我国刑事二审发回重审制度的实然分析与规范设计

刑事二审发回重审制度在一定程度上实现了上级法院对下级法院的监督且有利于发现事实真相,但它在理论和实践中也出现了很多问题。通过对发回重审立法规定的合理性和实践成效及问题进行实然分析,将揭示出我国发回重审制度在实现其实体性补救和程序性制裁功能时所体现出的缺陷。在此基础上提出修改建议,完善该制度就具有十分重要的意义。     

论我国见索即付保函法律制度的构建

见索即付保函产生于二战以后蓬勃发展的国际商业实践。突破了传统保函的从属性,具备独立性与单据化特征使受益人得到迅速、便捷的资金补偿,从而被商业社会普遍接受。但由于各国交易惯例的差异和当事人理解上的偏差,相关纠纷时有发生。我国商业实践早在20世纪80年代就开始运用,但现有立法却仍没有明确其合法地位,也没有专门而系统的操作规范,司法实践亦对涉外领域和国内领域的保函效力予以区别对待。基于商业实践和保护相关当事人权益的需要,构建我国见索即付保函法律制度势在必行。     

Environmental Policies and The Reproduction of Business as Usual: How Does It Work?

This paper aims to advance knowledge about corporate environmentalism by using new concepts and methods. We broaden the concept of the firm as “differentiated composite actor” by including not only managers but workers and unionists as actors. We descend into the “hidden abode of production” using Lefebvre’s concept of “everyday life” to explore the barriers environmental policies experience in this sphere. We base our explorations on life-history interviews to understand how the imaginaries of production are embedded in people’s self-conceptions. We identify seven barriers to the implementation of environmental practices: deficient regulations, collusion between controller and controlled, de-prioritisation, hierarchism, compartmentalisation, specialisation, and social unsustainability. A “necessity discourse,” legitimating the priority of efficiency and product quality over environmental sustainability, subjugates alternative sustainable practices. The paper concludes with a discussion of the results in the light of previous investigations, suggesting that the concept of the everyday could enrich future research.     

Security Identities and ‘No More,No Less’ Operations: On Making NATO's Involvement in Darfur Possible

This article explores NATO's support mission to the African Union's peacekeeping operation in Darfur, Sudan between 2005 and 2007. NATO policies are commonly presented as functional responses to events, but how did a conflict on the African continent become the Atlantic Alliance's business? In this essay, a poststructuralist practice-oriented approach is used to understand the way in which discursive practices progressively establish a policy option as ‘natural' in a given situation. It is argued that the normalization of NATO's support mission to the African Union in Darfur and the integration of this operation in NATO's security identity were the result of complex and conflict-ridden social interactions between different discursive practices supported by different actors.     

Promoting Data Protection Standards through Contracts: The Case of the Data Security Council of India

Data protection has emerged as a major corporate and government concern worldwide. The focus is on secure handling of data so as to ensure privacy of customer data and security of corporate data. Privacy and security laws in countries are not harmonized; compliance regulations are different too. As the global hub of outsourcing, India is faced with a challenge of demonstrating compliance with varying compliance regulations in countries. The Data Security Council of India (DSCI) considers the Best Practices Approach as a practical and realistic way to enhance adherence to data security and privacy standards, and to enable a service provider to demonstrate compliance. Getting these standards recognized through contracts can promote data protection. An industry association can act as a third party self‐regulatory organization to promote these standards and enforce them among its members through certification or privacy seals, thereby helping implement data protection in international data flows.     

African American Adolescents' Perceptions of Family Interactions: Kinship Support,Parent–Child Relationships,and Teen Adjustment

This study examined perceived kinship support and parenting practices for 158 African American adolescents in the 9th and 10th grades. Kinship support showed direct associations with teen outcomes that, for work orientation and school orientation, were partially mediated by parenting practices. With a few exceptions, kinship support was positively associated with youth adjustment for teens from single-parent and 2-parent homes, teens with college educated and less educated parents, and for girls and boys. Both kinship support and maternal warmth predicted self-reliance, work orientation, and school orientation. Kinship support was the primary predictor of ethnic identity.     

Proud to Be a Public Servant? An Analysis of the Work-Related Determinants of Professional Pride among Dutch Public Servants

ABSTRACT

A proud public servant is defined as someone who works honorably, conscientiously, and with dedication. Although professional pride has several positive effects on the performances of public servants, it is not instantly apparent which instruments help to stimulate pride. This study combines the Job Demands-Resources model and the High Performance Work Practices taxonomy to analyze the determinants of pride. The analysis of a large dataset of Dutch public servants shows that their professional pride can barely be influenced by High-Performance Work Practices but is in particular determined by the work environment and personal experiences related to the work.     

论经济全球化与中国的现代化

中国人对现代化的追寻已有百余年的历史,直到1978年,我们才真正找到一条符合中国国情的现代化道路.现代化既是一个历史性范畴,也是一个世界性范畴,因此,我们的现代化必须在开放的状态下完成.对外开放是我们的必然选择,中国必须融入经济全球化的潮流,经济全球化在给我们的现代化带来机遇的同时,也会带来挑战.对此,我们必须有足够清醒的认识,并采取相应的对策,以趋利避害.     

通过裁决的社会控制：《工会法》第 50—56 条不当 劳动行为行政救济机制的法律续造

《工会法》在“法律责任”部分确立了不当劳动行为的行政救济路径，但至今未明确此路径的 性质及程序展开规则，严重制约着该法的实施。此类争议在域外立法中存在着民事诉讼主导、行政裁决主导、 二元机制并存三种处置模式，但基于不当劳动行为争议的不可诉性、司法救济难以满足团结权保障的时效性和 预防性要求、行政救济可覆射之权责主体更为宽泛诸原因，行政裁决始终占据域外代表立法国家核心机制之地 位。我国应当汲取这一立法经验，在统筹好裁决机制设计多元价值诉求基础上，从不当劳动行为行政裁决机制 之基本构造、不当劳动行为型违法解雇条款与一般违法解雇条款之协调、工会工作人员不当劳动行为行政裁决 救济路径之拓补三方面推进法律续造，并带动相关立法的精进表达。未来，建议制定统摄性的“劳动争议处理法” 来对包括不当劳动行为争议在内的集体劳动争议之处置进行系统重整，最终形成具有中国特色的劳动争议处置 体系。
