In this article, we review the mediation literature from the past decade, utilizing a cybernetic mediation paradigm to organize the material. In this paradigm, we note that the type of conflict, country, culture, and mediation institutions affect the mediation process. Within this process, the mediator and disputants interact with each other, attempting to reach their own goals. This interaction produces outcomes for the disputants, the mediators, and other parties. The literature — organized using this paradigm — indicates that mediation is frequently practiced in many venues; the literature also provides an exhaustive list of mediation goals, describes many mediation strategies, and reports manifold mediation outcomes. Unfortunately, the number of studies examining the relative effectiveness of specific strategies (e.g., pressing, relational, and analytic) seems insufficient. Few studies have used control groups or reported observations of mediator and disputants' behavior in actual mediations.  相似文献

This review article offers a critical assessment of Ato Quayson's Cambridge History of Postcolonial Literature (2012), engaging in passing with a debate between postcolonial theorists that appeared also in 2012 in the New Literary History (43.1 & 2). It posits that the History presents postcolonial literature, and indeed postcolonial studies, as much too settled fields, a view clearly at odds both with their genesis and with that reflected in the essays in NLH.  相似文献

This article analyzes how the Poles and Jews who disappeared from the western Ukrainian city of L'viv as a result of the Second World War are remembered in the city today. It examines a range of commemorative practices, from monuments and museums to themed cafes and literature, and analyzes how these practices interact to produce competing mnemonic narratives. In this respect, the article argues for an understanding of the city as a complex text consisting of a diverse range of mutually interdependent mnemonic media produced by a range of actors. The article focuses in particular on the ways in which Ukrainian nationalist narratives interact with the memory of the city's “lost others.” The article also seeks to understand L'viv's memory culture through comparison with a range of Polish cities that have faced similar problems with commemorating vanished communities, but have witnessed a deeper recognition of these communities than has been the case in L'viv. The article proposes reasons for the divergences between the memory cultures of L'viv and that found in Polish cities, and attempts to outline the gradual processes by which L'viv's Polish and Jewish pasts might become more widely integrated into the city's memory culture.  相似文献

Drawing on field theory, this paper aims to shed light on the development and functioning of the Kurdish literary world in Turkey, characterized, in particular, by the use of a non-official language. It argues that this “small literary world” is to be understood in relation to a “double macrocosm”: the sphere of Kurdish politics and the national Turkish sphere, which provide specific constraints and resources. The paper argues that in such a context the emergence of a literary field, autonomous from other social fields and independent from political stakes, follows an unpredictable path, and will not always be achieved political dimension of the literary act stresses its dependency on political stakes and the field of politics. This however does not impede the emergence of autonomous literary institutions. The multilingualism of the actors involved drives also toward another heteronomy: this small literary world is also to be understood in relation to the Turkish literary field. The paper first presents the macrocosms in which Kurdish literary activities developed. It then examines the progressive integration of a field freeing itself from political constraints. Lastly, it focuses on the trajectories of a few writers, the analyses of which show the intertwining of the different worlds.  相似文献

Those who work with the condemned often come to reject the death penalty not only in individual cases, and not only on the ground that it is poorly implemented. They tend to conclude that the punishment is wrong. I argue that the perspective of the executioner helps illuminate the debate about whether to abolish capital punishment, and that indeed the perspective of those who work with the condemned raises the troubling possibility that support for the death penalty can survive only at a great remove. Jeffrie Murphy has also argued that the executioner’s perspective can be useful, but I contend that Murphy asks the wrong question. His essay considers whether an executioner may, under some circumstances, take pride in his work. The better question is whether anyone ought to be asked to do such work. On this latter question, the perspective of the executioner sheds important light. Like Murphy, I draw on works by and about Albert Pierrepoint, the “last hangman” of Britain. I also draw on the perspectives of numerous executioners, wardens, chaplains, and other death row personnel. I argue that their perspectives offer a powerful argument against the main rationale for the death penalty: retribution. If retribution is keyed to the offender’s character as well as his wrongful act, then post-conviction character ought to matter. The executioners’ accounts share a common theme: that death row inmates change over time and hold the potential for redemption.  相似文献

Abstract

Anna Kavan's fictional portrayals of psychiatric breakdown and its treatment provide a unique perspective on the patient's experience of early to mid twentieth-century psychiatry. This article looks in detail at Kavan's time working with soldiers suffering from effort syndrome during the Second World War, observing how the solider-psychiatric patient becomes a figurehead for her radical politics in her Horizon article ‘The Case of Bill Williams’ (1944), and a prominent protagonist in her stories. Through close reading of her correspondence, her journalism and her wartime stories collected in I Am Lazarus (1945), it examines how the intersection of psychological trauma and physiological symptoms characteristic of effort syndrome surfaces in Kavan's writing of this period and in her own psychic responses to the war. It observes the importance of figurative language to her portrayal of war trauma and psychological breakdown, as her characters embody metaphor in their psychosomatic symptoms, and explores a twisted reconception of mind–body dualism prevalent throughout her writing of this period. It goes on to examine how the peculiar interaction of the physical and the psychological extends to the relationship between Kavan's characters and their external environment in her Blitz stories. Against the backdrop of the war-torn city, mind and body engage in ongoing conflict, affect and emotion bleed into her physical landscapes, and everyday objects become animated and hostile towards her protagonists.  相似文献

The author discusses some background matters concerning the US criminal justice systems that may provide useful context for non-US readers, and summarises the main general conclusions about the operation of community penalties from two decades' research. He also briefly summarises research concerning each of the major penalties that have been attempted. Why American jurisdictions have been comparatively unsuccessful at use of community penalties as alternatives to incarceration and whether that lack of receptivity can be changed is discussed in the conclusion.  相似文献
