On the Duration of Self-Employment: The Impact of Macroeconomic Conditions

The article examines the role of lending rates, imports and growth on the duration of self-employment in Zimbabwe while the country embarked on trade liberalisation. The variables were selected because of their importance as policy variables in reform programmes and also their importance to small entrepreneurs. Previous research has established the importance of an initial endowment and other measures of human capital on entry into self-employment as well as growth of the respective enterprises. We show that such initial conditions do not always give robust results. Instead, duration of self-employment is negatively related to higher lending rates, increased imports and structural change, but responds positively to growth.     

The “Bestie di Satana” Murders

In recent years, satanic groups have been responsible for various types and degrees of crimes. We report the case of a number of murders committed in Italy by a group of young people calling themselves the “Bestie di Satana”. Forensic psychiatric assessment of the members of a satanic sect charged with the crime revealed that all the young people had a fragile, immature personality, a very low level of education and were socially disadvantaged. The trial of the members of the “Bestie di Satana” sect was concluded with the verdict of deliberate murder, and all the members were given long jail sentences. This report should lead us to explore social and cultural responses to juvenile satanism, statistically shown to be a relatively rare phenomenon but with a high criminal potential.     

Crime and punishment in Russia and the United States: 1990–1998

Since the collapse of the Soviet Union in 1991, dramatic sociopolitical changes have affected the ability of the Russian criminal justice system to effectively process violent crimes. This paper compares the police and court processing of selected violent crimes in Russia and the United States during the period 1990–1998. Using data from the Russian Ministry of Internal Affairs and the U.S. Bureau of Justice Statistics, we examine the disposition of homicide, rape, robbery, and aggravated assault (i.e., serious bodily injury) cases in both countries during this period. Our findings indicate that while arrests and rates of homicide, robbery and aggravated assault decreased in the U.S. during this period, they increased in Russia. On the other hand, rape rates and arrests decreased in both countries during this period. Conviction rates as well as the percentage of defendants sentenced to prison in Russia were both higher than in the U.S. for each of the offenses studied during this period. We discuss implications of the findings and suggest additional research.     

The exclusion of Roma claimants in Canadian refugee policy

The arrival of thousands of European Roma seeking refugee status in Canada elicited a range of legislative and policy instruments that severely restrict their acceptance and create conditions antagonistic to further admissions. Interventions have included visa restrictions, actions by Immigration and Refugee Board, the Balanced Refugee Reform Act followed by the Protecting Canada's Immigration System Act, and ministerial rhetoric about the illegitimacy of Roma as refugees. Other factors have involved interpretations of persecution in relation to the Geneva Convention and Protocol, and the implications of the conditions required for membership to the European Union. These political circumstances in large part determine Canadian acceptance rates for the Roma. Their systematic exclusion is reminiscent of the historical treatment of other groups due to institutional racism. In the new racism, however, refugee law and policy is racist in effect while evading the language of race.     

放火罪与故意杀人罪关系新论

通说认为,放火罪和故意杀人罪是法条竞合关系,但无力解释为何放火罪未造成重伤以上结果的法定刑轻于故意杀人罪的法定刑。为追求罪刑相适应,以杀人故意实施放火行为,又危害公共安全的,成立放火罪与故意杀人罪想象竞合犯的观点逐渐占据优势。但放火罪中的致人死亡包括故意杀人,这表明放火罪能够包含杀人的故意与致人死亡的结果,并不符合想象竞合的适用前提。事实上,罪刑失衡的质疑不成立,特别法是重法时,普通法的量刑应当受到特别法的限制。未造成重伤以上后果的故意杀人行为的量刑本应受放火罪法定刑的限制,处3年以上10年以下有期徒刑。     

新农村建设背景下我国乡村治理体制的变革

我国现有的乡村治理体制自形成以来，对于保持乡村社会的稳定秩序，推动乡村经济社会的发展作出了巨大的贡献。然而，随着经济社会的飞速发展，我国现行乡村治理体制的弊端逐渐显露出来。因此，需要对我国现有的乡村治理体制作根本性变革，以确保新农村建设宏伟目标的顺利推进。

从制度演变的轨迹看,我国曾经三次大规模地推行市管县体制.由于制度背景的差异,市管县体制所取得的绩效也发生了很大的变化,从推动地方经济发展到各种弊端日益突出.分析市管县体制的各种影响因素,可以看出行政区划变革在促进经济发展中的局限性.要解决区域经济一体化的问题,就应该从治理的角度,寻求有效的地方治理之道,复合行政的理念就提供了这样一种新思路.     

Female juvenile murderers: Biological and psychological dynamics leading to homicide

The increasing involvement of girls under 18 in violent crime has been a matter of growing concern in the United States in recent years. This article reviews the arrests of female juveniles for violent crime and then focuses specifically on their involvement in homicide. Arrests of girls for murder, unlike arrests for assault, have not risen over the last 30 years, suggesting that the dynamics that propel female juveniles to engage in lethal violence differ from those contributing to assaultive behavior by this same group. A review of the literature indicates that theories as to why female adolescents kill do not take into account recent scientific findings on brain development and the biological effects of early trauma in explaining serious violent behavior by girls. Three cases, evaluated by the authors, involving female adolescents charged with murder or attempted murder, are presented. The authors focus on the biological and psychological dynamics that help explain their violent behavior. They discuss the effects of insecure attachment and child maltreatment, and trace a critical pathway between these early experiences and future risk of violent behavior. The dynamics of child maltreatment in fostering rage and violence are discussed thereafter in terms of offender accountability. The article concludes with a discussion of treatment and recommendations for future research.

The South African National Credit Act fails to protect homeowners against various interest rates hikes

Where a credit provider makes a proper financial assessment and finds that the low-income consumer will be able to satisfy in a timely manner all the obligations under all the credit agreements to which the consumer is a party he will in all probability conclude the credit agreement with the consumer. Obviously the affordability assessment made by the credit provider will depend on the prevailing interest rates at the time. There has been several interest rate hikes since June 2006 to December 2008 in South Africa that has had a detrimental impact on low-income home owners. Due to the various interest rate hikes and the prevailing high interest rates many consumers have lost their mortgaged homes. The South African National Credit Act of 2005 has failed to take into its purview cases such as these, and as a consequence there is no sort of consumer protection available for the low-income group who become over-indebted, because of the constant rising interest rates on their mortgage loans.
