以陕甘革命根据地作为领导中国革命的大本营的伟大战略决策的形成,是由于陕甘革命根据地的存在与革命发展的有利条件,共产国际援助中国革命思想和对陕甘革命根据地的认识,全国革命形势发展的要求与党中央为了实现政治路线,党和红军生存与发展的需要,中共第一代中央领导集体具有的科学精神与战略眼光这些最基本的因素所决定的,是当时社会历史条件下的必然选择。     

Unintended Consequences of Local Sales Tax: Capitalization of Sales Taxes into Housing Prices

Local governments are under pressure to look for alternatives to property taxes as their main revenue source. One response has been to adopt local sales taxes. Prior studies offer little guidance on whether and how much local governments enhance their revenue capacity with local sales taxes. This article unveils the underlying mechanisms by exploring the capitalization of sales taxes into housing prices as a property tax base measure. The empirical analysis reveals a capitalization of local sales taxes into housing prices, indicating the reduction of property tax bases in higher sales tax areas from the long-term perspective. The findings suggest that a sales tax rate increase might not raise local revenue capacity as much as policymakers intend.     

The Frequency of Cranial Base Fractures in Lethal Head Trauma

The interpretation of cranial base injuries has never been investigated from a purely anthropological perspective. Very little exists in forensic literature in order to interpret the significance of cranial base fractures. We analyzed 296 cases of deaths due to skull–brain injuries. The frequency of vault fractures was 75.7% and that of base fractures was 91.9%. We observed the distribution of cases of death according to manner of death and manner of injury and number of fossae involved. These observations were analytically compared to different variables (age, sex, manner of injury, and mode of injury). The study presented the proportion of base fractures associated with vault fractures, and the frequency of absence of base fracture in subjects with no vault fractures. Interesting associations of base fractures to age and manner of death are shown.     

论被征收不动产价值评估基准日的确定——美国模式与中国方案

被征收不动产价值评估时点的确定是精细化研究土地征收与补偿的重要环节。美国联邦和29个州均以成文法的形式规定了计算不动产价值的时间节点,但实践中严格按照实定法制定的时间进行价值评估可能会背离宪法"公正补偿"的要求,因此美国法院形成了五种应对方式。在中国法的建构中,应当对国有土地上房屋以及集体土地的征收与补偿建构统一的判断标准。通过法律解释方法完成对"公正补偿"与"不得低于"之间关系的塑造。一方面,不能机械地理解和适用"房屋征收决定公告之日"的规定,将所有征收项目不动产价值的评估时点确定为"征收决定公告之日";另一方面,也不宜轻率地否认成文法的规定,而应当综合考量评估报告应用的有效期、迟延履行的原因、项目的规模等因素,以达到"公正补偿"的目的。     

Youth,parental absenteeism and political bases in Mazowe district

The study sought to establish the effects of parents and guardians' absenteeism from homes on the dependents especially the youth in the rural villages of Chiweshe in Mazowe district committing time to political bases' activities. Data for the exploratory study was collected from narratives gathered from interviews and observations that were held with 40 youth purposefully sampled from the participants based on age and exposure to circumstances of living with parents/guardians who often manned political bases. The findings did to some extent confirm that elders' absenteeism from the children has various negative effects on the children. However, there were also isolated positives that were recorded.     

禁毒情报信息基础工作之困境与解决

情报信息是禁毒工作的重要组成部分,在毒品案件侦查过程中,情报信息的作用举足轻重。但是,当前禁毒基层部却存在的情报基础信息失灵,阵地控制疲软,对收集到的情报信息缺乏分析研究,信息转化利用率较低等突出问题,禁毒情报信息基础工作建设要切实解决好各级领导的思想认识问题,树立“一盘棋”的思想,协调诸警种的关系,强化基层禁毒警的情报信息意识,配备专门的警力进行情报信息分析,加大禁毒情报基础工作的投入。     

知识产权侵权惩罚性赔偿数额的司法确定问题研究

《中华人民共和国民法典》第1185条以一般规则的形式宣示我国知识产权侵权惩罚性赔偿制度的全面确立。抓紧落实惩罚性赔偿是知识产权司法面临的重大课题,惩罚性赔偿数额的确定是其中的主要问题。基数难以确定,倍数的确定缺乏统一标准,法定赔偿滥用,惩罚性赔偿、法定赔偿、酌定赔偿适用混乱,地方性裁判指南规定的数额标准不一致导致"类案不同判"等,都是当前损害赔偿数额确定中的问题。为解决上述问题,建议以权利人的实际损失为准确定惩罚性赔偿的基数,侵权获利或者许可使用费倍数作为对权利人实际损失的推定;明确实际损失的构成,在损失计算方法上适当借鉴域外经验;统一侵权获利的确定标准,同时考虑技术分摊问题;明确许可使用费的合理倍数可以作为惩罚性赔偿的基数,明确许可使用费确定时的考量因素;惩罚性赔偿的基数不应包括权利人制止侵权所支付的合理开支;酌定赔偿可以作为惩罚性赔偿的基数;满足一定条件情况下的法定赔偿可以作为惩罚性赔偿的基数。综合考虑刑事罚金、行政罚款、惩罚性赔偿的关系。出台司法解释、发布指导性案例,规范地方法院裁判惩罚性赔偿案件数额标准不一致的情形。     

规范化法学教育实习基地的改革与完善

法学教育作为连接理论与实践的桥梁,其现状并不能满足当前法治实践的基本需求,折射出有的教育模式有偏离实践教育基本方向的重大迷失。基于客观存在的现实弊端,依托政法院校的天然优势,建立法学实习基地已然成为弥补这一缺失的共同认识。然而遗憾的是,尽管法学教育实习基地的建设已经蔚为壮观,但是在数量趋增的背后却较难看到高质量实践教育的成效。因此,对现有法学教育实习基地进行充分利用与资源挖掘,在实习基地与政法院校之间设置更为灵活有效的沟通衔接机制,根据法学学科的不同特点来打造专业化法学实习基地,通过规范化重塑来唤醒实习基地的应有机能则是未来完善的重心所在。     

“伪基站”案件法律适用及打防对策研究

＂伪基站＂违法犯罪活动是近年来出现的一种新型违法犯罪活动形式,对此类犯罪活动的定罪,目前存在法律适用上的矛盾,造成公安机关侦办此类案件的现实困境。对于＂伪基站＂违法犯罪活动,要加强社会的宣传与防范,整合各警种优势资源进行打击,藉以推动此类犯罪的规范立法。     

无线定位技术在公安业务中的应用

无线定位技术包括卫星定位、蜂窝网定位、局域网WiFi定位、UWB定位等,对它们进行比较研究后,可以归纳出它们在公安业务中的七大应用。当前的热点问题——伪基站的治理也需要应用到该技术。
