孟子对舜的诸多论述体现出独特的观念:首先,孝作为一种道德原则源于人的本性之善。其次,孝是具有最高价值的道德原则,它不仅能够实现于血亲关系和家庭中,也可推及于社会群体及天地万物,具有强大的示范与感化作用。再次,在具体的实践方式上,为人子者应顺乎父母、得乎父母,对父母时时保持发诸本心的诚与敬。最后,在不同的道德原则发生冲突时,应根据具体情境选择具有更高价值的道德原则作为判断与选择的标准,做到原则性与灵活性的统一。  相似文献

Very few studies have examined the influence of the acculturation strategies of an offender of foreign descent on the way a third party judges the personality and action of that offender. The aim of our study was thus to measure the effect of three variables (Seriousness of the harm suffered by the victim; Type of acculturation strategy of the offender; Level of Social Dominance Orientation [SDO]) of the person making the judgement) on the judgements and decisions made by a sample of students faced with a situation of physical aggression committed by a man of North African descent living in France. After reading a scenario describing a criminal act committed by a man of North African descent, who had or had not adopted French culture, 168 French students completed a judgement scale concerning the criminal act and the offender and an SDO scale. The results show that the crime was perceived as less serious when the perpetrator had adopted French culture than when he had not. The perpetrator was also judged less severely. Participants with higher levels of SDO advocated harsher punishment and attributed the crime to the offender’s personality. We discuss these results and identify new avenues for research.  相似文献

外国法院判决的承认与执行是国际私法所调整的重要内容 ,英美法系国家将其视为国际私法应解决的三大问题之一。加拿大承认与执行外国法院判决的制度中吸收了英美等国的一些基本原则 ,但也逐渐发展出其自身的特点 ,尤其在近年来 ,加拿大法院逐渐放松了对外国判决承认与执行的限制 ,使外国判决较易在加拿大得到承认与执行。本文即结合加拿大承认与执行制度在实践中的发展趋势 ,阐述其承认与执行外国法院判决的一般要求和主要抗辩。  相似文献

将诉讼事件的一部分与他部分分离,先予终结的终局判决,即称一部终局判决。我们所熟悉的判决绝大部分都是全部终局判决,而对一部终局判决的认识则相对匮乏。一部终局判决可以简化审理过程.避免当事人与法院进行不必要的纠缠,进而节省诉讼资源,同时可以使当事人就该一部终局判决部分先获解决,使得胜诉者之私权早获保护。  相似文献

This paper argues that in medical discourse, there is insufficient unanimity of opinion with regards to the time at which an accurate diagnosis of PVS can be made and that clearly, there is an incomplete medical knowledge of the PVS condition. The judiciary chooses neither to question medical opinion that patients can be considered to be in PVS despite a failure to satisfy the diagnostic criteria, nor medical opinion that patients in `near PVS' will never recover. It is apparent from an examination of the judgements given in PVS cases that the law does not ascribe such individuals with full human status. Such a legal position is particularly problematic in ethical terms when applied in cases involving patients who are in a `near PVS' position, and in the light of evidence that some PVS diagnoses are inaccurate. The application of the best interests test in PVS cases results in the adoption of a paternalistic, objective approach that fails to respect the former competent individuals whom PVS patients once were. If, alternatively, the substituted judgement test were to be adopted, the principle of individual autonomy would become central to the question of whether PVS patients' treatment should be withdrawn. Furthermore, the application of this test would also ensure that PVS patients continue to be viewed as `persons'.  相似文献

法院的判决宣示着法的精神,引导着民众的行为.诉诸于法院各种诉讼请求,即是将各种矛盾呈现在法官面前.法官必须判断何种诉求为正当,只有当案件事实符合法律规范的构成要件,且案件事实中蕴涵的法律价值和所适用的法律规范的价值取向相一致时,才可以依据该法律规范对案件事实作出判决.法官在运用国家的制定法以回应民众的要求时,将一些明显不当的有违民意的规定加以过滤,能动地对制定法加以填充修正.刘荣军教授亦言:"处于社会与国家立法机关之间的司法,应当以并不完整的法律作为基本的支撑,寻找制定法之外的法源,将社会的正义、公平的观念和价值导入司法程序之中,创造出能够解压、还原法律本意的规则,以作为裁判的依据."  相似文献

民事二审和解撤诉之後,一方当事人反悔,另一方当事人能否向法院申请强制执行一审判决?中国的《民事诉讼法》和《民诉意见》对此问题并没有规定,实践中法院、当事人、检察院对此问题的处理方式五花八门。笔者以为:一审法院判决效力的认定是解决该类争议的关键。对此,笔者首先厘清了撤回起诉和撤回上诉的区别,然後又从绝对无效和相对无效角度层层推进,最後得出只有双方当事人在和解协议中明确约定反悔後执行一审判决,此时的一审判决才是有效的,其他情况均为无效。  相似文献

《物权法》第一百零六条明确规定了我国的善意取得制度,并将之一体适用于动产和不动产交易之中,这种简明划一的立法模式对于我国财产动态流转安全的保护具有重大意义。然而动产与不动产的不同特性决定了该制度在适用上是不统一的,集中体现在司法实践中对于《物权法》第一百零六条第一款善意时间点的判断上。本文通过案例提出问题,并运用民法解释方法对"受让时"做出合理解释。  相似文献

Many academics misunderstand public life and the conditions under which policy is made. This article examines misconceptions in three major academic traditions—policy as science (e.g., ‘evidence‐based policy’), normative political theory, and the mini‐public school of deliberative democracy—and argues that the practical implications of each of these traditions are limited by their partial, shallow and etiolated vision of politics. Three constitutive features of public life, competition, publicity and uncertainty, compromise the potential of these traditions to affect in any fundamental way the practice of politics. Dissatisfaction with real existing democracy is not the consequence of some intellectual or moral failure uniquely characteristic of the persona publica, and attempts to reform it are misdirected to the extent that they imagine a better public life modeled on academic ideals.  相似文献
