论建设工程价款优先受偿权

近年来,建筑市场所存在的拖欠建设工程价款问题越来越严重,并且已经影响到了我国建筑市场的健康发展和社会的和谐稳定.鉴于此,笔者以建设工程价款优先受偿权为视角,来探讨这一制度所存在的问题,并提出自己的一些建议.

作为连接城乡的纽带,农民工群体在社会主义新农村建设中发挥着不可替代的作用。随着改革开放的深入,农民工的地位与作用越来越凸显。但从社会地位来看,农民工群体处于一种"底层精英"的尴尬境地。一方面,他们在城市社会中处于社会的底层;另一方面,在农村社会中,他们却属于精英群体。农民工对新农村建设包括新农村经济建设、新农村政治建设和新农村文化建设三个方面所产生的影响是显而易见的。     

Prologue: the riddle of race

ABSTRACT

Bernard explores the myth of racelessness as it is currently circulating in American social discourse. The election of the first black American president has unleashed the term across the cultural landscape, from the mainstream media to the classrooms in which she teaches African American literature. Students use the term as a twenty-first-century incarnation of the civil rights-era concept of colour blindness. But racelessness does not represent an aspiration for equality as much as it represents an ambition to turn away from the realities of difference. It is code for a common ambition to avoid the realities of institutional racial inequalities, as well as personal experiences of cultural difference. The myth of racelessness intersects uncomfortably with current academic discourse that promotes the view of race as a social construction. Scientifically proven and irrefutably true, this discourse does not allow any room for the social experience of race and racial difference as it is lived by everyone every day, whether we like it or not. The election of President Barack Obama is a portal on to this current confusion about the concept of race, specifically, and blackness, in particular. Many pundits have speculated that Obama would not have been electable if he had had dark skin, if he were irrefutably black, in colour and culture. The fact that he himself has elected to call himself ‘black’ serves as the platform of Bernard's essay on the case of race in the United States.

随着科技的日益发展,知识资产的重要性和保护性已经越来越成为人们关注的焦点,知识资产的独占性而产生的经济效益更是无可置疑的,对于知识产权法制保护刚刚起步的我国,如何对知识产权保护力度的定量,是我国未来知识产权法典形成的必要基础,因此对我国知识产权法的法制建设提出几点建议:一是建立限制知识产权滥用的规范性;二是规定具体化;三是善于法经济分析;四是与国际接轨;五是加强和完善特有的知识产权优势。     

Protest,memory, and the production of ‘civilized’ citizens: two cases from Turkey and Lebanon

This article studies the proliferation of discourses of rationality and responsibility among a particular elite social group in Lebanon and Turkey, as they remember student mobilization of their past. I offer these episodes of student mobilization as acts of citizenship that create and make use of rapturous moments in the histories of their countries and institutions. I extend these acts of citizenship to the contemporary context and study the ways in which they become part of discourses of citizenship in unexpected ways. I propose that these narratives draw upon a set of local practices that reflect meanings of citizenship, originating from Western discourses of liberalism, albeit following a different route. In the narratives, violence and irrationality become the defining features of politicized behavior, whereas being civilized epitomizes good manners and rationality. Such boundary-drawing exercises contribute to making conceivable exclusionary social orders based on the idea of a hierarchical distribution of reason and social utility.     

新中国成立以来中国共产党纪律检查机关建设

新中国成立以来,党的纪律检查机关建设经历了初步探索（1949—1978）和恢复发展（1978至今）两个阶段,组织机构、干部队伍和体制机制建设的科学化水平逐步提高。前后两个时期党的纪律检查机关建设历程有很多不同,也有共同的规律,那就是党的建设是前提、改革发展是动力、干部队伍建设是重点。今后党的纪律检查机关建设仍应坚持党的领导,自觉融入党的建设总体布局;要不断改革完善现有的领导体制,增强独立性;通过强化队伍建设,保障干部的先进性、纯洁性。
