THE UTILITY OF THE DEVIANT CASE IN THE DEVELOPMENT OF CRIMINOLOGICAL THEORY*

This article asserts that the deviant case method offers a potential avenue for enhancing theory directed at explaining crime by using more available information to better connect the process of analyzing cases with that of explanatory refinement and elaboration. This approach has facilitated theoretical development in other social sciences and has proven useful where applied in criminological inquiry. Extant research is reviewed, and an empirical example is presented to demonstrate how this approach might be operationalized in criminological inquiry using quantitative methods. Conclusions relevant to future research are considered.

背信损害上市公司利益罪是一个新类型的罪名,虽然刑法增设近5年的时间,但由于罪名相对陌生,司法实践中,对本罪的理解和适用,尚处于探索阶段。本文仅以2010年5月18日最高人民检察院、公安部出台的《最高人民检察院公安部关于公安机关管辖的刑事案件立案追诉标准的规定（二）》（以下简称《立案追诉标准（二）》）中涉及到的相关概念为切入点进行展开分析,以明确背信损害上市公司利益罪立案追诉标准,从而加深实践中司法人员的感性认识。     

The hierarchies of age-period-cohort research: Political context and the development of generational turnout patterns

Voters that come of age at roughly the same time share common influences because of the specific political context during their formative years. We can therefore assume the errors in a model explaining their political behavior to be dependent. Recent advances in social statistical analysis of age-period-cohort (APC) effects propose the use of hierarchical modeling in combination with repeated cross-sectional survey design to solve this problem. We apply these random-intercept models to assess the impact of the political context on the development of generational turnout patterns, assuming that cohorts that grew up in a highly-politicized context have a higher propensity to turnout to vote despite of any age or period effects.

违规出具票据罪构成特征的学理分析

银行或其他金融机构出具票据的业务活动,为企业提供了安全、便捷的结算途径,同时也为自己带来了相应的票据责任和可能的财产风险。实践中,一些银行或其他金融机构的工作人员出于种种原因违反法律规定,非法为他人出具票据,从而使银行等金融机构遭受财产损失,严重扰乱金融秩序。我国关于违规出具票据罪的规定已较为完备,但是对于违规出具票据罪的构成要件问题还存在研究的必要。文章在归纳前人观点的基础上,从违规出具票据罪的客体、客观行为、主体和主观四个方面对其构成特征进行了理论分析,以期为我国刑法理论中对该罪的研究以及实务提供一些思考。     

占有行为的规范分析

占有行为是指占有的取得或丧失行为,它既不同于遗失等可归于自然事实的占有取得或丧失,也不同于埋藏物发现等形式上有占有要素、但该要素并无实质效用的形似行为,还不同于善意占有变为恶意占有等占有变更。占有行为包括了取得占有或丧失占有的目的意思,该意思不能独立于取得或丧失对物支配的事实状态,故占有行为是目的意思不独立的事实行为。尽管占有行为与法律行为相当不同,但它们之间存有协力、制约、衔接、并存等紧密的规范关联。在法律效果归属领域,在适用占有辅助规范和间接占有规范的基础上,还应类推适用代理规范。     

Granger因果分析模型研究进展

由于时间序列的非平稳性,不具有有限方差,所以高斯—马尔科夫定理不再成立,用普通最小二乘法得到的参数估计不再是一致的,出现伪回归的现象,从而导致错误的因果关系。同时由于时间序列的非线性,常规的线性向量自回归模型难以正确描述经济变量之间的因果关系。从G ranger因果分析模型研究进展情况,可见目前所面临的问题和未来可能的发展方向。     

Case report: Identification of skeletal remains using short-amplicon marker analysis of severely degraded DNA extracted from a decomposed and charred femur

Applying two extraction protocols to isolate DNA from a charred femur recovered after a major forest fire, a range of established and recently developed forensic marker sets that included mini-STRs and SNPs were used to type the sample and confirm identity by comparison to a claimed daughter of the deceased. Identification of the remains suggested that the individual had been dead for 10 years and the DNA was therefore likely to be severely degraded from the combined effects of decomposition and exposure to very high temperatures. We used new marker sets specifically developed to analyze degraded DNA comprising both reduced-length amplicon STR sets and autosomal SNP multiplexes, giving an opportunity to assess the ability of each approach to successfully type highly degraded material from a challenging case. The results also suggest a modified ancient DNA extraction procedure offers improved typing success from degraded skeletal material.
