之成效。

后期维特根斯坦借助语言分析 ,打破了传统美学本质主义的思维方式。他以审美活动为美学研究的起点 ,使其回归于生生不息的生活之流 ,从而揭示了其特性所在 ,并在此基础上讨论了困扰传统美学的审美魅力、审美普遍性问题 ,为美学研究提供了新的思路。     

Allocative or Distributive Aims of Income Taxation?

Relations of income tax legislation and economic development are traditional subjects of German public finance. Reginald Hansen's book (1996) on practical consequences of the “Methodenstreit” for income taxation is considered under three aspects: history of economic thought, tax-systems and aims of income taxation. The introduction is followed by four paragraphs: 1. Long-term views of income taxation, 2. Reginald Hansen's comments on income taxation in Germany, 3. From Schmoller and Wagner to the modern German type of income taxation, 4. “Ability to pay,” “Pay as you use” or what else? The article demonstrates progressive and restrictive results of the long-term view focusing on the evaluation of income taxation principles.     

The Executive and the Constitutional Reforms Process in Sri Lanka

ABSTRACT

The debate on whether the executive presidential system which was introduced to Sri Lanka in 1978 should be retained, reformed or abolished is not a new one. It is a topic which is central to constitutional reformation in Sri Lanka, but one which always carries the potential of either making or breaking any attempt made at reforming the Constitution. This article examines the character of the post of executive president in Sri Lanka and how the most recent constitutional reforms process (initiated in 2015–2016) has sought to engage with the topic of executive presidency. Departing from the more popular trend of unconditionally critiquing the executive presidency, this article calls for a more realistic and dispassionate assessment of not only the possibility of abolishing the executive presidency but also of the viability of a prime ministerial system in Sri Lanka.

歧义是英语ambiguty的汉译,它反映了语言的形式与内容(意义)的矛盾这一普遍事实,研究歧义可以考察同一语言形式表达多种语义内容的可能性,考察表面相同的形式实质上的差异性,从而深化对语言形式与内容的种种对应关系的认识。     

宪法是公民权利的保障书——解读2004年宪法修正案

宪法的发展历史表明,宪法是公民权利的保障书,2004年宪法修正案的内容正是这一点的生动体现。"三个代表"、政治文明写入宪法,为公民权利的发展提供了思想理论指导和政治基础;进一步明确了国家对发展非公有制经济的方针,完善了对私有财产保护的规定,为公民权利的发展提供了经济制度基础和物质前提;增加尊重和保障人权的规定,为公民权利的保障提供了一项基本原则;完善补偿制度,关于紧急状态的规定从保障公民权利的角度规范制约了政府权力。但为了保障修正案的实施,还应不断完善相关立法和宪法监督制度。     

现行宪法的规范定位及其价值修正

宪法规范必须以控制权力和保障权利为宗旨,合理安排好国家权力与公民权利、公民权利与公民义务和国家权力与国家权力之间的价值关系。最终通过对宪法规范的价值定位,来实现我国宪法的价值转变。     

浅析法国近年宪法修正案

法国近年来的宪法修正案扩大了公民参与政治的范围,强化了总统与政府、议会与政府的互动关系,在中央与地方关系安排上进行了重大调整,进一步扩大地方民主,发展参与式直接民主。但这些修正案具有一定的复古色彩。     

论我国行政给付的原则

行政给付是落实宪法规定的公民物质帮助权的制度,行政给付行为的实施应遵守国家责任原则、基本生活保障原则、公平公开原则、补充性原则、补足性原则和及时性原则。

本文认为,"三个代表"重要思想不仅对党的建设具有重大指导意义,而且对中国宪法发展将发生全方位的重要影响;中国宪法全面体现了"三个代表"的精神.文章建议把"三个代表"写进宪法,使"三个代表"重要思想与马克思列宁主义、毛泽东思想、邓小平理论一道作为我国宪法的指导思想.
